CHAPTER-1

INTRODUCTION

Notification1.1InexerciseofthepowersconferredunderSection5oftheForeignTrade（DevelopmentandRegulation）Act,1992（No.22of1992）theCentralGovernmenthasnotifiedon31stMarch,2002,theExportandImportPolicyfortheperiod2002-2007（hereinafterreferredtoasthePolicy）.

Inpursuanceoftheprovisionsofparagraph2.4ofthePolicy,theDirectorGeneralofForeignTradeherebynotifiesthecompilationknownasHandbookofProcedures（Vol.1）,HandbookofProcedures（Vol.2）andScheduleofDEPBrates.Thesecompilations,asamendedfromtimetotime,shallremaininforceuntil31stMarch,2007

Objective1.2TheobjectiveofthisHandbookistoimplementtheprovisionsoftheForeignTrade（DevelopmentandRegulation）Act,1992,theRulesandOrdersmadethereunderandtheExportandImportPolicy（2002-07）bylayingdownsimple,transparentandEDI（ElectronicDataInterchange）amenableprocedureswhichareeasytocomplywithandadministerforefficaciousmanagementofforeigntrade.

Definition1.3ForthepurposeofthisHandbook,thedefinitionscontainedintheForeignTrade（DevelopmentandRegulation）Act,1992,theRulesandOrdersmadethereunderandtheExportandImportPolicy（2002-07）shallapply.

CHAPTER-2

GENERALPROVISIONSREGARDINGEXPORTSANDIMPORTS

Policy2.1ThePolicyrelatingtothegeneralprovisionsregardingexportsandimportsisgiveninChapter-2ofthePolicy.

CountriesofImports/Exports2.2Unlessotherwisespecificallyprovided,import/exportwillbevalidfrom/toanycountryexceptIraq.However,thereshallbenobanontheexportofitemstoIraqorimportofitemsfromIraqincasewherethepriorapprovaloftheconcernedsanctionscommitteeoftheUnitedNation抯SecurityCouncilhasbeenobtained.

ExportofitemstoLibyaaslistedoutinAppendix-31areprohibited.

ApplicationFee2.3Unlessotherwiseexempted,specifiedfeeshallbepaidformakinganapplicationunderanyprovisionofthePolicyandthisHandbook.Thescaleoffee,modeofpayment,procedureforrefundoffeeandthecategoriesofpersonsexemptedfromthepaymentoffeearecontainedinAppendix-29

TerritorialJurisdictionofLicensingAuthorities2.4Everyapplication,unlessotherwisespecified,shallbesubmittedtothelicensingauthorityconcerned,aspertheterritorialjurisdictionofthelicensingauthoritiesindicatedinAppendix-24

FilingofApplication2.5Everyapplicationforanimport/exportlicence/certificate/permissionoranyotherpurposeshouldbecompleteinallrespectsasrequiredundertherelevantprovisionsofthePolicy/Proceduresandshallbesignedbytheapplicantasdefinedinparagraph9.9ofthePolicy.Anincompleteapplicationisliabletoberejectedgivingspecificreasonforrejection.Howeverincaseofmanualapplications,theapplicantwouldfurnishasoftcopy（ona1.44�floppydisk）oftheapplicationinMSwordformat.（PN34dtd13.09.02）

ProfileofImporter/Exporter2.6Eachimporter/exportershallberequiredtofileimporter/exporterprofileoncewiththelicensingauthorityintheformgiveninAppendix-2.LicensingauthorityshallentertheinformationfurnishedinAppendix-2intheirdatabasesoastodispensewiththeneedforaskingtherepetitiveinformation.IncaseofanychangeintheinformationgiveninAppendix-2,importer/exportershallintimatethesametothelicensingauthority.

SelfAddressedStampedEnvelope2.7Theapplicantshallfurnishaselfaddressedenvelopeof40X15cmwithpostalstampaffixedontheenvelopeasfollowsforalldocumentsrequiredtobesentbySpeedPost:

ExemptedCategories2.8ThefollowingcategoriesofimportersorexportersareexemptedfromobtainingImporter-ExporterCode（IEC）number:

（i）Importerscoveredbyclause3

（1）[exceptsub-clauses（e）and（l）]andexporterscoveredbyclause3

（2）[exceptsub-clauses（i）and（k）]oftheForeignTrade（ExemptionfromapplicationofRulesincertaincases）Order,1993.

