　　采用能适用长途空运以及气候变化，并能很好的防止野蛮装卸，防潮，防雨水侵蚀，防腐蚀，防震，防冻裂和防锈的坚固的木箱和纸箱进行包装，卖方应对包装不良以及未采取适当，正确的包装而造成的货物损坏和产生的费用承担全部的责任，箱内需包含一套完整的技术资料。

货物的包装应包括出口国家或地区政府植物检疫机构认可的企业按照中国出入境检验检疫局确认的检疫除害处理的方法，并加施政府植物检疫机构批准的Ippc标识。

　　由于没有熏蒸处理和木包装上无Ippc标识而造成的损失和后果，由卖方自行承担。

　　Allwoodenmaterialofshippingpackagemustbetreatedastherequirementsofentry-exitinspectionandQuarantinebureauofchina,bytheagentwhomiscertifiedbythegovernmentwherethegoodsisexported.AndthegoodsmustbemarkedwiththeIppcstamps,whicharecertifiedbythegovernmentagentofbotanical-InspectionandQuarantinebureau.

　　Allthelossesandresultscausedbynotheat-treatedandnoIppcmarksinthewoodenpackagesshallbebomebytheseller.4装箱标记

　　卖方应在每个包装箱上用不褪色的颜料标明包装箱号，毛重，净重，尺寸，以及下列字样“注意防潮”，“轻拿轻放”此边在上“等，并标明下列装运标记。

客户需要在合同签订后三十天内完成填好美国商务部的bIs-711表格和生产商要求的最终用户声明表格。

生产商是不会对由于未能遵守美国出口调理而引起的任何耽搁，延误交货负责。

卖方收到相关部门出具的出口许可证或者工厂出具的不需要出口许可这个的声明后，会即时通知买方。

23贸易术语24廉政条款

　　9．索赔：

买方对合同项下装运货物的任何索赔必须于货物到达目的港后30天内提出并必须提供经卖方同意的检验机构出具的检验报告供卖方审核。

在任何情况下卖方对间接损失不承担赔偿责任，属于保险公司、船公司、运输机构和/或邮局责任范围内的索赔卖方不予受理。

　　10．不可抗力：

由于发生人力不可抗拒的原因，致使本合约不能履行，部分或全部商品延误交货，卖方概不负责，但应立即通知买方。

本合同所指的不可抗拒力系指不可干预、不能避免且不能克服的客观情况。

ThesellershallnotbeheldresponsibleforfailureordelayindeliveryoftheentirelotoraportionofthegoodsunderthissalescontractinconsequenceofanyForcemajeureincidentswhichmightoccur,andthesellershallnotifythebuyerassoonaspossible.Forcemajeureasreferredtointhiscontractmeansunforeseeable,unavoidableandinsurmountableobjectiveconditions.

凡因本合同引起的或本合同有关的任何争议，如果协商不能解决，应提交中国国际经济贸易仲裁委员会内蒙分会。

按照申请仲裁时该会当时实施的仲裁规则进行仲裁。

仲裁裁决是终局的，对双方具有约束力。

　　1.1甲方承诺并保证对本节目享有合法之版权，可授权乙方依本合约所列对应权利，乙方依本合约行使权利时，绝无任何侵害他人版权、独家代理发行权、商标权或任何其它权利之疑，如有纠纷或第三者提出版权异议的情况，甲方愿意承担理清和处理所发生的一切法律责任及相关事宜和费用，且不得因此损及乙方之利益。
