2.MEMBERSHIP

2.1Eligibility 

Youmustbeover18yearsofagetoregisterasamemberoftheServiceortousethisWebsite.ByusingtheWebsite,yourepresent,undertakeandwarrantthatyouhavetheright,authorityandcapacitytoenterintothisAgreementandtocomplywithalloftheTermsandConditions. 

2.2Membership

（a）YoumaybecomeamemberoftheServicefreeofcharge.FreemembershipwillonlyentitleyoutoparticipateinsomeofthefeaturesavailableaspartoftheService.Inordertoaccessadditionalfeatures,youmustbecomeapayingsubscribertotheService.Accordingly,youruseofthoseadditionalfeaturesisconditionaluponthepaymentoftherelevantfees.

（b）Youacknowledgeandagreethatinordertoprotecttheusersofthissite,youmaynotapplyfororbecomeamemberifyouhavebeenconvictedofanindictableoffenceorafelony.Byapplyingformembershipyouwarrantandrepresenttousthatyouhavenotbeenconvictedofanindictableoffenceorafelonynorareyourequiredtoregisterasasexoffenderwithanygovernmentauthority.Wereservetherighttoconductinvestigationsandbackgroundchecksonyou,toconfirmyouarenotinbreachofthisrepresentationandwarranty,andyouherebyconsenttoallowingustoconductsuchinvestigation.Wereservetherighttorefuseand/orterminateyourmembershipifyoubreachthiswarrantyoryourrepresentationprovestobefalse.

2.3Subscriptionplansandfees 

Subscriptionplansandtheircorrespondingfeesarelocatedatthe"UpgradeMembership"page.Thesesubscriptionfeesaresubjecttochange,whichchangeswillbepostedonthepageoftheWebsitepreviouslydescribed.Youacknowledgethattheremaybediscrepanciesinrelationtosubscriptionfeesbetweenjurisdictions,whichdiscrepanciesarereflectiveofcostsapplicabletoaparticularjurisdictionandothercommercialconditionsrelevanttothatjurisdiction. 

2.4Payment

（a）WhilecertainServicesareavailablefreeofcharge,youacknowledgethatthePaidServicesareavailableonlytoMemberswithavalidsubscriptionorotherwiseonpaymentofafee.Subscriptionscanbeacquiredattheprices,fortheperiodsandbythepaymentmethodsspecifiedontheupgrademembershippage.Pricesarestatedinthecurrencyshownontheupgrademembershippageandincludeallapplicabletaxesunlessotherwisestated.

（b）Yourmembershipwillbeautomaticallyrenewed.Youcanoptoutofauto-renewalatanytime.Ifyouhavenotoptedout,then,thesubscriptionwillbeauto-renewedfortheperiodsstated.Youcancancelauto-renewalbyfollowingtheinstructionsintheHelpsectionofthewebsite. 

（c）Wemayatanytimechangeourpriceforasubscription.Thenewratetakeseffectifyouapplyforanewsubscription（whetherornotitisyourfirstsubscription）afterwehavepostedthedetailsofournewpriceontheSite.Auto-renewalsofexistingsubscriptionwillcontinueattheoldprice. 

2.5MemberIDandpassword

Aspartofthememberregistrationprocess,youwillberequiredtoselectamemberID（username）andpassword.Wemayrefusetoacceptanyusernameforanyreason,includingthattheproposedmemberIDimpersonatessomeoneelse,isormaybeillegal,isormaybeprotectedbytrademarkorotherintellectualpropertylaw,isvulgarorotherwiseoffensive,ormaycauseconfusion,aswedetermineinourabsolutediscretion.YouaresolelyresponsiblefortheconfidentialityanduseofyourmemberIDandpassword（includingallactivitiesconductedunderyourMemberIDandpassword）andagreenottotransferorresellyouruseoforaccesstotheWebsitetoanythirdparty.Ifyouhavereasontobelievethatyouraccountisnolongersecure,youmustimmediatelynotifyusandyoumustpromptlychangeyourpasswordbyupdatingyouraccountinformation. 

2.6Payment

Intheeventthatweprovidearecurringbillingfacilityforthepaymentofsubscriptionfeesapplicabletothesubscriptionplanyouselect,youherebyauthorisetheCompanytochargethosefeesonarecurringbasis（withinareasonabletimepriortotheexpirationofyourcurrentsubscription）.Inthatcase,theCompanywillceasechargingfeesuponitsreceiptofyourwrittennoticethatsuchauthorisationhasbeenterminated.AnysuchnoticeshallnotaffectchargesmadebeforetheCompanycouldreasonablyact.Inanyevent,youmustprovidecurrent,completeandaccurateinformationtoenablesubscriptionfeestobechargedcorrectly,whichinformationmustbeupdatedregularly. 

3.THESERVICE

TheServiceisaninternetinformationservicethatfacilitatescontactbetweenmemberswhomayormaynotbeseekingfriendshiporarelationship.Itisnotamarriagebrokeringservice,mailorderbrideservicenoramatchmakingservice.TheCompanyisundernoobligationtobrokeranyothermemberormembersforyou.

4.OBLIGATIONOFUSER

4.1Ownrisk

YouacknowledgethatyouruseoftheServiceandtheWebsiteissolelyatyourownrisk.

4.2Accurateinformation

Yourepresent,warrantandundertakethattheinformationthatyousupplytotheService,theWebsiteandtheCompanyisaccurateinallrespects,notinbreachofthisAgreementandnotharmfultoanypersoninanyway.

4.3Informationnotconfidential

Youagreethatanymaterialorinformationprovidedbyyou,saveandexceptforanyPersonalInformation（whichmayincludeyourfullname,emailaddress,postaladdress,telephonenumberetc.）theuseofwhichisgovernedbyourPrivacyPolicy,willbetreatedasnon-confidentialandnon-proprietaryandwemayusesuchmaterialorinformationwithoutrestriction.Specifically,youconsenttotheCompanyusingsuchmaterialorinformation（includinganyphotographs,videooraudiorecordings）topre-populateadatabaseforanywebsiteownedandoperatedbytheCompanywhichissimilartotheWebsite.YouacknowledgethatanysuchmaterialorinformationprovidedbyyouwillbeavailableforothermembersorusersoftheWebsitetoread.

4.4Informationavailableoverseas

（b）CupidMediautilisesserversforthestorageofyourPersonalInformationwhichmaybelocatedinacountryotherthanyourcountryofresidence.YouconsenttothetransferofPersonalInformationtocountriesotherthanyourcountryofresidence,whichwillbefacilitatedbyCupidMediaonlyinaccordancewiththetermsofourPrivacyPolicy. 

4.5Copyrightassigned

YouagreethatallcopyrightwhichsubsistsinanymaterialorinformationprovidedbyyoutotheCompanyisassignedtotheCompany.Youwillnotpost,transmitorotherwiseprovideanymaterialorinformationinwhichthecopyrightisownedbyanotherpersonorentityandyouwarrantthatallmaterialandinformationprovidedisyouroriginalworkandnotsourcedfromanythirdparty.

4.6Legalaccess

YoumustensurethatyouraccesstotheWebsiteanduseoftheServiceisnotillegalorprohibitedbylawswhichapplytoyou.Youaresolelyresponsibleforthelegalityofyouractionsunderallapplicablelaws.

4.7Exposuretoviruses
