PhilippinePlantVarietyProtectionActof2002"

Sec.2.StatementofPolicies.

a）TheStaterecognizesthataneffectiveintellectualpropertysystemingeneralandthedevelopmentofnewplantvarietyinparticularisvitalinattainingfoodsecurityforthecountry.Tothisend,itshallprotectandsecuretheexclusiverightsofbreederswithrespecttotheirnewplantvarietyparticularlywhenbeneficialtothepeopleforsuchperiodsasprovidedforinthisAct.

b）Theuseofintellectualpropertybearsasocioeconomicfunction.Tothisend,theStateshallpromotethediffusionoftechnologyandinformationforthepromotionofnationaldevelopmentandprogressforthecommongood.

c）TheStaterecognizestheindispensableroleoftheprivatesector,encouragestheparticipationofprivateenterprisesandprovidesincentivestoneededinvestmentsinthedevelopmentofnewplantvarieties.

d）TheStaterecognizesthatscienceandtechnologyareessentialfornationaldevelopmentandpromotestheadaptationoftechnologyandknowledgefromallsourcesforthenationalbenefit.TheStatealsorecognizestheneedtoprotectandsecuretheexclusiverightsofscientistsandothergiftedcitizenstotheirintellectualpropertyandcreations.

e）TheState,whilerecognizingintellectualpropertyrightsinthefieldofagriculture,doessoinamannersupportiveofandnotinconsistentwithitsobligationtomaintainahealthfulecologyinaccordwiththerhythmandharmonyofnature.

TITLEII

Definitions

Sec.3.Definitions.-

a）"

Applicant"

meansthebreederwhoappliesforthegrantofaCertificateofPlantVarietyProtection.

b）"

Board"

meanstheNationalPlantVarietyProtectionBoardcreatedbythisAct.ItshallalsorefertotheNationalSeedIndustryCouncilduringthetransitionperiodfromtheeffectivityofthisActuptothetimethesaidBoardhasbeenorganizedandoperating.

c）"

breeder"

means:

1.Thepersonwhobred,ordiscoveredanddevelopedanewplantvariety;

or

2.Thepersonwhoistheemployeroftheaforementionedpersonorwhohascommissionedthework;

3）Thesuccessors-in-interestoftheforegoingpersonsasthecasemaybe;

or

4）TheholderoftheCertificateofPlantVarietyProtection.

d）"

CertificateofPlantVarietyProtection"

meansthedocumentissuedbytheBoardpursuanttothisActfortheprotectionofanewplantvariety.

e）"

Commission"

meanstoengagetheservicesofapersontodevelopnewplantvarietiesinexchangeformonetaryoranymaterialconsideration.

f）"

Harvestedmaterial"

meansanypartofaplantwithpotentialeconomicvalueoranyproductmadedirectlytherefrominpropercase.

g）"

Holder"

meansapersonwhohasbeengrantedaCertificateofPlantVarietyProtectionorhissuccessors-in-interest.

h）"

Persons"

includesnaturalpersonsandjuridicalpersons.

i）"

Plant"

includesterrestrialandaquaticflora.

j）"

PlantVarietyProtection（PVP）"

manstherightsofbreedersovertheirnewplantvarietyasdefinedinthisAct.

k）"

Propagatingmaterial"

meansanypartoftheplantthatcanbeusedtoreproducetheprotectedvariety.

l）"

Regulations"

meanstherulesandregulationspromulgatedbytheBoardforthepurposeofimplementingtheprovisionsofthisAct.

m）"

Variety"

meansaplantgroupingwithinasinglebotanicaltaxonofthelowestknownrank,thatwithoutregardtowhethertheconditionsforplantvarietyprotectionarefullymet,canbedefinedbytheexpressionofthecharacteristicsresultingfromagivengenotypeorcombinationofgenotypes,distinguishedfromanyotherplantgroupingsbytheexpressionofatleastone

（1）characteristics,andconsideredasaunitwithregardtothesuitabilityforbeingpropagatedunchanged.Avarietymayberepresentedbyseed,transplants,plants,tubers,tissuecultureplantlets,andotherforms.

TITLEIII

ConditionsfortheGrantofthePlantVarietyProtection

Sec.4.TheCertificateofPlantVarietyProtectionshallbegrantedforvarietiesthatare:

a）New;

b）Distinct;

c）Uniform;

and

d）Stable.

Sec.5.Newness.-Avarietyshallbedeemednewifthepropagatingorharvestedmaterialofthevarietyhasnotbeensold,offeredforsaleorotherwisedisposedoftoothers,byorwiththeconsentofthebreeder,forpurposesofexploitationofthevariety;

a）InthePhilippinesformorethanone

（1）yearbeforethedateoffilingofanapplicationforplantvarietyprotection;

b）Inothercountriesorterritoriesinwhichtheapplicationhasbeenfiled,formorethanfour（4）yearsor,inthecaseofvinesortress,morethansix（6）yearsbeforethedateoffilingofanapplicationforPlantVarietyProtection.

