Notvery.Theruleswerewrittenbyagroupofarbitratorswhohadexperiencearbitratinginmanydifferentcountries.TheysimplyputintheIBARuleswhattheyusuallywroteintheirordersfordirections-i.e.,theirbestpractice.ThatishowproceduresnotgenerallyusedinstatecourtsproceedingswerebuiltintotheIBARules,suchasextensivewrittensubmissionsaccompaniedbyearlysubmissionofdocuments,witnessstatementswithlivecross-examinationofwitnesses,andfreeassessmentoftheevidencebythearbitraltribunal.Forthesamereason,technicalrulesofevidence,suchasthehearsayrule,donotapplyininternationalarbitration.Thereare,however,afewimportantpointsthatarenotcoveredbytheIBARulesorarejustglossedover.

No,thedifferencescomefromhistoryandhabitmostly.ThesehaveshapedtheorganizationofthecourtsandthelegalprofessioninthecommonlawworldforcenturieswithoutthedramaticchangethatshookContinentalthelittlemorethan200yearsago.ItisonlyEuropealittlemorethan200yearsago.Itisonlyoverlittlemorethantwocenturiesthatlegislatorsintwo-thirdsoftheworldstartedcreatingsystematiccodes.OntheEuropeancontinent,weowetheRomanssomebasicideas,butthedetailsarehardlyolderthan200years.ThereisalsoquiteabitmoreRomanlawinthecommonlawthanmanypeoplerealize.
