Principles
AnantidumpingmeasureshallbeappliedonlyunderthecircumstancesprovidedforinArticle
VIofGATT
1994
andpursuanttoinvestigationsinitiatedandconductedinaccordancewiththeprovisionsofthisAgreement.ThefollowingprovisionsgoverntheapplicationofArticle
1994insofarasactionistakenunderantidumpinglegislationorregulations.

DeterminationofDumping
2.1ForthepurposeofthisAgreement,aproductistobeconsideredasbeingdumped,i.e.introducedintothecommerceofanothercountryatlessthanitsnormalvalue,iftheexportpriceoftheproductexportedfromonecountrytoanotherislessthanthecomparableprice,intheordinarycourseoftrade,forthelikeproductwhendestinedforconsumptionintheexportingcountry.
2.2Whentherearenosalesofthelikeproductintheordinarycourseoftradeinthedomesticmarketoftheexportingcountryorwhen,becauseoftheparticularmarketsituationorthelowvolumeofthesalesinthedomesticmarketoftheexportingcountry,suchsalesdonotpermitapropercomparison,themarginofdumpingshallbedeterminedbycomparisonwithacomparablepriceofthelikeproductwhenexportedtoanappropriatethirdcountry,providedthatthispriceisrepresentative,orwiththecostofproductioninthecountryoforiginplusareasonableamountforadministrative,sellingandgeneralcostsandforprofits.
2.2.1Salesofthelikeproductinthedomesticmarketoftheexportingcountryorsalestoathirdcountryatpricesbelowperunit(fixedandvariable)costsofproductionplusadministrative,sellingandgeneralcostsmaybetreatedasnotbeingintheordinarycourseoftradebyreasonofpriceandmaybedisregardedindeterminingnormalvalueonlyiftheauthoritiesdeterminethatsuchsalesaremadewithinanextendedperiodoftimeinsubstantialquantitiesandareatpriceswhichdonotprovidefortherecoveryofallcostswithinareasonableperiodoftime.Ifpriceswhicharebelowperunitcostsatthetimeofsaleareaboveweightedaverageperunitcostsfortheperiodofinvestigation,suchpricesshallbeconsideredtoprovideforrecoveryofcostswithinareasonableperiodoftime.
2.2.1.1Forthepurposeofparagraph
2,costsshallnormallybecalculatedonthebasisofrecordskeptbytheexporterorproducerunderinvestigation,providedthatsuchrecordsareinaccordancewiththegenerallyacceptedaccountingprinciplesoftheexportingcountryandreasonablyreflectthecostsassociatedwiththeproductionandsaleoftheproductunderconsideration.Authoritiesshallconsiderallavailableevidenceontheproperallocationofcosts,includingthatwhichismadeavailablebytheexporterorproducerinthecourseoftheinvestigationprovidedthatsuchallocationshavebeenhistoricallyutilizedbytheexporterorproducer,inparticularinrelationtoestablishingappropriateamortizationanddepreciationperiodsandallowancesforcapitalexpendituresandotherdevelopmentcosts.Unlessalreadyreflectedinthecostallocationsunderthissubparagraph,costsshallbeadjustedappropriatelyforthosenonrecurringitemsofcostwhichbenefitfutureand/orcurrentproduction,orforcircumstancesinwhichcostsduringtheperiodofinvestigationareaffectedbystartupoperations.
2.2.2Forthepurposeofparagraph2,theamountsforadministrative,sellingandgeneralcostsandforprofitsshallbebasedonactualdatapertainingtoproductionandsalesintheordinarycourseoftradeofthelikeproductbytheexporterorproducerunderinvestigation.Whensuchamountscannotbedeterminedonthisbasis,theamountsmaybedeterminedonthebasisof:
(i)theactualamountsincurredandrealizedbytheexporterorproducerinquestioninrespectofproductionandsalesinthedomesticmarketofthecountryoforiginofthesamegeneralcategoryofproducts;
(ii)theweightedaverageoftheactualamountsincurredandrealizedbyotherexportersorproducerssubjecttoinvestigationinrespectofproductionandsalesofthelikeproductinthedomesticmarketofthecountryoforigin;
(iii)anyotherreasonablemethod,providedthattheamountforprofitsoestablishedshallnotexceedtheprofitnormallyrealizedbyotherexportersorproducersonsalesofproductsofthesamegeneralcategoryinthedomesticmarketofthecountryoforigin.
2.3Incaseswherethereisnoexportpriceorwhereitappearstotheauthoritiesconcernedthattheexportpriceisunreliablebecauseofassociationoracompensatoryarrangementbetweentheexporterandtheimporterorathirdparty,theexportpricemaybeconstructedonthebasisofthepriceatwhichtheimportedproductsarefirstresoldtoanindependentbuyer,oriftheproductsarenotresoldtoanindependentbuyer,ornotresoldintheconditionasimported,onsuchreasonablebasisastheauthoritiesmaydetermine.
