THECOUNCILOFTHEEUROPEANUNION,
HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle37thereof,
HavingregardtotheproposalfromtheCommission,
HavingregardtotheOpinionoftheEuropeanParliament[1],
HavingregardtotheOpinionoftheEuropeanEconomicandSocialCommittee[2],
FollowingconsultationoftheCommitteeoftheRegions,
Whereas:
(1)TheProtocolonprotectionandwelfareofanimalsannexedtotheTreatyrequiresthatinformulatingandimplementingagricultureandtransportpolicies,theCommunityandtheMemberStatesaretopayfullregardtothewelfarerequirementsofanimals.
(2)UnderCouncilDirective91/628/EECof19November1991ontheprotectionofanimalsduringtransport[3],theCouncilhasadoptedrulesinthefieldofthetransportofanimalsinordertoeliminatetechnicalbarrierstotradeinliveanimalsandtoallowmarketorganisationstooperatesmoothly,whileensuringasatisfactorylevelofprotectionfortheanimalsconcerned.
(3)TheReportfromtheCommissiontotheEuropeanParliamentandtheCouncilontheexperienceacquiredbyMemberStatessincetheimplementationofCouncilDirective95/29/ECof29June1995amendingDirective91/628/EECconcerningtheprotectionofanimalsduringtransport[4],asrequiredunderDirective91/628/EEC,recommendedamendingcurrentCommunitylegislationinthisfield.
(4)MostMemberStateshaveratifiedtheEuropeanConventionfortheprotectionofanimalsduringinternationaltransportandtheCouncilhasgivenamandatetotheCommissiontonegotiateonbehalfoftheCommunitytherevisedEuropeanConventionfortheprotectionofanimalsduringinternationaltransport.
(5)Forreasonsofanimalwelfarethetransportofanimalsoverlongjourneys,includinganimalsforslaughter,shouldbelimitedasfaraspossible.
(6)TheCouncilinvitedtheCommissionon19June2001[5]tosubmitproposalsforensuringeffectiveimplementationandstrictenforcementofexistingCommunitylegislation,improvingtheprotectionandwelfareofanimalsaswellaspreventingtheoccurrenceandspreadofinfectiousanimaldiseases,andputtinginplacemorestringentrequirementssoastopreventpainandsufferinginordertosafeguardthewelfareandhealthofanimalsduringandaftertransport.
(7)On13November2001,theEuropeanParliamentcalledontheCommissiontopresentproposalsforamendingexistingCommunityrulesonthetransportoflivestock,inparticularwithaviewto:
-consultingthecompetentscientificcommitteeonthedurationofanimaltransport,
-presentingaharmonisedEuropeanmodelcertificatefortransporters;
harmonisingrouteplansforlongtransport,
-ensuringthatanymemberofstaffhandlinglivestockduringtransporthascompletedatrainingcourserecognisedbythecompetentauthorities,and
-ensuringthatveterinarychecksatCommunityborderinspectionpostsincludecomprehensiveinspectionofthewelfareconditionsinwhichanimalsaretransported.
(8)TheScientificCommitteeonAnimalHealthandAnimalWelfareadoptedanopiniononthewelfareofanimalsduringtransporton11March2002.Communitylegislationshouldthereforebeamendedtotakeintoaccountnewscientificevidencewhilegivingprioritytotheneedforitsenforceabilitytobeproperlyensuredintheimmediatefuture.
(9)Specificprovisionsforpoultry,catsanddogswillbesetoutinappropriateproposalswhentherelevantopinionsoftheEuropeanFoodSafetyAuthority(EFSA)areavailable.
(10)InthelightofexperiencegainedunderDirective91/628/EECinharmonisingCommunitylegislationonthetransportofanimals,andthedifficultiesencounteredduetothedifferencesintranspositionofthatDirectiveatnationallevel,itismoreappropriatetosetoutCommunityrulesinthisfieldinaregulation.PendingtheadoptionofdetailedprovisionsforcertainspecieshavingparticularneedsandrepresentingaverylimitedpartoftheCommunitylivestock,itisappropriatetoallowMemberStatestoestablishormaintainadditionalnationalrulesapplyingtotransportofanimalsofsuchspecies.
(11)InordertoensureaconsistentandeffectiveapplicationofthisRegulationacrosstheCommunityinthelightofitsbasicprincipleaccordingtowhichanimalsmustnotbetransportedinawaylikelytocauseinjuryorunduesufferingtothem,itisappropriatetosetoutdetailedprovisionsaddressingthespecificneedsarisinginrelationtothevarioustypesoftransport.Suchdetailedprovisionsshouldbeinterpretedandappliedinaccordancewiththeaforesaidprincipleandshouldbetimelyupdatedwhenever,inparticularinthelightofnewscientificadvice,theyappearnolongertoensurecompliancewiththeaboveprincipleforparticularspeciesortypesoftransport.
