InternationalChamberofCommerce(the“ICCBankingCommission”)charteredaTask
Forcetodocumentinternationalstandardbankingpracticefortheexaminationofdocuments
asreflectedinthearticlesoftheUniformCustomsandPracticeforDocumentaryCredits.
WhiletheTaskForcehasbaseditsworkonInternationalChamberofCommercePublication
No.500(UCP),theprinciplessetforthherearelikelytobegenerallyapplicableto
succeedingrevisions,becausethisstatementofpracticeisconsistentwiththeUCPandthe
OpinionsandDecisionsoftheICCBankingCommission.Thefinalproductreflectstheinput
fromICCNationalCommitteesandindividualICCmembers.Gratefulacknowledgementis
madeofthethousandsofhourscontributedbymembersoftheTaskForceandothers.
IntheopinionoftheICCBankingCommission,thisdocumentstatesinternationalstandard
bankingpracticeasreflectedinthearticlesofUCP.Thisdocumentsupplementsandexplains
thepracticesonwhichtheUCPisbasedandshouldnotbeviewedasanamendmenttothe
UCP.SomeofthesepracticesareassumedinUCP,whileothersareimplied,thereforethis
documentmustbereadinconjunctionwiththerelevantUCPprovisions.
Noexercisecananticipateallthetermsorthedocumentsthatmaybeusedinconnectionwith
documentarycredits(“credits”)ortheirinterpretationundertheUCPandthestandard
practiceitreflects,muchlesstheevolutionofpracticeinresponsetochangingcommercial
needs.Nevertheless,aseriousattempthasbeenmadetoaddressdiscreteissuesthat
commonlyarisebutarenotexpresslytreatedintheUCPinlightoftheprinciplesthatshape
standardbankingpractice.TheapplicationoftheUCP,andthepracticesdocumentedinthis
publication,shouldenablepartiestodealsuccessfullywithalmostanyexamination
eventuality.
Apartfromtechnicalrulesofstandardpracticeitmustberecognizedthatthesuccessful
completionofatransactionalsorequiresgoodfaithonthepartofallinvolvedandthe
exerciseofsoundjudgement.
Itmustalsoberecognisedthatthecreditcanvarystandardbankingpractice,asstatedin
Article1ofUCP.AnyterminacreditwhichmodifiesoraffectstheapplicabilityoftheUCP
willalsohaveanimpactonthestandardbankingpractices.Therefore,inconsidering
documentarycompliance,partiesmustobserveandtakeintoaccountanyterminacreditthat
expresslyexcludesormodifiesaprovisioninanArticleoftheUCP.Whilethisprincipleis
assumedthroughoutthisdocument,itissometimesexpresslystatedforemphasisorto
illustrateaprinciple.Theabsenceofsuchareference,however,doesnotimplythattheterms
ofthecreditmaynotoverridethegeneralpropositionstatedinthesepractices.

Thispublicationisorganisedintothreeparts.Thefirstis“PreliminaryConsiderations”.The
secondaddresses”GeneralPrinciples”whichmayapplytoanydocument.Thethirddeals
withdocumentscommonlyrequiredbycredits.
TheInternationalStandardBankingPracticefortheExaminationofDocumentsarticulates
internationalstandardbankingpracticeforissuers,nominatedbanks,andbeneficiaries.
Applicants,however,shouldnotassumethattheymayrelyontheseprovisionsinorderto
excusetheirobligationstoreimbursetheissuer,sincetheirobligations,rights,andremedies
dependupontheirundertakingwiththeissuer,theperformanceoftheunderlyingtransaction,
andthetimelinessofanyobjectionunderapplicablelawandpractice.
TheUCPandthispublicationshouldbereadintheirentirety.Pleasenotethattheheadingof
eachsectionisforreferenceastointentandpurposeonly.Itisnottobeconstruedasother
thansolelyforbenefitorguidance.Thereshouldbenolegalimputation.

PRELIMINARYCONSIDERATIONS
TheApplicationandIssuanceoftheCredit
1.Thetermsofacreditareindependentoftheunderlyingtransactionevenifthecredit
expresslyreferstothattransaction.Toavoidunnecessarycosts,delays,anddisputesin
theexaminationofdocuments,however,theapplicantandbeneficiaryshouldcarefully
considerwhichdocumentsshouldberequired,bywhomtheyshouldbeproduced,and
thetimeframeforpresentation.
2.Theapplicantbearstheriskofanyambiguityinitsinstructionstoissueoramendacredit.
Unlessexpresslystatedotherwise,arequesttoissueoramendacreditauthorizesan
issuertosupplementordevelopthetermsinamannernecessaryordesirabletopermit
theuseofthecredit.
3.TheapplicantshouldbeawarethattheUCPcontainsarticlessuchasArticles13,20,21,
23,24,26,27,28,39,40,46and47thatdefinetermsinamannerthatmayproduce
unexpectedresultsunlesstheapplicantfullyacquaintsitselfwiththeseprovisions.For
example,inacreditrequiringpresentationofamarinebilloflading,aprohibition
againsttranshipmentwillhavetospecificallyexcludeUCP500Sub-Article23d.A
statementinacreditthattranshipmentisprohibitedwillstillallowtranshipmenttooccur,
subjecttotheconditionsoftheabovesub-Article.
4.Acreditshouldnotrequirepresentationofdocumentsthataretobeissuedand/or
countersignedbytheapplicant.Ifthecreditisissuedincludingsuchterms,the
beneficiarymusteitherseekamendmentorcomplywiththemandbearstheriskoffailure
todoso.
5.Manyoftheproblemsthatariseattheexaminationstagecouldbeavoidedorresolvedby
carefulattentiontodetailintheunderlyingtransaction,thecreditapplication,and
issuanceofthecreditasdiscussed.

