医疗技术临床应用管理办法

为加强医疗技术临床应用管理～建立医疗技术准入和管理制度～促进医学科学发展和医疗技术进步～提高医疗质量～保障医疗安全～根据卫生部《医疗技术临床应用管理办法》,卫医政发（2009）18号,件精神结合医院实际情况制定本办法。

第一章总则

第一条根据《执业医师法》、《医疗机构管现条例》、《医疗事故处理条例》等有关法律、法规和规章～制定本办法。

第二条本办法所称医疗技术～是指医疗机构及其医务人员以诊断和治疗疾病为目的～对疾病作出判断和消除疾病、缓解病情、减轻痛苦、改善功能、延长生命、帮助患者恢复健康而采取的诊断、治疗措施。

第三条医院开展医疗技术临床应用应当遵守本办法。

第四条医疗技术临床应用应当遵循科学、安全、规范、有符合伦理的原则。

医院开展医疗技术应当与其功能任务相适应～具有符合资质人员、相应的设

备、设施和质量控制体系～并遵守技术管理规范。

第五条根据国家建立的医疗技术临床应用准入和管理制度～对医疗技术实行分类、分级管理。

第六条医务科负责医院医疗技术临床应用管理工作。

第二章医疗技术分类分级管理

第七条医疗技术分为三类:

第一类医疗技术是指安全性、有效性～医疗机构通过常规管理在临床应用中能确保其安全性、有效性的技术。

第二类医疗技术是指安全性、有效性～涉及一定伦理问题或风险较高～卫生行政部门应当加以控制管理的医疗技术。

第三类医疗技术是指具有下列情形之一～需要卫生行政部门加以严格控制管理的医疗技术:

一,涉及重大伦理问题,

二,高风险,

三,安全性、有效性尚需经规范的临床试验研究进一步验证,

四,需要使用稀缺资源;

五,卫生部规定的其他需要特殊管理的医疗技术。

第八条卫生部负责第三类医疗技术的临床应用管理工作。

第九条第三类医疗技术目录由卫生部制定公布～并根据临床应用实际情况予以调整。

第十条省级卫生行政部门负责第二类医疗技术临床应用管理工作。

况公布～报卫生部备案。

省级卫生行政部门不得将卫生部废除或者禁止使用的医疗技术列入本行政区医疗技术目录。

第十一条第一类医疗技术临床应用由医院根据功能、任务、技术能力实施严格管理。

第十二条医院依法准予医务人员实施与其专业能力相适应的医疗技术。

第十三条医院开展的临床检验项目必须是卫生部公布的准予开展的临床检验项目。

第十四条医务人员不得在临床应用卫生部废除或者禁止使用的医疗技术。

第三章医疗技术临床应用能力审核

第十五条属于第三类的医疗技术首次应用于临床前～必须经过卫生部组织的安全性、有效性临床试验研究、论证及伦理审查。

第十六条第二类医疗技术和第三类医疗技术临床应用前实行第三方技术审核制度。

对医务人员开展第一类医疗技术临床应用的能力技术审核～由医院审核后组织实施～必要时可以由省级卫生行政部门规定。

第十七条医院专家技术委员会为医院医疗技术临床应用技术审核组织～根据工作需要建立专家库。

第十八条各科室、部门申请医疗技术临床应用能力技术审核时～应当提交医疗技术临床应用可行性研究报告～内容包括:

一,开展该项医疗技术的目的、意义和实施方案,

二,该项医疗技术的基本概况～包括国内外应用情况、适应证、禁忌证、不良反应、技术路线、质量控制措施、疗效判定标准、评估方法～与其他医疗技术诊疗同种疾病的风险、疗效、费用及疗程比较等

三,开展该项医疗技术具备的条件～包括主要技术人员的执业注册情况、资质、相关履历～医疗机构的设备、设施、其他辅助条件、风险评估及应急预案,

四,其他需要说明的问题。

第十九条有下列情形之一的～各科室不得提出医疗技术临床应用能力申请:

一,申请的医疗技术是卫生部废除或者禁止使用的,

二,申请的医疗技术未列入相应目录的,

三,申请的医疗技术距上次同一医疗技术未通过临床应用能力技术审核时间未满12个月的,

四,省级以上卫生行政部门规定的其他情形。

第四章医疗技术临床应用管理

第二十条根据卫生部规定～省级卫生行政部门负责审定第二类医疗技术的临床应用。

第二十一条医院建立医疗技术分级管理制度和保障医疗技术临床应用质量、安全的规章制度～建立相关医疗技术档案～对医疗技术定期进行安全性、有效性和合理应用情况的评估。

第二十二条根据卫生部规定建立手术分级管理制度。

根据风险和难易程度不同～手术分为四级:

一级手术是指风险较低、过程简单、技术难度低的普通手术,

二级手术是指有一定风险、过程复杂程度一般、有一定技术难度的手术,

三级手术是指风险较高、过程较复杂、难度较大的手术,

四级手术是指风险高、过程复杂、难度大的重大手术。

第二十三条医院对具有不同专业技术职务任职资格的医师级开展不同级别的手术进行限定～并对其专业能力进行审核