（ii）Ministries/DepartmentsoftheCentraloraStateGovernment.

（iii）Personsimportingorexportinggoodsfortheirpersonalusenotconnectedwithtradeormanufactureoragriculture.

（iv）Personsimporting/exportinggoodsfrom/toNepalprovidedtheCIFvalueofasingleconsignmentdoesnotexceedIndianRs.25,000.

（v）Personsimporting/exportinggoodsfrom/toMyanmarthroughIndo-MyanmarborderareasprovidedtheCIFvalueofasingleconsignmentdoesnotexceedIndianRs.25,000.

However,theexemptionfromobtainingImporter-ExporterCode（IEC）numbershallnotbeapplicablefortheexportofSpecialChemicals,Organisms,Materials,EquipmentsandTechnologies（SCOMET）aslistedinAppendix-3,Schedule2oftheITC（HS）exceptinthecaseofexportsbycategory（ii）above.

（vi）ThefollowingpermanentIECnumbersshallbeusedbythecategoriesofimporters/exportersmentionedagainstthemforimport/exportpurposes.

ApplicationforGrantofIECNo.2.9AnapplicationforgrantofIECnumbershallbemadebytheRegistered/HeadOfficeoftheapplicanttothelicensingauthorityunderwhosejurisdiction,theRegisteredofficeincaseofcompanyandHeadofficeincaseofothersfallsintheformspecifiedinAppendix-3andshallbeaccompaniedbydocumentsprescribedtherein.

IECFormatandStatements2.9.1TheLicensingAuthorityconcernedshallissueanIECnumberintheformatasgiveninAppendix-3A.AcopyofsuchIECnumbershallbeendorsedtotheconcernedbanker（asperthedetailsgivenintheIECapplicationform）.AconsolidatedstatementofIECnumbers,issuedbythelicensingauthority,shallbesenttotheExchangeControlDepartmentoftheRBIintermsofAppendix-30,asperdetailsgiveninAppendix-3B.

ValidityofIECNo.2.9.2AnIECnumberallottedtoanapplicantshallbevalidforallitsbranches/divisions/units/factoriesasindicatedintheformatofIECgiveninAppendix-3A.

DuplicateCopyofIECNo.2.9.3WhereanIECNumberislostormisplaced,theissuingauthoritymayconsiderrequestsforgrantofaduplicatecopyofIECnumber,ifaccompaniedbyanFIRandanaffidavit.

SurrenderofIECNo.2.9.4IfanIECholderdoesnotwishtooperatetheallottedIECnumber,hemaysurrenderthesamebyinformingtheissuingauthority.Onreceiptofsuchintimation,theissuingauthorityshallimmediatelycancelthesameandelectronicallytransmitittoDGFTforonwardtransmissiontotheCustomsandRLAs.

ApplicationFormforImportandExportofRestrictedItems2.10Anapplicationforgrantofalicence/certificate/permissionforimportorexportofitemsmentionedasrestrictedinITC（HS）maybemadeintheformandtothelicensingauthoritiesspecifiedundertherelevantchaptersofthisHandbook.

ImportsunderIndo-USMemorandumofUnderstanding2.11Importofspecifiedcapitalgoods,rawmaterials,components,etc.fromtheUnitedStatesofAmericaissubjecttoUSExportControlRegulations.USsuppliersofsuchitemsarerequiredtoobtainanexportlicence/certificate/permissionbasedontheimportcertificatefurnishedbytheIndianimportertotheUSsupplier.ThefollowingarethedesignatedImportCertificateIssuingAuthorities（ICIA）:

（i）TheDepartmentofElectronics,forimportofcomputerandcomputerbasedsystems;

（ii）TheDepartmentofIndustrialPolicyandPromotion,TechnicalSupportWing（TSW）,fororganisedsectorunitsregisteredunderit,exceptforimportofcomputersandcomputerbasedsystems;

（iii）TheMinistryofDefence,fordefencerelateditems;

（iv）TheDirectorGeneralofForeignTradeforsmallscaleindustriesandentitiesnotcoveredaboveaswellasonbehalfofanyoftheabove;

（v）TheEmbassyofIndia,Washington,DC,onbehalfofanyoftheabove.

ArequestforanimportcertificateshallbemadeintheformgiveninAppendix-7.TheimportcertificateintheformgiveninAnnexuretoAppendix-7maybeissuedb
