（一）翻译题

1.TheUCPprovidesnoguidancewherethewords“from”and“after”areusedtodeterminematuritydatesofdrafts. Referenceto“from”and“after”intheUCPreferssolelytodateterminologyforperiodsofshipment. Wheretheword“from”isusedtoestablishthematuritydate,internationalstandardbankingpracticewouldbeexcludethedatementioned,unlessthecreditspecificallyprovidesthat“from”isconsideredtoincludethedatementioned. Therefore,forthepurposeofdeterminingthematuritydateofatimedraft,thewords“from”and“after”havethesameeffect. Calculationofthematuritycommencesthedayfollowingthedateofthedocument,shipment,orotherevent,i.e.10daysafterorfromMarch1toMarch11.

2.Ifabillofexchangeshowingmorethanoneonboardnotationispresentedunderacreditwhichrequiresdraftstobedrawn,forexample,at60daysafterorfrombillofladingdate,andthegoodsaccordingtobothorallonboardnotationswereshippedfromportswithinapermittedgeographicalareaorregion,theearliestoftheseonboarddateswillbeusedforcalculationofthematuritydate. Example:

thecreditrequiresshipmentfromEuropeanportandthebillofladingevidencesonboardvessel“A”fromDublinAugust16,andonboardvessel“B”fromRotterdamAugust18. Thedraftshouldreflect60daysfromtheearliestonboarddateinEuropeanport,i.e.August16.
