inaccordancewiththelabourlaw,theprovisionsonthelabouradministrationregulationsforforeigninvestmententerprisesandotherrelevantlawsandregulationsofthepeople?
srepublicofchina,thepartieshaveconcludedthefollowinglabourcontract（hereinafterreferredtoasthe“contract”）合同双方依照《中华人民共和国劳动法》、《外商投资企业劳动管理规定》以及中华人民共和国其它相关法律法规，共同约定以下劳动合同（以下简称“本合同”）。

若由于本公司管理编制的需要及/或由于该员工本人资格与能力的原因，本公司可在必要的情况下对该员工的职务和工作职责进行适当调整。
2.1thetrialperiodwillstartonthedateofsignatureofthiscontract.thedurationofthetrial
periodisthree（3）months.duringthetrialperiodtheemployeewillbeboundbyallarticlesofthiscontract.
试用期自本合同签署之日起开始，时间为三个月。
在试用期间，该员工受本合同全部条款所约束。
2.2afterthespecifiedtrialperiodandifnonoticeofterminationisgiventheemployee
automaticallybecomesemployedunderthetermsandconditionsofthiscontract.
在约定的试用期内，若该员工没有收到关于解除劳动关系的通知，在试用期满后，该员工自动转为本公司正式员工，执行本合同规定的条款。
3.1
3.2thedurationofthiscontractistwenty-sixth（26）months.本合同期限为26个月。

contractshallcomeintoforceonlyafterawrittenagreementhasbeensignedbybothparties.
本合同经合同双方同意后可以续签。
只有在合同双方签署书面协议后，续签的合同方能生效。
4.1thecompanyshalldefineitsownsalarypolicyinaccordancewithregulationsstipulatedbythestateandmunicipalgovernment.thecompanyshallensurethatthemonthlysalaryoftheemployeeisnotlessthantheminimumpaystandardsetbythelocalgovernment.
本公司将依照中华人民共和国和北京市有关政策法规制定本公司的员工工资标准。
本公司保证该员工的月工资将不低于当地政府规定的最低工资。
4.2theemployeewillreceiveagross口monthlyor口annualsalaryofxxxrenminbi（rmbxxx）andincreasethereafterthebasisofthestaffperformance,theeconomicdevelopmentofthecompany
andaccordingtothesalarypolicyofthecompanyapprovedbytheboardofdirectorsofthecompany,andetc.
该员工税前工资将为口每月或口每年xxx元人民币，今后将按照该员工的工作表现、本公司的经济效益以及由本公司制定并经董事会批准的工资标准每年递增。
4.3suchsalaryshallbetransferredtothebankaccountdesignatedbytheemployeebetweenthethirdandfifthdayofeachmonth.
上述工资将于每月3号至5号期间汇入该员工所指定的银行账户。
5.1atthefulldiscretionofthechiefexecutiveofficerandbaseduponhis/hergeneralattitudeand
theresultofhis/herworkandfulfilmentofhis/herobjectivesdetailedwithhis/hermanagerandatthebeginningofeachcalendaryeartheemployeewillbeentitledtoanannualbonusnotexceedingone
（1）monthofsalaryandshallbepaidtotheemployeeforeachfullcalendaryearwhichtheemployeeworksforthecompanyintwo
（2）instalmentsthefollowingyear.经本公司首席执行官同意，并且根据该员工的工作态度、工作成果及其上级主管规定之工作目标的完成状况，该员工将有权在每个公历年初享受年终奖金（奖金总额不超过该员工的月工资）。
员工为公司工作满一年时，
奖金将于次年分两次发放给个人。
6.1theemployeeshallpayindividualincometaxinaccordancewiththerelevantlawsand

该员工须按照中华人民共和国相关法律法规缴纳个人所得税。
本公司将为该员工代扣代徼个人所得税，并将应纳税款上交相应税务机关。

3.4乙方在合同期内享受中国法律规定的节日，公休假日。

四、雇佣合同的解除和终止
Ⅳcontractcancellationandtermination
4.1合同期满双方不再续签或者双方约定的合同终止条件出现时，雇佣合同即终止。

4.2经合同双方当事人协商一致，本合同可以解除。

4.3乙方因归国或其他私人原因未正常出勤且超过十天且未向甲方做出书面说明的，本合同自动终止。

五、其他事项

5.1其他未尽事宜，双方可参照甲方公司内部的相关规章制度执行。

5.2甲乙双方均应遵守本合同之约定，任何一方违约，非违约方均有权要求违约方承担相应的损失。

5.3甲乙双方在本合同的执行中如有争议，可协商解决。

5.4本合同分为中英两种文本，每种文本具有相同的法律效力；
如两种文本产生冲突，则中文文本为作准文本。

5.5本合同一式两份，甲、乙双方各执一份，每份具有同等法律效力。

或者其他任何主管认为乙方不能符合该职位的要求的；

（2）materiallybreachestheemployer’srulesandregulations;
（3）commitsseriousderelictionofdutyorpracticesgraft,causingsubstantialdamagetotheemployer;
（4）hasadditionallyestablishedanemploymentrelationshipwithanotheremployerwhichmateriallyaffectsthecompletionofhistaskswiththefirst-mentionedemployer,orherefusestorectifythematterafterthesameisbroughttohisattentionbytheemployer;
（5）causestheemploymentcontracttobeinvalidduetothecircumstancespecifiedinitem