GENERALPRINCIPLES
IssuerofDocuments
6.Whereacreditindicatesthatadocumentistobeissuedbyanamedentity,thecondition
issatisfiedif:
a)thedocumentappearstobeissuedbythenamedentity-i.e.onitsletterheador
specifiedformand,ifrequired,appearstobesignedbythenamedentity;or
b)thedocumentisissuedonunheadedpaperbutwithinitsbodythereisevidenceof
completionbyand/orsignatureofthenamedentity.
Language
7.Accordingtointernationalstandardbankingpractice,documentsmustbeissuedinthe
languageofthecredit.Anissuingbankwhichrequiresdocument(s)inanotherlanguage(s)
thanthatofthecreditmustsostateinthecredit.Whenacreditstatesthatdocumentsin
twoormorelanguagesareacceptable,anominatedbankmayinitsadviceofthecredit
limitthenumberofacceptablelanguagesasaconditionofitsengagementintheircredit
orconfirmation.
Dates
8.Documentssuchasdrafts,certificates,declarations,statements,transportdocumentsand
insurancedocumentsmustbedatedandsigned.Whetherotherdocumentsrequiredating
willdependonthenatureandcontentofthedocumentinquestion.Arequirementfora
documenttobedated-otherthanthosementionedabove-maybesatisfiedbylinkage
withinitscontenttothedateofanotherdocumentformingpartofthesamepresentation
(e.g.whereashippingcertificatewillbeissuedwhichstates“dateasperbilloflading
numberxxx”orsimilar).
9.Documentsmaybeissuedafterthedateofshipment.However,theissuancedateof
documentsmustnotbelaterthanthedatethedocumentsarepresented.Whereacredit
requiresapre-shipmentinspectioncertificateoradocumentincorporatingsuchwording,
itmayalsobeissuedafterthedateofshipment.However,insuchcase,eitheritstitleor
contentmustindicatethatinspectiontookplacepriortooronthedateofshipment.

10.Adocumentindicatingadateofpreparationandadateofsigningisdeemedtobeissued
onthedateofsigning.
11.Theruleforpresentationinsub-Article43(a)ofUCP500onlyappliestopresentations
thatmustcontainoriginaltransportdocuments.Thetransportdocumentsarethosewhich
fallunderthecategorytobereviewedunderArticles23–29.
12.Phrasesareoftenusedtosignifytimeoneithersideofadateorevent.
a)“within2daysof”or“within2daysafter”indicatesaperiodfromthedateofthe
eventuntil2daysaftertheevent.Theterm“within”whenusedinconnectionwitha
dateexcludesthatdateincalculationoftheperiod.
b)“notlaterthan2daysafter”doesnotindicateaperiod,onlyalatestdate.Ifanadvice
mustnotbedatedpriortoaspecificdate,thecreditmustsostate.Wherethe
documentindicatesthattheeventhasalreadyoccurred,thetimebeforecannotbe
included.
c)“atleast2daysbefore”indicatesthatsomethingmusttakeplacenotlaterthan2days
beforeanevent.Thereisnolimitastohowearlyitmaytakeplace.
13.Datesmaybeexpressedindifferentformatsprovidedthatthedateintendedcanbe
determinedfromthedocumentorpresentation.Forexample,the12thofNovember2001
couldbeexpressedas12Nov01,12Nov01,12.11.2001,12.11.01,2001.11.12,11.12.01,
121101,etc.Toavoidconfusionitisrecommendedthatthenameofthemonthshouldbe
usedinsteadofthenumber.ICCOpinionR210.
TitleofDocuments
14.Documentsshouldbetitledascalledforinthecredit,orbearatitleofsimilarintent,or
maybeuntitled.Forexample,acreditrequirementfora“PackingList”mayalsobe
satisfiedbyadocumenttitled“PackingNote”or“PackingandWeightList”,etc.The
contentofadocumentmustappeartofulfillthefunctionoftherequireddocument.Inthe
aboveexampleitmustincludepackingdetails.
