A.GeneralProvisionsandDefinitions

Article1

ApplicationofURC522

a.TheUniformRulesforCollections,1995Revision,ICCPublication,shallapplytoallcollectionsasdefinedinArticle2wheresuchrulesareincorporatedintothetextofthe

“collectioninstruction”referredtoinArticle4andarebindingonallpartiestheretouniessotherwiseexpresslyagreedorcontrarytotheprovisionsofanational,stateorlocallawand/orregulationwhichcannotbedepartedfrom.

b.Banksshallhavenoobligationtohandleeitheracollectionoranycollectioninstructionorsubsequentrelatedinstructions.

c.Ifabankelects,foranyreason,nottohandleacollectionoranyrelatedinstructionsreceivedbyit,itmustadvisethepartyfromwhomitreceivedthecollectionortheinstructionsbytelecommunicationor,ifthatisnotpossible,byotherexpeditiousmeans,withoutdelay.

Article2

DefinitionofCollection

ForthepurposesoftheseArticles:

a.“Collection”meansthehandlingbybanksofdocumentsasdefinedinsub-Article2（b）,inaccordaneereceived,inorderto:

I.obtainpaymentand/oracceptanee,or

II.deliverdocumentsagainstpaymentand/oragainstacceptance,or

III.deliverdocumentsonothertermsandconditions.

b.“Documents”meansfinancialdocumentsand/orcommercialdocuments:

I.“Financialdocuments”meansbillsofexchange,promissorynotes,cheques,orothersimilarinstrumentsusedforobtainingthepaymentofmoney;

II.“Commercialdocuments”meansinvoice,transportdocuments,documentsoftitleorothersimilardocuments,oranyotherdocumentswhatsoever,notbeingfinancialdocuments.

c.”Cleancollection”meanscollectionoffinancialdocumentsnotaccompaniedbycommercialdocuments.

d.”Documentarycollection”meanscollectionof:

I.financialdocumentsaccompaniedbycommercialdocuments;

documentsnotaccompaniedbyfinancialdocuments.

Article3

a.ForthepurposesoftheseArticlesthe“partiesthereto”are:

I.the“principal”whoisthepartyentrustingthehandlingofacollectiontoabank;

II.the“remittingbank”whichisthebanktowhichtheprincipalhasentrustedthehandlingofacollection;

III.“collectingbank”whichisanybank,otherthantheremittingbank,involvedinprocessingthecollection;

IV.the“presentingbank”whichisthecollectingbankmakingpresentationtothedrawee.

b.The“drawee”istheonetowhompresentationistobemadeinaccordaneewiththecollectioninstruction.

B.FormandStructureofCollections

Article4

CollectionInstruction

Ai.AlldocumentssentforcollectionmustbeaccompaniedbyacollectioninstructionindicatingthatthecollectionissubjecttoURC522andgivingcompleteandpreciseinstructions.Banksareonlypermittedtoactupontheinstructionsgiveninsuchcollectioninstruction,andinaccordaneewiththeseRules.

ii.Bankswillnotexaminedocumentsinordertoobtaininstructions.

iii.Uniessotherwiseauthorizedinthecollectioninstruction,bankswilldisregardanyinstructionsfromanyparty/bankotherthantheparty/bankfromwhomtheyreceivedthecollections.

BAcollectioninstructionshouldcontainthefollowingitemsofinformation,asappropriate.

i.Detailsofthebankfromwhichthecollectionwasreceivedincludingfullname,postalandSWIFTaddresses,telex,telephone,facsimilenumbersandreferece.

ii.Detailsoftheprincipalincludingfullname,postaladdress,andifapplicabletelex,telephoneandfacsimilenumbers.

iii.Detailsofthedraweeincludingfullname,postaladdress,orthedomicileatwhichpresentationistobemadeandifapplicabletelex,telephoneandfacsimilenumbers.

iv.Detailsofthepresentingbank,ifany,includingfullname,postaladdress,andifapplicabletelex,telephoneandfacsimilenumbers.

v.Amount（s）andcurrency（ies）tobecollected.

vi.Listofdocumentsenclosedandthenumerialcountofeachdocument.

vii.a）Termsandconditionsuponwhichpaymentand/oracceptaneeistobeobtained.

b）Termsofdeliveryofdocumentsagainst:

