Issueandobjectives
TheHazardousProductsAct(HPA)prohibitsorrestrictstheadvertisement,saleandimportationofproductswhichare,orarelikelytobe,adangertothehealthorsafetyofthepublic.UndertheSurfaceCoatingMaterialsRegulations,ineffectsinceApril19,2005,HealthCanada(HC)seta600mg/kgtotalleadlimitforsurfacecoatingmaterials,includingpaintsorothersimilarmaterialsthatdrytoasolidfilmwhenalayerofitisappliedtoasurface,butnotincludingmaterialsthatbecomeapartofthesubstrate.HealthCanadaalsoprohibits,underPartIofScheduleItotheHPA,children’stoys(paragraph9(b)),furnitureandotherarticlesforchildrenotherthantoys(item2)aswellaspencilsandartists’brushes(item18)thathaveasurfacecoatingmaterialappliedtothemthatcontainsmorethan600mg/kgtotallead.
Excessivelevelsofleadcancausemanyseverehealtheffectsinyoungchildrenrangingfromkidneydamagetoimpairedintellectualdevelopment.Reducingleadinchildren’sproductsisaveryimportantissuearoundtheworld.
EffectiveAugust14,2009,intheUnitedStates(U.S.),thetotalleadlimitsetoutunderTitle16:
CommercialPracticesoftheCodeofFederalRegulations(CFR)Part1303(16CFR1303),BanofLead-ContainingPaintandCertainConsumerProductsBearingLead-ContainingPaint,wasreducedfrom600mg/kgto90mg/kginaccordancewithsection101(f)oftheConsumerProductSafetyImprovementActof2008(CPSIA)[www.cpsc.gov/cpsia.pdf].Thisappliestopaintsandsimilarsurfacecoatingmaterialsforconsumeruse,aswellastoysandotherarticlesintendedforusebychildrenandfurniturearticlesforconsumerusethathaveasurfacecoatingmaterialappliedtothem.
ThisamendmentisintendedtoprotectthehealthandsafetyofCanadianchildrenwhileatthesametimeitalignsCanadawiththeU.S.withrespecttototalleadlevelsinsurfacecoatingmaterialsandcertainproductsthatcontainsurfacecoatingmaterials:

(1)and5
(1)andsection8oftheSurfaceCoatingsMaterialsRegulations,thetotalleadlimitisnow90mg/kg.
∙The90mg/kgtotalleadlimitalsoappliestofurnitureandotherarticlesforchildren(item2),toys,equipmentandotherproductsforusebyachildinlearningorplay(paragraph9(b))andpencilsandartists’brushes(item18)underPartIofScheduleItotheHPA.
Thefollowingadministrativeamendmentsarealsomade:
∙Paragraph9(b)ofPartIofScheduleItotheHPAwasrenumberedtoparagraph9(a);
and
∙Item2,paragraph9(a)anditem18ofPartIofScheduleItotheHPAwererewordedasrequiredtoensureconsistency.
Descriptionandrationale
Leadisaninexpensive,soft,heavymetalthatcanbeusedinsurfacecoatingmaterialstoreducedryingtimeandincreasedurability.Leadcanalsobeusedincertainpigments.However,exposuretoleadmaybeharmfultohealth,particularlyinchildren.Leadcanenterthebodythroughthedigestivesystemorthelungs.Itaccumulatesinthebodyandcandamagethenervoussystem,thekidneys,andtheblood-formingandreproductivesystems.Leadhasalsobeenshowntocauseintellectualandbehaviouraldeficitsinchildren.
Theformer600mg/kgtotalleadlimitforsurfacecoatingmaterialsundertheSurfaceCoatingMaterialsRegulationsandvariousproductstowhichsurfacecoatingmaterialshavebeenappliedunderitem2,paragraph9(b)anditem18ofPartIofScheduleItotheHPAwasbasedona1972toxicologicalassessmentbytheAmericanAcademyofPediatricsCommitteeonEnvironmentalHealth,whichwasaffirmedbytheNationalAcademyofSciencesin1973(seehttp:
//pediatrics.aappublications.org/cgi/reprint/49/6/918).ThislimitwasvoluntarilyadoptedbytheCanadianPaintandCoatingsAssociation(CPCA)in1991forallCanadianproducedconsumerpaints.Atthetime,italsoalignedwiththetotalleadlimiteffectivebetweenSeptember1,1977andAugust14,2009intheU.S.under16CFR1303.
Arecalculationofthe1972toxicologicalassessmentforleadbyHCin2008usingcurrentinformationshowedthatreducingthetotalleadlimitinsurfacecoatingmaterialstolessthan113mg/kgwouldresultinadailyleadintakebyachildthatisbelowthetolerabledailyintake(TDI)valueforleadcurrentlyestablishedbytheWorldHealthOrganizationandendorsedbyHC.Therefore,the90mg/kgtotalleadlimitforsurfacecoatingmaterialsadoptedintheU.S.andrecentlyadoptedinCanadaisconsideredtoprovideadequateprotectiontochildrenfromleadexposurethroughingestionofsurfacecoatingmaterials.AligningthetotalleadlimitforsurfacecoatingmaterialsinCanadaandtheU.S.ensuresthatCanadianchildrenhavethesamelevelofprotectionfromleadexposureaschildrenintheU.S.
BasedontheresultsofHCsurveys(seeTable1)andinformationreceivedfromindustryassociationsaffectedbythisproposal,thecostimpactofreducingthetotalleadlimitinsurfacecoatingmaterialsto90mg/kgwouldbelowtonegligible.MembersoftheCPCA,representingalmost90%ofCanadianpaintsales,arecompliantwiththe90mg/kgtotalleadlimit.Thisamendmentwillnotintroduceanynewcostsforthesurfacecoatingmaterialsindustry.Complianceislower(seefootnote2)overallfortheotherproductssubjecttothe90mg/kgtotalleadlimit,butvariesbetweenproductcategories.Giventherelativelysmallpercentageofproductsthatwerecompliantwiththeformertotalleadlimitof600mg/kgbutnotthecurrenttotalleadlimitof90mg/kg,itisestimatedthatthecostimpactofthisproposalontheaffectedindustrieswillbelow.

AligningCanadianandU.S.totalleadlimitsisimportantforboththepublicandindustry.ItallowsaconsistentleadlevelwhichallindustrymembersintheU.S.andCanadacanfollow,simplifyingtradebetweencountries.AmendingtheCanadianrequirementsalsosupportsthegovernment’scommitmenttotheFoodandConsumerSafetyActionPlan;
acomprehensivesetofproposedmeasuresthatwillmakeCanadianssaferbylegislatingtougherfederalgovernmentregulationoffood,health,andconsumerproducts.ItalsosupportstheLeadRiskReductionStrategyforConsumerProducts,whichlimitsleadexposuretochildrenthroughanumberofdifferentconsumerproducts.

InJanuary2009,apre-consultationletteroutliningtheproposedamendmentstotheSurfaceCoatingMaterialsRegulations,aswellasitem2,paragraph9(b)anditem18ofPartIofScheduleItotheHPAwassenttosixassociationsrepresentingthefollowingindustries:
