(1)Subsidyforconstructionofdrydock
TheGovernorinCouncilmay,asanaidtotheconstructionofanydrydock,authorizethepaymentoutofanyunappropriatedmoneyformingpartoftheConsolidatedRevenueFundofasubsidy,inaccordancewiththisAct,toanyincorporatedcompany,approvedbytheGovernorinCouncilashavingtheabilitytoperformthework,thatentersintoanagreementwithHerMajestytoconstructadrydockunderthisAct,withallnecessaryequipment,machineryandplant,forthereceptionandrepairingofvessels.

(2)Reportbeforegrantofsubsidy
NosuchaidshallbegrantedunlesstheGovernorinCouncilissatisfied,onareportoftheMinisterandsuchotherevidenceastheGovernorinCouncildeemsnecessary,thatthedrydockisneededinthepublicinterest,andis,asproposed,ofsufficientcapacitytomeetthepublicrequirementswherethedrydockistobelocated.

(1)Worksofexistingdrydockcompany
ForthepurposeofconstructingadrydockunderthisAct,thecompanyenteringintotheagreementcontemplatedbysection3mayutilize,oracquireforthepurposeofutilizing,theworksandpropertyofanyexistingdrydockcompanywhosedockhasbeenconstructedunderAnActtoencouragetheconstructionofDryDocksbygrantingassistanceoncertainconditionstocompaniesconstructingthem,chapter17oftheStatutesofCanada,1882,AnActtoencouragetheconstructionofDryDocks,chapter9oftheStatutesofCanada,1899,AnActtoencouragetheConstructionofDryDocks,chapter116oftheRevisedStatutesofCanada,1906,orAnActtoencouragetheConstructionofDryDocks,chapter24oftheStatutesofCanada,1908,andthevalueoftheworksandpropertyatthetimewhentheagreementisenteredinto,insofarastheworksandpropertymaybeusefulintheconstructionofadrydockofgreaterdimensionsorcapacityunderthisAct,shallbedeemedtobeforthepurposesofsubsidycalculationapartofthecostofthedrydockconstructedunderthisAct.

(2)Aggregatesubsidiesalreadypaid
TheaggregateamountofallsubsidiespaidbytheGovernorinCouncil,inrespectofthedocksoutilized,underanyoftheActsmentionedinsubsection
(1),beforetheagreementtoconstructunderthisActisenteredinto,shallbedeductedfromthesubsidypayableunderthisAct,andthedeductionshallbemadeinequalannualportionsduringtheperiodinrespectofwhichthesubsidyispayableunderthisAct,andtheremainingpayments,ifany,ofthesubsidycalledforbytheagreemententeredintounderanyoftheActsmentionedinsubsection
(1)shallnotbemade.
4(3)Valueofexistingworks
Forthepurposesofthissection,thevalueoftheworksandpropertyofanyexistingdrydockcompanyshallbeestimatedbytheMinister,andtheGovernorinCouncil,havingregardtotheestimate,shalldeterminethevalueoftheworksandproperty,andtheamountshallbesodeterminedbeforethesaidagreementisenteredinto.

s5.Plans,specificationsandestimates
AnycompanythatseekstoenterintoanagreementwithHerMajestytoconstructadrydockunderthisActshall,aspartofitsapplicationtherefor,presentdetailedworkingplansandspecificationsoftheproposedworks,accompaniedbyestimatesofthecostthereof,includingestimatesofthecostofallnecessaryequipment,machinery,plantandsite,ifthecompanyisobligedtopayforthesiteincashanddoesnotobtainorhasnotobtainedasitebywayofbonusorgift,andtheestimatesofcostshallbeinsuchdetailaswillenabletheMinistertoverifythemforthepurposesoftherecommendationmadebytheMinisterundersection8.

(1)Expropriationoflands
WhereacompanythathasenteredintoanagreementwithHerMajestytoconstructadrydockunderthisActisunabletoagreewiththeownerofanylandorotherrealpropertyorinterestthereinastothepurchase,acquisitionortransferoftheland,propertyorinterestorthepricetobepaidforit,andthecompanyconsidersthatitisnecessaryforasiteforthedrydock,thecompanymay,withtheapprovaloftheGovernorinCouncilandinaccordancewiththeExpropriationAct,expropriatetheland,propertyorinterest.