1）paymentand/oracceptanee

2）othertermsandconditions

Itistheresponsibilityofthepartypreparingthecollectioninstructiontoensurethatthetermsforthedeliveryofdocumentsareclearlyandunambiguouslystated,otherwisebankswillnotberesponsibleforanyconsequencesarisingtherefrom.

viii.Chargestobecollected,indicatingwhethertheymaybewaivedornot.

ix.Interesttobecollected,ifapplicable,indicatingwhetheritmaybewaivedornot,including:

a）rateofinterest

b）interestperiod

c）basisofcalculation（forexample360or365daysinyear）asapplicable.

x.Methodofpaymentandformofpaymentadvice.

xi.Instrucitonsincaseofnon-payment,non-acceptaneeand/ornon-complianeewithotherinstructions.

i.Collectioninstructionsshouldbearthecompleteaddressofthedraweeorofthedomicileatwhichthepresentationistobemade.Iftheaddressisincompleteorincorrect,thecollectingbankmay,withoutanyliabilityandresponsibilityonitspart,endeavourtoascertaintheproperaddress.

ii.Thecollectingbankwillnotbeliableorresponsibleforanyensuingdelayasaresultofanaddressbeingprovided.

B.FormofPresentation

Article5

Presentation

a.ForthepurposesoftheseArticles,presentationistheprocedurewherebythepresentingbankmakesthedocumentsavailabletothedraweeasinstructed.

b.Thecollectioninstructionshouldstatetheexactperiodoftimewithinwhichanyactionistobetakenbythedrawee.

Expressionssuchas“first”,“prompt”，”immediate”,andthelikeshouldnotbeusedinconnectionwithpresentationorwithrefereneetoanyperiodoftimewithinwhichdocumentshavetobetakenuporforanyotheractionthatistobetakenbythedrawee.Ifsuchtermsareusedbankswilldisregardthem.

c.Documentsaretobepresentedtothedraweeintheforminwhichtheyarereceived,exceptthatbanksareauthorizedtoaffixanynecessarystamps,attheexpenseofthepartyfromwhomtheyreceivedthecollectionuniessotherwiseinstructed,andtomakeanynecessary

endorsementsorplaceanyrubberstampsorotheridentifyingmarksorsymbolscustomarytoorrequiredforthecollectionoperation.

d.Forthepurposeofgivingeffecttotheinstructionsoftheprincipal,theremittingbankwillutilizethebanknominatedbytheprincipalasthecollectingbank.Intheabsenceofsuch

nomination,theremittingbankwillutilizeanybankofitsown,oranotherbank'schoiceinthecountryofpaymentoracceptanceorinthecountrywhereothertermsandconditionshavetobecompliedwith.

e.Thedocumentsandcollectioninstructionmaybesentdirectlybytheremittingbanktothecollectingbankorthroughanotherbankasintermediary.

f.Iftheremittingbankdoesnotnominateaspecificpresentingbank,thecollectingbankmayutilizeapresentingbankofitschoice.

Article6

Sight/Acceptance

Inthecaseofdocumentspayableatsightthepresentingbankmustmakepresentationforpaymentwithoutdelay.

Inthecaseofdocumentspayableatatenorotherthansightthepresentingbankmust,whereacceptanceiscalledfor,makepresentationforacceptancewithoutdelay,andwherepaymentiscalledfor,makepresentationforpaymentnotlaterthantheappropriatematuritydate.

ReleaseofCommercialDocuments

DocumentsAgainstAcceptance（D/A）vs.DocumentsAgainstPayment（D/P）shouldnotcontainbillsofexchangepayableatafuturedatewithinstructionthatcommercialdocumentsaretobedeliveredagainstpayment.

b.Ifacollectioncontainsabillofexchangepayableatafuturedate,thecollection

instructionshouldstatewhetherthecommercialdocumentsaretobereleasedtothedraweeagainstacceptance（D/A）oragainstpayment（D/P）.

Intheabsenceofsuchstatementcommercialdocumentswillbereleasedonlyagainstpaymentandthecollectingbankwillnotberesponsibleforanyconsequencesarisingoutofanydelayinthedeliveryofdocuments.

c.Ifacollectioncontainsabillofexchangepayableatafuturedateandthecollection

instructionindicatesthatcommercialdocumentsaretobereleasedagainstpayment,documentswillbereleasedonlyagainstsuchpaymentandthecollectingbankwillnotberesponsibleforanyconsequencesarisingoutofanydelayinthedeliveryofdocuments.
