　　CHAPTERIVCULTURALRELICSINTHECOLLECTIONOFCULTURALINSTITUTIONS

　　第二十二条全民所有的博物馆、图书馆和其他单位对收藏的文物，必须区分文物等级，设置藏品档案，建立严格的管理制度，并向文化行政管理部门登记。

　　Article22Museums,librariesandotherinstitutionsunderownershipbythewholepeoplemustclassifytheculturalrelicsintheircollectionbydifferentgrades,compilefilesfortherelicskeptbythem,establishastrictsystemofcontrolandregistertherelicswiththerelevantdepartmentforculturaladministration.

　　地方各级文化行政管理部门，应分别建立本行政区域内的馆藏文物档案；

国家文化行政管理部门应建立国家一级文物藏品档案。

　　Localdepartmentsforculturaladministrationatvariouslevelsshallcompilefilesfortheculturalrelicsinthecollectionofculturalinstitutionsintheirrespectiveadministrativeareas;

thestatedepartmentforculturaladministrationshallcompilefilesforGradeOneculturalrelicsofthestate.

　　第二十三条全民所有的博物馆、图书馆和其他单位的文物藏品禁止出卖。

这些单位实行文物藏品的调拨、交换，必须报文化行政管理部门备案；

　　Article23Salesofculturalrelicsinthecollectionofmuseums,librariesandotherinstitutionsunderownershipbythewholepeopleshallbeprohibited.Transfersandexchangesamongtheseinstitutionsoftheculturalrelicsintheircollectionmustbereportedtothedepartmentsforculturaladministrationfortherecord;

　　一级文物藏品的调拨、交换，须经国家文化行政管理部门批准。

未经批准，任何单位或者个人不得调取文物。

　　transfersandexchangesofGradeOneculturalrelicsintheircollectionmustbeapprovedbythestatedepartmentforculturaladministration.Nounitorindividualmayhaveculturalrelicstransferredwithoutapproval.

　　第五章私人收藏文物

　　CHAPTERVCULTURALRELICSINPRIVATECOLLECTIONS

　　第二十四条私人收藏的文物能够由文化行政管理部门指定的单位收购，其他任何单位或者个人不得经营文物收购业务。

　　Article24Culturalrelicsinprivatecollectionsmaybepurchasedbyunitsdesignatedbythedepartmentsforculturaladministration;

nootherunitorindividualmayengageinthebusinessofpurchasingculturalrelics.

　　第二十五条私人收藏的文物，严禁倒卖牟利，严禁私自卖给外国人。

　　Article25Theresaleofculturalrelicsinprivatecollectionsataprofitshallbestrictlyforbidden,andsoshallbetheprivatesaleofsuchrelicstoforeigners.

　　第二十六条银行、冶炼厂、造纸厂以及废旧物资回收部门，应与文化行政管理部门共同负责拣选出掺杂在金银器和废旧物资中的文物，除供银行研究所必需的历史货币能够由银行留用外，其余移交给文化行政管理部门处理。

移交的文物须合理作价。

　　Article26Banks,smelteries,papermillsanddepartmentsfortherecoveryofoldandwastematerialsshallassumeresponsibility,jointlywiththedepartmentsforculturaladministration,forsortingoutculturalrelicsfromamonggoldandsilverarticlesandwastematerials.Theculturalrelicsthusobtained,exceptforcoinsandotherkindsofcurrencyofpastageswhichareneededbyresearchinstitutesofthebanksandwhichmaybekeptbythebanks,shallbeturnedovertoandplacedatthedisposalofthedepartmentsforculturaladministration.Thepricesoftheculturalrelicsturnedovershallbereasonablyassessed.

　　公安、海关、工商行政管理部门依法没收的重要文物，理应移交给文化行政管理部门。

　　Importantculturalrelicsconfiscatedaccordingtolawbypublicsecurityorgans,theCustomsandthedepartmentsfortheadministrationofindustryandcommerceshallbeturnedovertothedepartmentsforculturaladministration.

　　第六章文物出境

　　CHAPTERVITAKINGCULTURALRELICSOUTOFCHINA

　　第二十七条文物出口和个人携带文物出境，都必须事先向海关申报，经国家文化行政管理部门指定的省、自治区、直辖市文行政管理部门实行鉴定，并发给许可出口凭证。

　　Article27CulturalrelicstobeexportedortobetakenoutofthecountrybyindividualsmustbedeclaredtotheCustomsinadvanceandexaminedbythedepartmentforculturaladministrationofaprovince,anautonomousregionoramunicipalitydirectlyundertheCentralGovernmentdesignatedbythestatedepartmentforculturaladministrationbeforeexportcertificatesaregranted.

　　文物出境必须从指定口岸运出。

经鉴定不能出境的文物，国家能够征购。

　　Culturalrelicsleavingthecountrymustbeshippedoutatdesignatedports.Culturalrelicswhich,afterexamination,arenotpermittedtoleavethecountrymayberequisitionedbythestatethroughpurchase.

　　第二十八条具有重要历史、艺术、科学价值的文物，除经国务院批准运往国外展览的以外，一律禁止出境。

　　Article28Itshallbeprohibitedtotakeoutofthecountryanyculturalrelicsofsignificanthistorical,artisticorscientificvalue,withtheexceptionofthosetobeshippedabroadforexhibitionwiththeapprovaloftheStateCouncil.

　　第七章奖励与惩罚

　　CHAPTERVIIAWARDSANDPENALTIES

　　第二十九条有下列事迹的单位或者个人，由国家给予适当的精神鼓励或者物质奖励：

　　Article29Thestateshallgiveappropriatemoralencouragementormaterialawardstounitsorpersonsforanyofthefollowingdeeds：

（一）认真执行文物政策法令，保护文物成绩显著的；

（1）seriousimplementationofthepolicies,lawsandregulationsconcerningculturalrelicsandremarkableachievementsinprotectingculturalrelics;

（二）为保护文物与违法犯罪行为作坚决斗争的；

（2）resolutestruggleagainstcriminalacts,intheinterestofprotectingculturalrelics;

　　（三）将个人收藏的重要文物捐献给国家的；

　　（3）donationofimportantculturalrelicsinone'

sowncol
