Article1

ThisLawisformulatedinaccordancewiththeConstitutionandtheactualsituationinourcountry,drawinguponourpracticalexperienceincivilactivities,forthepurposeofprotectingthelawfulcivilrightsandinterestsofcitizensandlegalpersonsandcorrectlyadjustingcivilrelations,soastomeettheneedsofthedevelopingsocialistmodernization.

Article2

TheCivilLawofthePeople'

sRepublicofChinashalladjustpropertyrelationshipsandpersonalrelationshipsbetweencivilsubjectswithequalstatus,thatis,betweencitizens,betweenlegalpersonsandbetweencitizensandlegalpersons.

Article3

Partiestoacivilactivityshallhaveequalstatus.

Article4

Incivilactivities,theprinciplesofvoluntariness,fairness,makingcompensationforequalvalue,honestyandcredibilityshallbeobserved.

Article5

Thelawfulcivilrightsandinterestsofcitizensandlegalpersonsshallbeprotectedbylaw;

noorganizationorindividualmayinfringeuponthem.

Article6

Civilactivitiesmustbeincompliancewiththelaw;

wheretherearenorelevantprovisionsinthelaw,theyshallbeincompliancewithstatepolicies.

Article7

Civilactivitiesshallhaverespectforsocialethicsandshallnotharmthepublicinterest,ugogoocialeconomicorder.

Article8

ThelawofthePeople'

sRepublicofChinashallapplytocivilactivitieswithinthePeople'

sRepublicofChina,exceptasotherwisestipulatedbylaw.

ThestipulationsofthisLawasregardscitizensshallapplytoforeignersandstatelesspersonswithinthePeople'

Section1CapacityforCivilRightsandCapacityforCivilConduct.

Article9

Acitizenshallhavethecapacityforcivilrightsfrombirthtodeathandshallenjoycivilrightsandassumecivilobligationsinaccordancewiththelaw.

Article10

Allcitizensareequalasregardstheircapacityforcivilrights.

Article11

Acitizenaged18orovershallbeanadult.Heshallhavefullcapacityforcivilconduct,mayindependentlyengageincivilactivitiesandshallbecalledapersonwithfullcapacityforcivilconduct.

Acitizenwhohasreachedtheageof16butnottheageof18andwhosemainsourceofincomeishisownlabourshallberegardedasapersonwithfullcapacityforcivilconduct.

Article12

Aminoraged10orovershallbeapersonwithlimitedcapacityforcivilconductandmayengageincivilactivitiesappropriatetohisageagogohallberepresentedbyhisagentadlitemorparticipatewiththeconsentofhisagentadlitem.

Aminorundertheageof10shallbeapersonhavingnocapacityforcivilconductagogoagentadlitem.

Article13

Amentallyillpersonwhoisunabletoaccountforhisownconductshallbeapersonhavingnocapacityforcivilconductagogoagentadlitem.

Amentallyillpersonwhoisunabletofullyaccountforhisownconductshallbeapersonwithlimitedcapacityforcivilconductandmayengageincivilactivitiesappropriatetohismentalhealth;

inothercivilactivities,heshallberepresentedbyhisagentadlitemorparticipatewiththeconsentofhisagentadlitem.

Article14

Theguardianofapersonwithoutorwithlimitedcapacityforcivilconductshallbehisagentadlitem.

Article15

Thedomicileofacitizenshallbetheplacewherehisresidenceisregistered;

ifhishabitualresidenceisnotthesameashisdomicile,hishabitualresidenceshallberegardedashisdomicile.

