Thishealthandsafetymanualmustbereadinconjunctionwiththecompany’s(insertyourcompany’snamehere)healthandsafetypolicystatement.Thiscanbefound(indicateherewherethesafetypolicystatementcanbefound).
Employer’sResponsibilitiesUnderHealth&SafetyLaw
OurPolicyistoprovideandmaintainsafeandhealthyworkingconditions,equipmentandsystemsofworkforallouremployees,andtoprovidesuchinformation,trainingandsupervisionastheyneedforthispurpose.Wealsoacceptourresponsibilityforthehealthandsafetyofotherpeoplewhomaybeaffectedbyouractivitiesincludingvisitors,contractorsandmembersofthepublic.
Employees’ResponsibilitiesUnderHealthandSafetyLaw
AllemployeeshaveadutyundertheHealthandSafetyatWorketc.Act1974(the“Act”)andotherrelevanthealthandsafetylegislation,totakereasonablecarefortheirownhealthandsafetyandthatofotherswhomaybeaffectedbytheiractsoromissionswhilsttheyareatwork.Theymustalsoco-operatewiththeiremployerstoenablethemtocomplywiththeirdutiesunderrelevanthealthandsafetylaw.
Itisanoffenceforanyemployeetorecklesslyinterferewithormisuseanythingprovidedintheinterestsoftheirhealth,safetyandwelfare.
Inordertoworksafely,employeesmustcarryouttheirdutiesinlinewiththeinformation,instruction,trainingandsupervisionthattheyhavebeengiven.
ManagementmustbeinformedimmediatelyofanydangeroussituationsorshortcomingsintheCompany’shealthandsafetyarrangementsandsystems.
Implementation
Theallocationofdutiesforsafetymattersandtheparticulararrangements,which,wewillmaketoimplementthepolicy,aresetoutbelow.
Thepolicyandit’sassociatedmanual,willbekeptuptodate,particularlyasthebusinesschangesinnatureandsize.Toensurethis,thepolicyanditsmanualwillbereviewedeveryyearsoastoensurethattheyfitthecompany’sneedsandobligations.
AllocationofDutiesforSafetyMatters
UltimateResponsibility
UltimateresponsibilityforhealthandsafetyatthecompanylieswiththeBoardofDirectors.Thecompanyisliableforprosecutionorcivilclaimsarisingfromtheactsoromissionsofanyemployeecarriedoutinthecourseofcompanybusiness.Prosecutionofthecompany,itsCEOorDirectorswillnotpreventanysubsequentprosecutionofindividualemployeesresponsibleforanyincidentoraccidentwhichresultedintheinitialprosecutionorcompensationclaimagainstthecompany.
TheCompanyOfficerinChargeofhealthandSafety
Thecompanyhasappointed(nameandtitleofperson)toberesponsibleforhealthandsafetyissues.Thisincludestheoverseeingof,andarrangementsrequiredfor,relevantriskassessmentsandliaisonwiththeHealthandSafetyExecutive(HSE)andotherrelevantauthorities.
He/shewillensurethatDirectorsaremadeawareofanyrelevantlegislationetc.,sothatthecompanycomplieswithhealthandsafetylawatalltimes.
TheCompany’sAppointedSafetyConsultants(ifappointed)
Thecompany’sappointedsafetyconsultantshaveaduty:
-
∙Toprovideadviceto(personinchargeofsafety’snamehere)onhealthandsafetyissuesandrelevantlegislation.
∙Toassisthim/herinimplementingthecompany’shealthandsafetypolicyandrelatedsystems.
∙Tocarryoutrelevantinvestigations,riskassessmentsandaudits.
CompanyHealthandSafetyGroup(formthisfromstaffatyoursite)
Thisgroupwillmeet(setaperiod,atleastquarterly)andconsistsof:

TheGroupisresponsiblefor:

∙Formulation,communicationandmonitoringofthecompany’shealthandsafetypolicystatementandmanual.
∙MonitoringoftheCompany’shealthandsafetymanagementsystem.
∙Discussinganyotherhealthandsafety-relatedissuesarisingwithinthecompany.
ManagersandSupervisors
Managersandsupervisorshaveadutytoensurethat:

∙Eachpersonforwhomtheyareresponsibleisawareofthecontentsofthecompany’sHealthandsafetypolicyStatementandManual.
∙AnyhealthandsafetyrelatedissuesreportedtothembytheirstaffareimmediatelyreportedtotheCompany’sappointedsafetyconsultants.
∙Theysetapersonalexampletoemployeessoastoensurethatemployeesareencouragedtoobservehealthandsafetyproceduresatalltimes.
IndividualEmployees
Employeesare:
∙Toco-operatewithmanagersandsupervisorstoachieveasafeandhealthyworkplace
∙Totakereasonablecareforthesafetyofthemselvesandothers
∙Toco-operateintheimplementationofthecompany’sHealthandSafetysystems
∙Tousecorrectlyallworkequipmentinaccordancewithinstructionsandtrainingreceivedandnottointerferewithormisusesuchequipment
∙Nottointentionallyinterferewithorrecklesslymisuseanythingprovided
