Article1ThisLawisenactedpursuanttotheConstitutionforthepurposeofpreventingandcorrectinganyillegalorimproperspecificadministrativeacts,protectingthelawfulrightsandinterestsofcitizens,legalpersonsandotherorganizations,safeguardingandsupervisingtheexerciseoffunctionsandpowersbyadministrativeorgansinaccordancewithlaw.

Article2ThisLawisapplicabletoacitizen,legalpersonoranyotherorganizationwhoconsidersthathisoritslawfulrightsandinterestshavebeeninfringeduponbyaspecificadministrativeact,andappliesforadministrativereconsiderationtoanadministrativeorganwhichacceptstheapplicationforadministrativereconsideration,andmakesadecisionofadministrativereconsideration.

Article3AdministrativeorgansperformingtheirdutiesofadministrativereconsiderationinaccordancewiththisLawareadministrativereconsiderationorgans.Theofficesresponsibleforlegalaffairswithinadministrativereconsiderationorgansshallhandleconcretemattersrelatedtoadministrativereconsiderationandperformthefollowingduties:

（1）acceptingapplicationsforadministrativereconsideration;

（2）takingofevidencefromorganizationsandpersonsconcerned,andconsultingfilesandmaterials;

（3）reviewingthelegalityandappropriatenessofanyspecificadministrativeactsbeingappliedforadministrativereconsideration,anddrawingupdecisionsofadministrativereconsideration;

（4）handlingorforwardingapplicationsforreviewingitemslistedinArticle7ofthisLaw;

（5）puttingforwardproposals,inaccordancewithstatutoryauthoritiesandprocedures,ondisposingactsviolatingtheprovisionsofthisLawcommittedbyadministrativeorgans;

（6）handlingaffairsrespondingtoaction,ifdecidingtobringasuitincircumstancesofrefusingtoacceptthereconsiderationdecision;

（7）otherdutiesprescribedbylawsandregulations.

Article4Administrativereconsiderationorgansshall,whenperformingdutiesofadministrativereconsideration,followtheprinciplesofbeinglawful,fairness,openness,timely,andconvenienttopeoples,insistoncorrectingeverywrong,andensuringtoimplementlawsandregulationscorrectly.

Article5Ifanycitizen,legalpersonoranyotherorganizationrefusestoacceptanadministrativereconsiderationdecision,heoritmay,inaccordancewiththeprovisionsofAdministrativeProcedureLawofthePeople’sRepublicofChina,bringanadministrativelawsuitbeforeapeople’scourt,exceptthattheadministrativedecisionis,asprovidedforbylaw,afinaldecision.

Article6Acitizen,legalperson,oranyotherorganizationmay,inaccordancewiththisLaw,fileanapplicationforadministrativereconsiderationunderanyoneofthefollowingcircumstances:

（1）anadministrativesanction,suchaswarning,fine,confiscationofillegalgainsorproperty,ordertosuspendproductionorbusiness,suspensionorrescissionoflicenseorpermit,administrativeattachment,whichonerefusestoaccept;

（2）acompulsoryadministrativemeasure,suchasrestrictionofpersonalfreedomorthesealingup,seizingorfreezingofproperty,whichonerefusestoaccept;

（3）anadministrativedecisionofaltering,suspendingordischargingcertificates,suchasalicense,permit,creditcertificate,credential,whichonerefusestoaccept;

（4）anadministrativedecisionofconfirmingownershiporrighttouseofnaturalresources,suchasland,mineralresources,rivers,forests,mountains,grasslands,unreclaimedland,beaches,maritimewaters,whichonerefusestoaccept;

（5）infringementuponone’smanagerialdecision-makingpower,which,oneholds,hasbeenperpetratedbyanadministrativeorgan;

（6）caseswhereanadministrativeorgan,whichhasalteredandnullifiedone’sagriculturalcontract,isconsideredtohaveinfringeduponone’srightsandinterests;

（7）caseswhereanadministrativeorganisconsideredtohaveillegallyraisedfunds,leviedproperty,apportionedcharge,ordemandedtheperformanceofduties;

（8）caseswhereanadministrativeorganisconsideredtohaveillegallyhandledissuingacertificate,suchasapermit,license,creditcertificate,orcredential,orexaminingandapprovingorregisteringrelativeitems,whichoneconsidersoneselflegallyqualifiedtoapplyfor;

（9）caseswhereanadministrativeorganisconsideredtohavefailedtoperformitsstatutoryduty,accordingtolaw,ofprotectingone’srightsofthepersonandofproperty,andone’srightstoreceiveeducation,asonehasappliedfor;

（10）caseswhereanadministrativeorganisconsideredtohavefailedtoissueapension,socialinsurancemoneyorminimummaintenancefeeforlivingaccordingtolaw;

and

（11）casesinwhichotherspecificadministrativeactsofanadministrativeorganareconsideredtohaveinfringeduponotherlawfulrightsandinterests.

