Members,
Desiringtoreducedistortionsandimpedimentstointernationaltrade,andtakingintoaccounttheneedtopromoteeffectiveandadequateprotectionofintellectualpropertyrights,andtoensurethatmeasuresandprocedurestoenforceintellectualpropertyrightsdonotthemselvesbecomebarrierstolegitimatetrade;
Recognizing,tothisend,theneedfornewrulesanddisciplinesconcerning:
(a)theapplicabilityofthebasicprinciplesofGATT1994andofrelevantinternationalintellectualpropertyagreementsorconventions;
(b)theprovisionofadequatestandardsandprinciplesconcerningtheavailability,scopeanduseoftrade-relatedintellectualpropertyrights;
(c)theprovisionofeffectiveandappropriatemeansfortheenforcementoftrade-relatedintellectualpropertyrights,takingintoaccountdifferencesinnationallegalsystems;
(d)theprovisionofeffectiveandexpeditiousproceduresforthemultilateralpreventionandsettlementofdisputesbetweengovernments;
and
(e)transitionalarrangementsaimingatthefullestparticipationintheresultsofthenegotiations;
Recognizingtheneedforamultilateralframeworkofprinciples,rulesanddisciplinesdealingwithinternationaltradeincounterfeitgoods;
Recognizingthatintellectualpropertyrightsareprivaterights;
Recognizingtheunderlyingpublicpolicyobjectivesofnationalsystemsfortheprotectionofintellectualproperty,includingdevelopmentalandtechnologicalobjectives;
Recognizingalsothespecialneedsoftheleast-developedcountryMembersinrespectofmaximumflexibilityinthedomesticimplementationoflawsandregulationsinordertoenablethemtocreateasoundandviabletechnologicalbase;
Emphasizingtheimportanceofreducingtensionsbyreachingstrengthenedcommitmentstoresolvedisputesontrade-relatedintellectualpropertyissuesthroughmultilateralprocedures;
DesiringtoestablishamutuallysupportiverelationshipbetweentheWTOandtheWorldIntellectualPropertyOrganization(referredtointhisAgreementas"
WIPO"
)aswellasotherrelevantinternationalorganizations;

PARTI
GENERALPROVISIONSANDBASICPRINCIPLES
Article1
NatureandScopeofObligations
1.MembersshallgiveeffecttotheprovisionsofthisAgreement.Membersmay,butshallnotbeobligedto,implementintheirlawmoreextensiveprotectionthanisrequiredbythisAgreement,providedthatsuchprotectiondoesnotcontravenetheprovisionsofthisAgreement.MembersshallbefreetodeterminetheappropriatemethodofimplementingtheprovisionsofthisAgreementwithintheirownlegalsystemandpractice.
2.ForthepurposesofthisAgreement,theterm"
intellectualproperty"
referstoallcategoriesofintellectualpropertythatarethesubjectofSections1through7ofPartII.
3.MembersshallaccordthetreatmentprovidedforinthisAgreementtothenationalsofotherMembers.Inrespectoftherelevantintellectualpropertyright,thenationalsofotherMembersshallbeunderstoodasthosenaturalorlegalpersonsthatwouldmeetthecriteriaforeligibilityforprotectionprovidedforintheParisConvention(1967),theBerneConvention(1971),theRomeConventionandtheTreatyonIntellectualPropertyinRespectofIntegratedCircuits,wereallMembersoftheWTOmembersofthoseconventions.AnyMemberavailingitselfofthepossibilitiesprovidedinparagraph
3ofArticle5orparagraph
2ofArticle
6oftheRomeConventionshallmakeanotificationasforeseeninthoseprovisionstotheCouncilforTrade-RelatedAspectsofIntellectualPropertyRights(the"
CouncilforTRIPS"
).