2.4Afaircomparisonshallbemadebetweentheexportpriceandthenormalvalue.Thiscomparisonshallbemadeatthesameleveloftrade,normallyattheexfactorylevel,andinrespectofsalesmadeatasnearlyaspossiblethesametime.Dueallowanceshallbemadeineachcase,onitsmerits,fordifferenceswhichaffectpricecomparability,includingdifferencesinconditionsandtermsofsale,taxation,levelsoftrade,quantities,physicalcharacteristics,andanyotherdifferenceswhicharealsodemonstratedtoaffectpricecomparability.Inthecasesreferredtoinparagraph
3,allowancesforcosts,includingdutiesandtaxes,incurredbetweenimportationandresale,andforprofitsaccruing,shouldalsobemade.Ifinthesecasespricecomparabilityhasbeenaffected,theauthoritiesshallestablishthenormalvalueataleveloftradeequivalenttotheleveloftradeoftheconstructedexportprice,orshallmakedueallowanceaswarrantedunderthisparagraph.Theauthoritiesshallindicatetothepartiesinquestionwhatinformationisnecessarytoensureafaircomparisonandshallnotimposeanunreasonableburdenofproofonthoseparties.
2.4.1Whenthecomparisonunderparagraph4requiresaconversionofcurrencies,suchconversionshouldbemadeusingtherateofexchangeonthedateofsale,providedthatwhenasaleofforeigncurrencyonforwardmarketsisdirectlylinkedtotheexportsaleinvolved,therateofexchangeintheforwardsaleshallbeused.Fluctuationsinexchangeratesshallbeignoredandinaninvestigationtheauthoritiesshallallowexportersatleast60
daystohaveadjustedtheirexportpricestoreflectsustainedmovementsinexchangeratesduringtheperiodofinvestigation.
2.4.2Subjecttotheprovisionsgoverningfaircomparisoninparagraph
4,theexistenceofmarginsofdumpingduringtheinvestigationphaseshallnormallybeestablishedonthebasisofacomparisonofaweightedaveragenormalvaluewithaweightedaverageofpricesofallcomparableexporttransactionsorbyacomparisonofnormalvalueandexportpricesonatransactiontotransactionbasis.Anormalvalueestablishedonaweightedaveragebasismaybecomparedtopricesofindividualexporttransactionsiftheauthoritiesfindapatternofexportpriceswhichdiffersignificantlyamongdifferentpurchasers,regionsortimeperiods,andifanexplanationisprovidedastowhysuchdifferencescannotbetakenintoaccountappropriatelybytheuseofaweightedaveragetoweightedaverageortransactiontotransactioncomparison.
2.5InthecasewhereproductsarenotimporteddirectlyfromthecountryoforiginbutareexportedtotheimportingMemberfromanintermediatecountry,thepriceatwhichtheproductsaresoldfromthecountryofexporttotheimportingMembershallnormallybecomparedwiththecomparablepriceinthecountryofexport.However,comparisonmaybemadewiththepriceinthecountryoforigin,if,forexample,theproductsaremerelytransshippedthroughthecountryofexport,orsuchproductsarenotproducedinthecountryofexport,orthereisnocomparablepricefortheminthecountryofexport.
2.6ThroughoutthisAgreementtheterm"
likeproduct"
("
produitsimilaire"
)shallbeinterpretedtomeanaproductwhichisidentical,i.e.alikeinallrespectstotheproductunderconsideration,orintheabsenceofsuchaproduct,anotherproductwhich,althoughnotalikeinallrespects,hascharacteristicscloselyresemblingthoseoftheproductunderconsideration.
2.7ThisArticleiswithoutprejudicetothesecondSupplementaryProvisiontoparagraph
1ofArticle
VIinAnnex
ItoGATT

DeterminationofInjury
3.1AdeterminationofinjuryforpurposesofArticle
1994shallbebasedonpositiveevidenceandinvolveanobjectiveexaminationofboth(a)
thevolumeofthedumpedimportsandtheeffectofthedumpedimportsonpricesinthedomesticmarketforlikeproducts,and(b)
theconsequentimpactoftheseimportsondomesticproducersofsuchproducts.
3.2Withregardtothevolumeofthedumpedimports,theinvestigatingauthoritiesshallconsiderwhethertherehasbeenasignificantincreaseindumpedimports,eitherinabsolutetermsorrelativetoproductionorconsumptionintheimportingMember.Withregardtotheeffectofthedumpedimportsonprices,theinvestigatingauthoritiesshallconsiderwhethertherehasbeenasignificantpriceundercuttingbythedumpedimportsascomparedwiththepriceofalikeproductoftheimportingMember,orwhethertheeffectofsuchimportsisotherwisetodepresspricestoasignificantdegreeorpreventpriceincreases,whichotherwisewouldhaveoccurred,toasignif
