TheprovisionsofthisAgreementshallapplytotheinternationalcarriageofpassengersandgoodsbyroad,fromortotheterritoryofoneContractingParty,andintransitthroughtheterritoryoftheotherContractingPartybyusingvehiclesregisteredintheterritoryoftheformerContractingParty.

Article2

Definitions

ForthepurposeofthisAgreement:

Theterm“carrier”meansanyphysicalorjuridicalpersonauthorizedtocarrypassengersandgoodsinconformitywiththelaws,regulationsandrulesoftheContractingParties.

Theterm“vehicle”means

i）anypowerdrivenroadvehiclebuilteitherforcarriageof

passengers（moretheneightseatsexcludingthedriver’sseat）orfoodsordrawingsuchvehicles,or

ii）acombinationcomprisingavehicleasdefinedinparagraph（i）aboveandatrailerorasemi-trailerconnectedtoit,builtforthecarriageofpassengersorgoods.

Theterm“permit”meansallkindsofpermitstobeissuedbythecompetentauthoritiesoftheContractingParties.

Theterm“quotes”meansthenumberofpermitsissuedannuallyfortransitpurposes.

Theterm“regularbusservice”meansthecarriageofpassengersbetweentheterritoryofthetwoContractingPartiesonaprescribedroadinaccordancewithnationalschedulesandtariffs.

Theterm“regulartransitbusservice”meansaregularbusservicebeginningintheterritoryofoneContractingParty,crossingtheterritoryoftheotherContractingPartywithoutleavingortakingpassengersandterminatingintheterritoryofathirdState.

Theterm“shuttleservice”meansanorganizedinternationalserviceforthecarriagefromoneandthesamepointofdeparturetoafixedpointofdestinationofagroupofpassengersandtheirreturntothepointofdepartureattheendofapre-scheduledperiod;

（Passengerstravelingingroup,areallrequiredtoreturninthesamegroup.Thefirstreturnjourneyfromandthelastjourneytothepointofdestinationwillbewithoutpassengers.）

Theterm“closed-doorservice（touristtransport）”meansinternationalcarriageofoneandthesamegroupofpassengersinoneandthesamevehicleinatour,startingfromapointintheterritoryofoneoftheContractingPartiesandterminatinginthesameContractingPartywithouttakingorleavingpassengers.

Theterm“transittransport”meanscarriageofpassengersandgoodsthroughtheterritoryofoneContractingParty,betweenpointsofdepartureanddestinationlocatedoutsidetheterritoryofthatContractingParty.

Article3

EachContractingParty,inconformitywiththeprovisionsofthisAgreement,shallrecognizetherightoftransitinrespectofpassengers,theirpersonaleffects,commercialgoodsandvehiclesoftheotherContractingPartyovertheroutestobedeterminedbythecompetentauthoritiesofeachContractingParty.

Article4

Subjecttoitsnationallegislation,eachContractingPartyshallgrantauthorizationtothecarriersoftheotherContractingPartytoestablishofficesandortoappointrepresentativesandoragenciesinitsownterritoryatplacestobemutuallyagreeduponbythecontractingParties.

AcarriershallnotactasatravelagencyintheterritoryoftheotherContractingParty.

Article5

EitherContractingPartyshallnotlevyanyimportorexporttaxorcharge（includingcustomstax）onvehiclesoftheotherContractingParty,whichareintransitinitsterritoryotherthan:

a）thechargesforusingroadnetworkinfrastructure（roadandbridgetools）

b）thechargestomeettheexpensesrelatingtothemaintenance,

protectionandadministrationofroadandtransport.

c）fees,onanon-discriminatorbasis,tocoverthedifference

betweenthenationalandtheinternationalpriceoffuel,

d）charges,ifweight,dimensionsorloadofthevehicleexceedthe

prescribedlimitsinthenationallegislationoftheContractingParties.

TheauthorizedcarriageintransitthroughtheterritoriesoftheContractingPartiesmaybeexemptedonreciprocalbasisfromthechargesstipulatedinparagraph（b）above.

Article6

IncasecarriersanddriversofoneContractingPartyoffendtheregulationsoftrafficandtransportationwhileontheterritoryoftheotherContractingParty,thecompetentauthoritiesofthelattershalleitherwarnthecarrierorthedriverorshallsuspendthepermittemporarily,provisionallyorpermanently.

ThecompetentauthoritiesofthelatterContractingPartyshallnotifythecompetentauthoritiesoftheformerContractingPartyofthemeasurestakenregardingtheoffencesindicatedinthefirstparagraphofthisArticle.