(12)Transportforcommercialpurposesisnotlimitedtotransportwhereanimmediateexchangeofmoney,goodsorservicestakesplace.Transportforcommercialpurposesincludes,inparticular,transportwhichdirectlyorindirectlyinvolvesoraimsatafinancialgain.
(13)Theunloadingandsubsequentreloadingofanimalscouldalsobeasourceofstressforthemandcontactatcontrolposts,formerlyreferredtoasstagingpoints,couldincertainconditionsleadtothespreadofinfectiousdiseases.Itisthereforeappropriatetoprovideforspecificmeasuressafeguardingthehealthandwelfareofanimalswhenrestingatcontrolposts.Asaresult,itisnecessarytoamendtheprovisionsofCouncilRegulation(EC)No1255/97of25June1997concerningCommunitycriteriaforstagingpointsandamendingtherouteplanreferredtointheAnnextoDirective91/628/EEC[6].
(14)Poorwelfareisoftenduetolackofeducation.Therefore,trainingshouldbeaprerequisiteforanypersonhandinganimalsduringtransportandtrainingshouldbeprovidedonlybyorganisationsapprovedbythecompetentauthorities.
(15)Welfareconditionsofanimalsduringtransportresultmainlyfromtheday-to-dayconductofthetransporters.ChecksbycompetentauthoritiesmaybehinderedastransporterscanfreelyoperateindifferentMemberStates.Therefore,transportersshouldbemoreaccountableandtransparentconcerningtheirstatusandoperations.Inparticulartheyshouldprovideproofoftheirauthorisation,systematicallyreportanydifficultyandkeeppreciserecordsoftheiractionsandtheresults.
(16)Animaltransportinvolvesnotonlytransportersbutalsoothercategoriesofoperatorssuchasfarmers,traders,assemblycentresandslaughterhouses.Asaconsequence,someobligationsregardingthewelfareofanimalsshouldbeextendedtoanyoperatorinvolvedinthetransportofanimals.
(17)Assemblycentresplayacriticalroleinthetransportofsomelivestockspecies.Therefore,assemblycentresshouldensurethatCommunitylegislationontheprotectionofanimalsduringtransportisknownandrespectedbytheiremployeesandvisitors.
(18)Longjourneysarelikelytohavemoredetrimentaleffectsonthewelfareofanimalsthanshortones.Hencespecificproceduresshouldbedesignedtoensurebetterenforcementofthestandards,inparticularbyincreasingthetraceabilityofsuchtransportoperations.
(19)CouncilRegulation(EEC)No3820/85of20December1985ontheharmonisationofcertainsociallegislationrelatingtoroadtransport[7]providesformaximumdrivingperiodsandminimumrestperiodsforroaddrivers.Itisappropriatethatjourneysforanimalsaresimilarlyregulated.CouncilRegulation(EEC)No3821/85of20December1985onrecordingequipmentinroadtransport[8]providesforrecordingequipmenttobeinstalledandusedtoensureeffectivecheckingoncompliancewithsociallegislationconcerningroadtransport.Itisnecessarythatsuchrecorddatabemadeavailableandcheckedsoastoenforcetravellingtimelimitsunderanimalwelfarelegislation.
(20)InsufficientexchangeofinformationbetweencompetentauthoritiesleadstoinadequateenforcementofCommunitylegislationfortheprotectionofanimalsduringtransport.Accordingly,itisnecessarytosetupflexibleprocedurestoimprovethelevelofcollaborationbetweenthecompetentauthoritiesinthedifferentMemberStates.
(21)RegisteredEquidae,asdefinedinArticle2(c)ofDirective90/426/EEC[9],arefrequentlytransportedfornon-commercialpurposesandsuchtransportsmustbecarriedoutinlinewiththeoverallobjectivesofthisRegulation.Havingregardtothenatureofsuchmovements,itappearsappropriatetoderogatefromcertainprovisionswhereregisteredEquidaearetransportedforcompetition,races,culturaleventsorbreeding.However,itisnotappropriatetoapplysuchderogationtoEquidaetransported,directlyoraftertransitthroughamarketormarshallingcentre,toaslaughterhouseforslaughter,whichinaccordancewithArticle2(d)and8
(1),secondindentofDirective90/426/EEC,aretobeconsideredas"

(22)Inadequatefollow-upofinfringementsoflegislationonanimalwelfareencouragesnon-compliancewithsuchlegislationandleadstodistortionofcompetition.Therefore,uniformproceduresshouldbeestablishedthroughouttheCommunitytoincreasechecksandtheimpositionofpenaltiesforinfringementsofanimalwelfarelegislation.TheMemberStatesshouldlaydownrulesonpenaltiesapplicabletoinfringementsoftheprovisionsofthisRegulationandensurethattheyareimplemented.Thosepenaltiesmustbeeffective,proportionateanddissuasive.
(23)Asignificantnumberofanimalsaretransportedbylivestockvessel