Article7Ifacitizen,legalpersonoranyotherorganizationconsidersanyofthefollowingprovisions,whichisthebasisofaspecificadministrativeactofanadministrativeorgan,tobeillegal,heoritmay,whenfilinganapplicationforadministrativereconsiderationonaspecificadministrativeact,fileanapplicationtotheadministrativereconsiderationorganforreviewingthesaidprovisions:

（1）provisionsofdepartmentsundertheStateCouncil;

（2）provisionsoflocalpeople’sgovernmentsatorabovethecountylevelandtheirdepartments;

（3）provisionsofpeople’sgovernmentsoftownsortownships.

TheprovisionssetforthintheprecedingparagraphdonotincluderulesofdepartmentsandcommissionsundertheStateCouncil,andlocalpeople’sgovernments.Reviewonrulesshallbehandledaccordingtorelevantlawsandadministrativeregulations.

Article8Ifanadministrativesanctionoranyotherpersonneldispositionbyanadministrativeorganisrefusedtoaccept,appealmaybemadeaccordingtotherelevantprovisionsoflawsandadministrativeregulations.

Ifmediationoranyotherdispositiononacivildisputeundertakenbyanadministrativeorganisrefusedtoaccept,anapplicationforarbitrationmaybemadeoralawsuitmaybebroughtbeforeapeople’scourt.

Article9Anycitizen,legalpersonoranyotherorganization,whoconsidersthataspecificadministrativeacthasinfringeduponhisoritslawfulrightsandinterests,mayfileanapplicationforadministrativereconsiderationwithin60daysfromthedaywhenheoritknowsthespecificadministrativeact,exceptthatthetimelimitprescribedinlawsexceeds60days.

Ifthetimelimitprescribedbylawisdelayedduetoforcemajeureorotherspecialreasons,thetimelimitshallbeaccountedcontinuouslyfromthedaywhentheobstacleisremoved.

Article10Anycitizen,legalpersonoranyotherorganizationthatfilesanapplicationforadministrativereconsiderationinaccordancewiththisLawisanapplicant.

Ifacitizenwhohastherighttoapplyforadministrativereconsiderationisdeceased,hisnearrelativesmayapplyforadministrativereconsideration.Ifacitizenwhohastherighttoapplyforadministrativereconsiderationisincompetentorwithlimitedcapacityforcivilconduct,hisstatutoryagentmayapplyforadministrativereconsiderationonbehalfhim.Iflegalperson,oranyotherorganization,thathastherighttoapplyforadministrativereconsiderationterminates,thelegalpersonoranyotherorganizationthatsucceedstoitsrightsmayapplyforadministrativereconsideration.

Anyothercitizen,legalpersonoranyotherorganizationthathasaninterestinaspecificadministrativeact,fortheadministrativereconsiderationofwhichanapplicationhasalreadybeenfiledmay,filearequestforparticipationintheadministrativereconsiderationasathirdparty.

Ifacitizen,legalpersonoranyotherorganizationrefusestoacceptaspecificadministrativeactundertakenbyanadministrativeorganandappliesforadministrativereconsideration,thesaidadministrativeorganthatundertookthespecificadministrativeactistherespondentoftheapplication.

Theapplicantandthethirdpartymaydelegateagent（s）toparticipateintheadministrativereconsideration.

Article11Anapplicantmayapplyforadministrativereconsiderationinwrittenorinoral.Ifanapplicantapplyforadministrativereconsiderationinoral,theadministrativereconsiderationorganshalltranscribefundamentalfactsoftheapplicant,claimsoftheadministrativereconsideration,andmainfacts,groundsandtimeonwhichtheapplicationforadministrativereconsiderationisbased.

Article12Anapplicant,whorefusestoacceptaspecificadministrativeactofthedepartmentsunderlocalpeople’sgovernmentsatorabovethecountylevelmayapplyforadministrativereconsiderationtothepeople’sgovernmentatthesamelevel;

anapplicantmayalsoapplyforadministrativereconsiderationtothecompetentauthorityatthenexthigherlevel.