Article7

AMixedCommissionconsistingofrepresentativesofthetwoContractingPartiesshallbeformed:

ThetermsofreferenceoftheMixedCommissionare:

a）tosupervisetheproperimplementationofthisAgreement.

b）todeterminetheform,thetimeandthewaysofexchangeofpermits,

c）tostudyandmakeproposalsforthesolutionofpossibleproblemsnotsettleddirectlybetweenthecompetentauthoritiesreferredtoinArticle24ofthisAgreement,

d）toreviewallotherrelevantissuesthatfallwithinthescopeofthisAgreementandmakerecommendationsthereofforsettlement,

e）toconsideranyothermatterstobemutuallyagreeduponrelatingtotransportation.

TheMixedCommissionshallmeetwhenrequiredattherequestofoneoftheContractingPartiesalternatelyinTurkeyandIran.

TheagendatobediscussedattheMixedCommissionmeetingshallbepreparedinadvanceinthelightofthetermsofreferencementionedabove,bytheContractingPartiesthroughdiplomaticchannels:

TherecommendationsmadeordecisionsreachedbytheMixedCommissionshallbefullyimplemented.However,iftheMixedCommissiondecidestoamendanyArticleofthisAgreement,suchamendmentshallbesubmittedtothecompetentauthoritiesforapproval.

Article8

ThevehiclesregisteredintheterritoryoftheContractingPartyshallnotcarrypassengersandgoodsbetweenanytwopointswithintheterritoryoftheotherContractingParty.

UnlessaspecialpermitfromthecompetentauthorityoftheotherContractingPartyisobtained,acarrierfromoneContractingPartyshallnotcarrypassengersandgoodsfromtheterritoryoftheotherContractingPartytothirdcountries.

Article9

AnunloadedvehicleregisteredinoneContractingPartyshallnotentertheterritoryoftheotherContractingPartytocollectpassengersandgoodsunlesspermitisissuedforthispurpose.

ThecarriersofthetwoContractingPartiesshallcooperatecloselytoensurethetimelycarriageofpassengersandgoodsdestinedtotheotherContractingParty.RequeststobemadeinthisdirectionbyeitherContractingPartyshallbeconsideredwithmutualgood-willandunderstanding.

CARRIAGEOFPASSENGERS

Article10

AcarrierofoneContractingPartyshalloperatearegularservicetooraregulartransitservicethroughtheterritoryoftheotherContractingPartybyobtainingayearlypermitinadvancefromthecompetentauthorityoftheotherContractingParty.

Article11

ThetransittouristcarriageandshuttleservicetobeperformedbyavehicleregisteredintheterritoryofoneContractingPartytoorfromtheterritoryoftheotherContractingPartyshallnotbesubjecttoobtainingpermit.

CARRIAGEOFGOODS

Article12

ThecarriageofgoodsintransitthroughtheterritoriesoftheContractingPartiesshallbesubjecttopriorpermitbasedonquota,exceptthecasesdefinedbelow:

a.carriageofdeceasedwithvehiclesdesignedforthispurpose,

b.carriageofdecorativearticlesfortheatricalperformances,

c.carriageofgoods,equipmentsandcircusanimalsneededformusicalperformancesandcinemashows,sportsactivitiesandrecordingTVandradioprograms,

d.carriageofworksofart,

e.carriageofanimalsotherthanthoseforslaughtering,

f.carriageofdamagedvehiclesorvehiclesoutofoperation.

g.postalcarriage,

h.occasionalcarriageofgoodstoorfromairportsasaresultofchangeinflightitineraries,

i.carriageofaidmaterialincaseofnaturaldisasters,

j.carriageofmaterialforfairsandexhibitions,

k.othercasestobemutuallyagreeduponbytheMixedCommission.

PermitsshallbeexchangedannuallyandwheneverneededonthebasisofmutualagreementwithaviewtomeetingtherequirementsoftheContractingParties.

Article13

AtransitpermitshallbevalidforoneroundtriptransitjourneythroughtheterritoryoftheContractingParties.

Itshallalsobevalidforonevehicleandonlyforthecarriertowhomitisissuedandshallnotbetransferable.

Permitsshallbedeliveredfreeofcharge.

Article14

AvehicleregisteredintheterritoryofoneContractingPartycannotcollectreturnloadtoitsterritoryortothirdcountriesafterdeliveryofgoodstotheotherContractingParty,unlessapermitisissuedforthispurpose.

Article15

Arms,ammunitionsandmilitaryequipmentandexplosivesareexcludedfromtherightoftransitunlessapermitisobtainedfromtheContractingParties.

Thepassageofgoodsprohibitedfromtheentryforhuman,animalandplanthygienicpurposesshallalsobeexcludedfromtherightoftransit.

MISCELLANEOUSPROVISIONS

Article16

TheContractingPartiesshalltakeallthemeasureswhichtheydeemnecessaryinordertofacilitate,s
