一、成立业主委员会换届筹备组

（一）筹备组成员的条件和人数

业主委员会换届筹备组由原业主委员会委员、业主代表和居（村）民委员会代表组成换届选举筹备组五-七人组成，筹备组成员人数应为单数。

居（村）民委员会代表担任筹备组组长，组织、协调业主大会的筹备工作。

（二）筹备组的成立程序

1.申请和倡议

1、由原业主委员会向新建县房管部门、新建县街道办事处提交《业主委员会换届选举申请书》

2、由原业主委员会向居（村）民委员提交《关于组建换届选举业主委员会委员筹备组的倡议》，居（村）民委员在《倡议》上盖章确认同意成立。

2.公示

经居（村）民委员会确认的《关于组建换届选举业主委员会委员筹备组的倡议》，在小区内张贴公示7日，告知全体业主关于组建换届选举业主委员会委员召开业主大会筹备组的事宜。

3.公示期内业主自荐

《关于成立换届选举业主委员会委员筹备组的倡议》公示期间，自荐参与筹备组成员的业主填写《换届选举业主委员会筹备组成员自荐表》，将表格送到居（村）民委员会或者《倡议》上指定的业主处。

4．筹备组的产生

《关于组建换届选举业主委员会委员筹备组的倡议》公示期满后，居（村）民委员会收到业主自荐表不超过规定的业主代表人数的，这些自荐的业主即成为筹备组成员。

超过规定的业主代表人数的，居（村）民委员会召集所有自荐人选举筹备组成员。

其中，自荐业主中是原业主委员委员的，可直接成为本次换届选举业主委员会委员筹备组成员。

业主为法人或者其他组织，委托其工作人员参加筹备组的，应当书面委托。

筹备组中的业主代表也可由街道办事处（镇人民政府）和居（村）民委员会直接推荐产生。

筹备组成员名单及简历应当自成立之日起7日内在物业管理区域的显著位置公示。

5.筹备组的确立

筹备组填写《换届选举业主委员会委员筹备组备案表》，连同《关于成立换届选举业主委员会委员筹备组的倡议》、《筹备组成员自荐表》和筹备组成员名单及简历复印件送物业所在地的居（村）民委员会和房管部门备案。