However,therequirementofnoveltyprovidedforinthisActshallnotapplytovarietiessold,offeredforsaleordisposedoftoothersforaperiodoffive（5）yearsbeforetheapprovalofthisAct.Provided,ThatapplicationforPVPshallbefiledwithinone

（1）yearfromtheapprovalofthisact.

Sec.6.Distinctness.-Avarietyshallbedeemeddistinctifitisclearlydistinguishablefromanycommonlyknownvariety.ThefilingofanapplicationforthegrantingofaplantvarietyprotectionorfortheenteringofanewvarietyinanofficialregisterofvarietyinthePhilippinesorinanycountry,shallrenderthesaidvarietyamatterofpublicknowledgefromthedateofthesaidapplication:

Provided,ThattheapplicationleadstothegrantingofaCertificateofPlantVarietyProtectionortheenteringofthesaidothervarietyintheofficialregisterofvarietyasthecasemaybe.

Sec.7.Uniformity.-Thevarietyshallbedeemeduniformif,subjecttothevariationthatmaybeexpectedfromtheparticularfeaturesofitspropagation,itissufficientlyuniforminitsrelevantcharacteristics.

Sec.8.Stability.-Thevarietyshallbedeemedstableifitsrelevantcharacteristicsremainunchangedafterrepeatedpropagationor,inthecaseofaparticularcycleofpropagation,attheendofeachsuchcycle.

TITLEIV

VarietyDenomination

Sec.9.VarietyDenomination.-Thevarietyshallbedesignatedbyadenominationwhichshallbeitsgenericdescription.Inparticular,itmustbedifferentfromanydenominationthatdesignatesanexistingvarietyofthesameplantspeciesorcloselyrelatedspecies.

Sec.10.RightofPriorityoverDenomination.-TheuseofadenominationshallnotbegrantedtoabreederifsuchdenominationhasalreadybeenregisteredtoanotherbreederorisbeingusedbyathirdpartyinrelationtothesaleorofferingforsaleofaparticularvarietypriortothefilingdateorprioritydateofanapplicationforaCertificateofPlantVarietyProtection.Incasetwo

（2）ormorebreeders/applicantsapplyfortheregistrationofthesamedenomination,thebreeder/applicantwhohastheearliestfilingdateorprioritydateshallhavetherighttoregisterthesametotheexclusionoftheotherapplicant/breeder（s）.

Sec.11.FiguresasDenomination.-Thedenominationmustenablethevarietytobeidentified.Itmaynotconsistsolelyoffiguresexceptwhenitisanestablishedpracticefordesignatingsuchavariety.

Sec.12.MisleadingDenomination.-Nodenominationshallbeacceptedifitisliabletomisleadortocauseconfusionconcerningthecharacteristicvalueoridentityofthevarietyoridentityofthebreeder.

Sec.13.RefusalofDenomination.-Ifthedenominationdoesnotsatisfytheserequirements,itsregistrationshallberefusedandthebreedershallberequiredtoproposeanotherdenominationwithinaprescribedperiod.Thedenominationshallberegisteredtogetherwiththegrantofthebreeder'

sright.

Sec.14.DenominationUsedinanApplicationPreviouslyFiledabroad.-Anapplicationfiledinthiscountry,thesubjectmatterofwhichisthesameasthatofanapplicationpreviouslyfiledabroad,shallusethesamedenominationasthelatter.However,ifsuchdenominationdoesnotconformtotheprovisionsofthisTitle,theapplicant/breedershallberequiredtosubmitanewdenomination.

Sec.15.ObligationtoUseDenomination.-Anyperson,whooffersforsaleormarketsinthePhilippines,propagatingmaterialofavarietyprotected,shallbeobligedtousethedenominationofthatvariety,evenaftertheexpirationofthebreeder'

srightthereforexceptwhentheruleofpriorrightsapply.

Sec.16.UseofMarks.-Whenaprotectedvarietyisofferedforsaleormarketed,itmaybeassociatedwithatrademark,tradenameorothersimilarindicationwitharegistereddenomination.Ifsuchanindicationissoassociated,thedenominationmustneverthelessbeeasilyrecognizable.

TITLEV

ApplicantstoaPlantVarietyProtection

Sec.17.Entitlement.-Anybreeder,withrespecttothevarietydeveloped,mayapplyforaplantvarietydeveloped,mayapplyforaplantvarietyprotectionandobtainaCertificateofPlantVarietyProtectionuponcompliancewiththerequirementsofthisAct.

Sec.18.Co-ownershipoftheRight.-Iftwo

（2）ormorepersonscontributetothedevelopmentofanewplantvariety,allofthemshallbenamedintheCertificateofPlantVarietyProtectionandshallbeentitledtosuchrightsasagreeduponinwritingorintheabsencethereof,therightsinproportiontotheircontributioninthedevelopmentofplantvariety.

Sec.19.Employee-Employerrelationship.-incaseanemployeedevelopsaplantvarietyinthecourseofhisemplo
