sRepublicofChina,andamendedthesecondtimeonJanuary9,2010accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeople&

sRepublicofChina）

ChapterIGeneralProvisions

Rule1.TheseImplementingRegulationsareformulatedinaccordancewiththePatentLawofthePeople&

sRepublicofChina（hereinafterreferredtoasthePatentLaw）.

Rule2.AnyformalitiesprescribedbythePatentLawandtheseImplementingRegulationsshallbecompliedwithinawrittenformorinanyotherformprescribedbythepatentadministrationdepartmentundertheStateCouncil.

Rule3.AnydocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsshallbeinChinese;

thestandardscientificandtechnicaltermsshallbeusedifthereisaprescribedonesetforthbytheState;

wherenogenerallyacceptedtranslationinChinesecanbefoundforaforeignnameorscientificortechnicalterm,theoneintheoriginallanguageshallbealsoindicated.

WhereanycertificateorcertifyingdocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsisinaforeignlanguage,thepatentadministrationdepartmentundertheStateCouncilmay,whenitdeemsnecessary,requestaChinesetranslationofthecertificateorthecertifyingdocumentbesubmittedwithinaspecifiedtimelimit;

wherethetranslationisnotsubmittedwithinthespecifiedtimelimit,thecertificateorcertifyingdocumentshallbedeemednottohavebeensubmitted.

Rule4.WhereanydocumentissentbymailtothepatentadministrationdepartmentundertheStateCouncil,thedateofmailingindicatedbythepostmarkontheenvelopeshallbedeemedtobethedateoffiling;

wherethedateofmailingindicatedbythepostmarkontheenvelopeisillegible,thedateonwhichthepatentadministrationdepartmentundertheStateCouncilreceivesthedocumentshallbethedateoffiling,exceptwherethedateofmailingisprovedbythepartyconcerned.

AnydocumentofthepatentadministrationdepartmentundertheStateCouncilmaybeservedbymail,bypersonaldeliveryorbyotherforms.Whereanypartyconcernedappointsapatentagency,thedocumentshallbesenttothepatentagency;

wherenopatentagencyisappointed,thedocumentshallbesenttothecontactingpersonnamedintherequest.

WhereanydocumentissentbymailbythepatentadministrationdepartmentundertheStateCouncil,the16thdayfromthedateofmailingshallbepresumedtobethedateonwhichthepartyconcernedreceivesthedocument.

Whereanydocumentisdeliveredpersonallyinaccordancewiththeprovisionsofthepatentadministration

departmentundertheStateCouncil,thedateofdeliveryisthedateonwhichthepartyconcernedreceivesthedocument.

Wheretheaddressofanydocumentisnotclearanditcannotbesentbymail,thedocumentmaybeservedbymakinganannouncement.Attheexpirationofonemonthfromthedateoftheannouncement,thedocumentshallbedeemedtohavebeenserved.

Rule5.ThefirstdayofanytimelimitprescribedinthePatentLawandtheseImplementingRegulationsshallnotbecountedinthetimelimit.Wherethetimelimitiscountedbyyearorbymonth,itshallexpireonthecorrespondingdayofthelastmonth;

ifthereisnocorrespondingdayinthatmonth,thetimelimitshallexpireonthelastdayofthatmonth;

ifatimelimitexpiresonanofficialholiday,itshallexpireonthefirstworkingdayfollowingthatofficialholiday.

Rule6.WhereatimelimitprescribedinthePatentLawortheseImplementingRegulationsorspecifiedbythepatentadministrationdepartmentundertheStateCouncilisnotobservedbyapartyconcernedbecauseofforcemajeure,resultinginlossofhisoritsrights,heoritmay,withintwomonthsfromthedateonwhichtheimpedimentisremoved,atthelatestwithintwoyearsimmediatelyfollowingtheexpirationofthattimelimitrequestthepatentadministrationdepartmentundertheStateCounciltorestorehisoritsrights.

Exceptforcircumstancesprescribedinprecedingparagraph,whereatimelimitprescribedinthePatentLawortheseImplementingRegulationsorspecifiedbythepatentadministrationdepartmentundertheStateCouncilisnotobservedbyapartyconcernedbecauseofanyotherjustifiedreason,resultinginlossofhisoritsrights,heoritmay,withintwomonthsfromthedateofreceiptofanotificationfromthepatentadministrationdepartmentundertheStateCouncil,requestthepatentadministrationdepartmentundertheStateCounciltorestorehisoritsrights.

WhereanypartyconcernedrequeststorestorehisoritsrightaccordingtoparagraphoneorparagraphtwoofthisRule,heoritshallsubmitarequestforrestorationofhisoritsright,statingthereasons,attaching,ifnecessary,therelevantcertifyingdocuments,andgothroughtherelevantformalitieswhichshouldhavebeencompliedwithbeforethelossofhisoritsright.WherethepartyconcernedrequestsforrestorationofhisoritsrightaccordingtoparagraphtwoofthisRule,heoritshallpaythefeeforrequestforrestorationofright.

WherethepartyconcernedmakesarequestforanextensionofatimelimitspecifiedbythepatentadministrationdepartmentundertheStateCouncil,heoritshall,beforethetimelimitexpires,statethereasonstothepatentadministrationdepartmentundertheStateCouncilandgothroughtherelevantformalities.

TheprovisionsofparagraphsoneandtwoofthisRuleshallnotbeapplicabletothetimelimitreferredtoinArticles24,29,42and68ofthePatentLaw.

Rule7.Whereanapplicationforapatentrelatestotheinterestsofnationaldefenseandisrequiredtobekeptsecret,theapplicationforpatentshallbefiledwithandexaminedbythepatentdepartmentofnationaldefense.WhereanapplicationforpatentreceivedbythepatentadministrationdepartmentundertheStateCouncilrelatestotheinterestsofnationaldefenseandisrequiredtobekeptsecret,theapplicationshallbepromptlyforwardedtothepatentdepartmentofnationaldefencetocarryouttheexamination.Whereitisfoundafterexaminationbythepatentdepartmentofnationaldefencethereisnocauseforrejectionoftheapplication,thepatentadministrationdepartmentundertheStateCouncilshallmakeadecisiontograntthepatentrightconcerningnationaldefense.

WherethepatentadministrationdepartmentundertheStateCouncilfindsthatanapplicationforpatentforinventionorpatentforutilitymodelfiledwithitrelatestonationalsecurityorothervitalinterestsotherthaninterestsconcerningnationaldefenseandisrequiredtobekeptsecret,itshallpromptlymakeadecisiononhandlingitasanapplicationforsecretpatentandnotifytheapplicantaccordingly.ThespecialproceduresfortheexaminationandreexaminationofapplicationforsecretpatentaswellastheinvalidationofsecretpatentshallbeprovidedforbythepatentadministrationdepartmentundertheStateCouncil.

Rule8.TheinventionorutilitymodeldevelopedinChinaasmentionedinArticle20ofthePatentLawreferstoaninventionorutilitymodelofwhichthesubstantivecontentsofthetechnicalsolutionweremadewithintheterritoryofChina.

WhereanyentityorindividualintendstofileanapplicationforpatentabroadfortheinventionorutilitymodeldevelopedinChina,itorheshallrequest,byoneofthefollowingmanner,thepatentadministrationdepartmentundertheStateCounciltoconductconfidentialityexamination:

（1）whereanyentityorindividualintendstofileanapplicationforpatentdirectlyinaforeigncountryoraninternationalpatentapplicationwitharelevantforeignorganization,itorheshallfilearequestforconfidentialityexaminationinadvancewiththepatentadministrationdepartmentundertheStateCouncilanddescribetherelatedtechnicalsolutionindetail;

（2）whereafterhavingfiledanapplicationforpatentwiththepatentadministrationdepartmentundertheStateCouncil,theapplicantintendstofileanapplicationforpatentinaforeigncountryoraninternationalpatentapplicationwitharelevantforeignorganization,itorheshallfiletherequestforconfidentialityexaminationwiththepatentadministrationdepartmentundertheStateCouncilbeforefilingoftheapplicationforpatentinaforeigncountryortheinternationalpatentapplicationwiththerelevantforeignorganization.

WheretheapplicantfilesaninternationalpatentapplicationwiththepatentadministrationdepartmentundertheStateCouncil,itorheshallbedeemedtohavesimultaneouslyfiledtherequestforconfidentialityexamination.

Rule9.WherethepatentadministrationdepartmentundertheStateCouncilreceivesarequestfiledunderRule8oftheseImplementingRegulationsandfinds,uponexamination,thattheinventionorutilitymodelmayrelatetothesecurityorvitalinterestoftheStateandisrequiredtobekeptsecret,itshallpromptlyissueanotificationofconfidentialityexaminationtotheapplicant.Iftheapplicantfailstoreceivethenotificationofconfidentialit