Article16

Theparentsofaminorshallbehisguardians.Iftheparentsofaminoraredeadorlackthecompetencetobehis

guardian,apersonfromthefollowingcategorieswhohasthecompetencetobeaguardianshallactashisguardian:

（1）paternalormaternalgrandparent;

（2）elderbrotherorsister;

or

（3）anyothercloselyconnectedrelativeorfriendwillingtobeartheresponsibilityofguardianshipandhavingapprovalfromtheunitsoftheminor'

sparentsorfromtheneighbourhoodorvillagecommitteeintheplaceoftheminor'

sresidence.Incaseofadisputeoverguardianship,theunitsoftheminor'

sparentsortheneighbourhoodorvillagecommitteeintheplaceofhisresidenceshallappointaguardianfromamongtheminor'

snearrelatives.Ifdisagreementovertheappointmentleadstoalawsuit,thepeople'

scourtshallmakearuling.Ifnoneofthepersonslistedinthefirsttwoparagraphsofthisarticleisavailabletobetheguardian,theunitsoftheminor'

sparents,theneighbourhoodorvillagecommitteeintheplaceoftheminor'

sresidenceorthecivilaffairsdepartmentshallactashisguardian.

Article17

Apersonfromthefollowingcategoriesshallactasguardianforamentallyillpersonwithoutorwithlimitedcapacityforcivilconduct:

（1）spouse;

（2）parent;

（3）adultchild;

（4）anyothernearrelative;

（5）anyothercloselyconnectedrelativeorfriendwillingtobeartheresponsibilityofguardianshipandhavingapprovalfromtheunittowhichthementallyillpersonbelongsorfromtheneighbourhoodorvillagecommitteeintheplaceofhisresidence.Incaseofadisputeoverguardianship,theunittowhichthementallyillpersonbelongsortheneighbourhoodorvillagecommitteeintheplaceofhisresidenceshallappointaguardianfromamonghisnearrelatives.Ifdisagreementovertheappointmentleadstoalawsuit,thepeople'

scourtshallmakearuling.

Ifnoneofthepersonslistedinthefirstparagraphofthisarticleisavailabletobetheguardian,theunittowhichthementallyillpersonbelongs,theneighbourhoodorvillagecommitteeintheplaceofhisresidenceorthecivilaffairsdepartmentshallactashisguardian.

Article18

Aguardianshallfulfilhisdutyofguardianshipandprotecttheperson,propertyandotherlawfulrightsandinterestsofhisward.Aguardianshallnothandlethepropertyofhiswardunlessitisintheward'

sinterests.

Aguardian'

srightstofulfilhisguardianshipinaccordancewiththelawshallbeprotectedbylaw.Ifaguardiandoesnotfulfilhisdutiesasguardianorinfringesuponthelawfulrightsandinterestsofhisward,heshallbeheldresponsible;

ifaguardiancausesanypropertylossforhisward,heshallcompensateforsuchloss.Thepeople'

scourtmaydisqualifyaguardianbasedontheapplicationofaconcernedpartyorunit.

Article19

Apersonwhosharesinterestswithamentalpatientmayapplytoapeople'

scourtforadeclarationthatthementalpatientisapersonwithoutorwithlimitedcapacityforcivilconduct.

Withtherecoveryofthehealthofapersonwhohasbeendeclaredbyapeople'

scourttobewithoutorwithlimitedcapacityforcivilconduct,anduponhisownapplicationorthatofaninterestedperson,thepeople'

scourtmaydeclarehimtobeapersonwithlimitedorfullcapacityforcivilconduct.

Article20

Ifacitizen'

swhereaboutshavebeenunknownfortwoyears,aninterestedpersonmayapplytoapeople'

scourtforadeclarationofthecitizenasmissing.

Ifaperson'

swhereaboutsbecomeunknownduringawar,thecalculationofthetimeperiodinwhichhiswhereaboutsareunknownshallbeginonthefinaldayofthewar.

Article21

Amissingperson'

spropertyshallbeplacedinthecustodyofhisspouse,parents,adultchildrenorothercloselyconnectedrelativesorfriends.

Incaseofadisputeovercustody,ifthepersonsstipulatedaboveareunavailableorareincapableoftakingsuchcustody,thepropertyshallbeplacedinthecustodyofapersonappointedbythepeople'

scourt.Anytaxes,debtsandotherunpaidexpensesowedbyamissingpersonshalldefrayedbythecustodianoutofthemissingperson'

sproperty.