(2)Noticetoappropriateminister
WheretheGovernorinCouncilapprovesanexpropriationundersubsection
(1),thecompanyshallsoadvisetheappropriateministerinrelationtoPartIoftheExpropriationAct.
6(3)ExpropriationAct
ForthepurposesoftheExpropriationAct,landorrealpropertyoraninterestthereinthattheGovernorinCouncilhasapprovedtheexpropriationofundersubsection
(1)isdeemedtobeaninterestinlandthat,intheopinionoftheappropriateministerinrelationtoPartIoftheExpropriationAct,isrequiredforapublicworkorotherpublicpurpose,andareferencetotheCrowninthatActshallbeconstruedasareferencetothecompany.
6(4)Chargesforservices
TheappropriateministerinrelationtoPartIoftheExpropriationActmaymakeregulationsprescribingfeesorchargestobepaidbyacompanyinrespectofanexpropriationreferredtoinsubsection
(1),andratesofinterestpayableinrespectofthosefeesandcharges.
6(5)DebtduetoHerMajesty
ThefeesorchargesareadebtduetoHerMajestyinrightofCanadabythecompany,andshallbearinterestattheprescribedratefromthedatetheyarepayable.
6(6)Security
TheMinistermayrequirethecompanytoprovidesecurity,inanamountdeterminedbytheMinisterandsubjecttoanytermsandconditionsthattheMinistermayspecify,forthepaymentofanyfeesorchargesthatareormaybecomepayableunderthissection.

s7.Threeclassesofdrydocks
DrydocksconstructedunderthisActshall,forthepurposesofthisAct,bedividedintothreeclassesasfollows:
(a)drydocksofthefirstclassfornavalandgeneralpurposescosting,forthepurposesofthesubsidycalculation,notmorethanfivemillionfivehundredthousanddollarsinthecaseofdrydocksspecifiedinsubparagraph(i),andnotmorethanfourmilliondollarsinthecaseofdrydocksspecifiedinsubparagraph(ii),being
(i)drydocks,otherthanfloatingdrydocks,ofdimensionswhencompletedofnotlessthanthefollowingprincipaldimensions,thatistosay,clearlengthonbottomfromcaissongrooveorhollowquointohead,elevenhundredandfiftyfeet,clearwidthofentrance,onehundredandtwenty-fivefeet,depthofwateroversillathighwaterordinaryspringtides,thirty-eightfeet,and
(ii)floatingdrydocksofaliftingcapacityofatleasttwenty-fivethousandtonsinwhichvesselscanbereceivedandrepairedwitheaseandsafety,
butanysuchdrydockshallnotforthepurposesofthisActbedeemedtobeadrydockofthefirstclassunlesstherecanbereceivedandrepairedthereinwitheaseandsafetythelargestshipsorvesselsoftheBritishNavyexistingatthetimeatwhichthecontractisenteredinto;
(b)drydocksofthesecondclass,costingforthepurposesofsubsidycalculationnotmorethantwoandone-halfmilliondollars,being
(i)drydocks,otherthanfloatingdrydocks,ofdimensionswhencompletedofnotlessthanthefollowingprincipaldimensions,thatistosay,clearlengthonbottomfromcaissongrooveorhollowquointohead,sixhundredandfiftyfeet,clearwidthofentrance,eighty-fivefeet,depthofwateroverthesillathighwaterordinaryspringtides,thirtyfeetifconstructedontidalwatersandtwenty-fivefeetoverthesillatordinarylowwaterifconstructedonnon-tidalwaters,and
(ii)floatingdrydocksofaliftingcapacityofatleastfifteenthousandtonsinwhichvesselscanbereceivedandrepairedwitheaseandsafety;
and
(c)drydocksofthethirdclass,costingforthepurposesofsubsidycalculationnotmorethanoneandone-halfmilliondollars,being
(i)drydocks,otherthanfloatingdrydocks,ofdimensionswhencompletedofnotlessthanthefollowingprincipaldimensions,thatistosay,clearlengthonbottomfromcaissongrooveorhollowquointohead,fourhundredfeet,clearwidthofentrance,sixty-fivefeet,depthofwateroverthesillathighwaterordinaryspringtides,twenty-twofeetifconstructedontidalwatersandeighteenfeetoverthesillatordinarylowwaterifconstructedonnon-tidalwaters,and
(ii)floatingdrydocksofaliftingcapacityofatleastthreethousandfivehundredtonsinwhichvesselscanbereceivedandrepairedwitheaseandsafety.
s8.Basisofsubsidy
ThecostonwhichthesubsidyshallbecalculatedshallbefixedanddeterminedbytheGovernorinCouncil,ontherecommendationoftheMinister,andthecostshallincludethecostofallnecessaryequipment,machineryandplant,andanysumingoodfaithexpendedortobeexpendedbythecompanyinthepurchaseofasiteforthedrydock,butshallnotincludethevalueofanysitereceivedortobereceivedbythecompanybywayofbonusorgift,andtheamountofthesubsidyshallbesofixedanddeterminedbeforetheagreementforpaymentofthesubsidyisenteredinto.