业主对筹备组成员有异议的，由街道办事处（镇人民政府）和居（村）民委员会协调解决。

筹备组将筹备组成员名单、简历及《换届选举业主委员会委员筹备组备案表》应当自成立之日起七日内在物业管理区域的显著位置公告。

筹备组自成立之日起60天内应当组织召开换届选举业主委员会委员业主大会。

6.筹备组职责

（1）起草本届业主委员会工作情况的报告；

（2）确定业主会会议召开的时间、地点、形式和内容；

（3）确认业主身份，确定业主在业主大会会议上的投票权数；

（4）确定新一届业委会候选人；

（5）做好召开业主大会会议的其他准备工作。

前款内容应当在业主大会会议召开15日前在物业管理区域的显著位置公告并书面通知全体业主。

筹备组的会议材料等应妥善保管，并于本物业区域的业主委员会成立后5日内移交业主委员会。

（三）决定表决事项、确认业主人数和投票权数

1.筹备组应决定业主大会的表决事项，下列

（1）是必选事项，

（2）～（10）是可选事项：

（1）选举业主委员会成员；

（2）修改《业主大会议事规则》；

（3）修改《管理规约》；

（4）制定新的物业服务内容、标准以及物业服务收费方案；

（5）选聘和解聘物业服务企业或者其他管理人；

（6）筹集和使用专项维修资金；

（7）改建、重建建筑物及其附属设施；

（8）改变共有部分的用途；

（9）利用共有部分进行经营以及所得收益的分配与使用；

（10）有关共有和共同管理权利的其他重大事项。

2.确认业主人数和投票权数

筹备组向物业管理公司及原业主委员会索取业主资料，确认业主人数，确定每户业主在首次业主大会上的投票权数。

物业服务企业应当协助业主大会筹备组工作，向业主大会筹备组提供业主清册，并在物业管理区域提供相应的人力、场地支持。

三、推选换届选举业主委员会委员候选人

（一）业主委员会委员候选人的资格条件

业主委员会委员候选人应当具备《业主大会议事规则》规定的条件。

业主委员会委员候选人应书面承诺，自愿成为新一届业主委员会委员，愿意在任期内积极为业主服务，保证公正廉洁、勤勉尽责，不随意辞职。

（二）发出业主委员会委员候选人推荐的通知

筹备组发出《关于推荐换届选举业主委员会委员候选人的通知》，向全体业主征集候选人以及相关意见。

在公示期内，符合候选人资格条件的业主填写《业主委员会委员候选人简历表》，提供《业主委员会委员候选人推荐表》，连同身份证复印件（核对原件后退还）和房产证明复印件（核对原件后退还）一起交给筹备组。

（三）候选人的产生

筹备组在公示期满后将收集到的名单和资料做好整理核实，最终确定候选人名单。

筹备组将整理、核实过的候选人名单、简历表在物业管理区域的显著位置公示至投票表决通过该两份文件为止，并同时告知业主召开。

业主大会会议的形式和时间。

四、发出召开业主大会通知

在候选人名单和简历公示满，同时筹备组填写好《关于召开换届选举业主委员会委员和业主大会的通知》，连同本“指引”中“筹备组职责”内容以及会议时间、地点、议题和议程在业主大会会议召开15日前以书面形式在物业管理区域的显著位置公告。

业主对公告内容有异议的，筹备组应当记录并作出答复。

在公示期内，筹备组及时告知物业所在地的房地产行政主管部门、街道办事处（镇人民政府）和居（村）民委员会，并印刷好《换届选举业主委员会委员选票》。

五、召开业主大会，投票表决产生新一届业主委员会委员等事项

业主大会会议可以采用集体讨论或者书面征求意见的形式，也可以采取集体讨论与书面征求意见相结合的形式召开。

采用的投票方式必须与《业主大会议事规则》规定相一致。

业主可以委托代理人参加业主大会会议，必须符合《业主大会议事规则》约定，业主和代理人应当签订《业主参加换届选举业主委员会委托书》，代理人持业主委托书并根据委托内容进行投票表决，委托书应载明委托内容、委托期限、委托权限等内容。

首次业主大会按照《业主大会议事规则》规定是否实行差额投票选举方式产生首届业主委员会，并确定委员人数。

如果回收的选票未达到规定的票数，筹备组可以向镇（街道办）申请延期，继续回收选票，延迟时间一般不超过60天。

在延期内，筹备组应积极发动未投票的业主参与投票。

若业主大会按照上述流程仍未能通过的，应当按规定重新向物业所在地街道办事处（镇人民政府）、居（村）民委员会提出成立换届选举业主委员会委员筹备组申请。

六、推选业主委员会主任、副主任及业主委员会分工

业主委员会自产生之日起三日内召开首次业主委员会会议，推选产生主任1人，副主任1～2人，以及其他职责人员。

七、公示表决结果

将业主大会的投票表决结果、业主委员会名单及分工在小区内显著位置公示5日，业主有权查询相关材料。

八、备案、刻章

（一）备案

业主委员会应当自选举产生之日起30日内，提交以下资料备案：

1.《南昌市业主委员会备案登记申请表》；

2.业主大会的会议记录、会议决定和会议表决结果；

3.业主委员会委员（候补委员）名单及其基本情况、分工安排；

4.其他资料。

居（村）民委员会、街道办事处（镇人民政府）加具意见后到区建设房产行政管理部门备案。

区建设房产行政管理部门应当在收到上述材料后5日内发出备案回执。

业主委员会收到备案回执后，应将备案情况告知物业服务企业，并在物业管理区域的显著位置公告。

（二）刻章

业主委员会凭区建设房产行政管理部门的备案回执，向公安机关申请刻制印章，按照《业主大会议事规则》的规定和业主大会的决定使用。

印章应当标明业主委员会的届数。
