ARTICLESOFAGREEMENTMADETHEdayof20.

BETWEEN

（hereinaftercalled“TheOwner”）oftheonepartand

of（orwhoseofficeissituatedat）（hereinaftercalled“TheBuilder”）oftheotherpart.

WHEREAStheOwnerisdesirousofhavingahouseanditssupportinginfrastructure（hereinaftercalledtheWorks）constructedinaccordancewiththedrawingsandspecificationsapprovedbytheBoardandinaccordancewiththeGeneralInformationatSection2andtheGeneralConditionsofContractatSection3.

ANDWHEREAStheBuilderhassubmittedhisofferdateddayof20,

offeringtocompleteandmaintaintheWorksuponthesaidconditionsandinaccordancewiththeDrawingsandSpecifications.

ANDWHEREAStheOwnerhasacceptedtheBuilder’sofferconveyedinthesaidtender.

NOWITISHEREBYAGREEDASFOLLOWS:

（1）Fortheconsiderationhereinaftermentioned,theBuildershallcompleteandmaintaintheWorkssubjectedtothesaidConditionsofContractandinaccordancewiththeDrawingsandSpecifications.

（2）TheOwnerwillpaytheBuilderthesumof（$EC）__________________________

orsuchothersumasshallbecomepayableinaccordancewiththesaidConditionsofContractfortheconstruction,completion,andmaintenanceoftheWorks.

SECTION2

GENERALINFORMATION

2.1ThisdraftofacontractbetweentheOwnerandtheBuilderisintendedtobeusedfortheconstructionofsmallhouseswhicharewithinthescopeoftheBuildingGuidelines.BuildingsoutsidethescopeoftheBuildingGuidelinesaremorecomplicatedandanyagreementbetweentheOwnerandtheBuildershouldbemadeusingthestandardagreementsdraftedbythemajorarchitecturalandengineeringinstitutionsoftheUK.USA,Canada,orEurope.

2.2AstandardcontractfortheconstructionofahousewillcontaindrawingsandspecificationsasapprovedbytheBoard,GeneralConditionsfortheexecutionoftheWorkswhichincludethehouseitselfandtheexteriorworkssuchastheseptictank,drainage,watercistern,accessroadsandlandscapingwhererequired.

2.3Thisdraftassumesthat:

2.3.1Aperson（theOwner）wishestoconstructahouseandhaspurchasedorownslandsuitablefortheconstructionofahouse.

2.3.2AdesignerhasbeenengagedbytheOwnertodrawupplansforthehouse.

2.3.3TheplansdrawnareinaccordancewiththerequirementsoftheBoardandtherelevantRegulationsinallrespects,andincludeadequateinformationonitemssuchasthestructureofthebuilding,electricity,plumbing,septictank,drainage,watercisternandguttering,accessroadways,landscapinganddescriptionsofthematerialstobeused.

2.3.4Theplansincludeadequateinformation（specifications）onthematerialstobeusedsothattheOwnerortheBuildercanpurchasethematerialsforthehouse.Suchdescriptionsorspecifications,canbenotedontheplansorinaseparatedocument.

2.3.5TheplanshavebeenapprovedbytheOwner.

2.3.6TheplanshavebeenapprovedbytheBoard.

2.3.7Thedesigner,theOwnerortheOwner’srepresentativewillberequiredtoinspecttheconstructiontoensurethattheBuildercarriesouttheworkinaccordancewiththeplansapprovedbytheBoard

2.3.8TheBuilderwillbeaskedbytheOwnertoprovideapriceforconstructingthehouseinaccordancewiththeapprovedplansandthepricewillincludeallmaterialtoolsandequipmentandlabourneededtoconstructthehouseincludingallinteriorandexteriorWorks,unlesstheOwnerdecidesinwritingthatcertainpartsoftheWorkswillnotbecarriedoutbytheBuilder.

2.4TheagreementbetweentheOwnerandtheBuilderwillnotbeinforceuntiltheBoardhasapprovedtheplansfortheconstructionofthehouse.

SECTION3

STANDARDCONDITIONSOFCONTRACT

3.1Commencementoftheworks

3.1.1Dateofsigningofthecontract:

3.4Variationsandalterations

3.4.1TheOwnerhastherighttorequesttheBuildertocarryoutallvariationsandalterationsfromtheplansandspecificationsprovidedthatsuchalterationsandvariationshavebeenapprovedbytheBoardinaccordancewiththecontrollinglegislation.

3.4.2TheBuildershallpricesuchvariationsandalterationswithinareasonableamountoftimeofthereceiptoftherequestsbytheOwnertodoso.WorkshallnotbecarriedoutonthealterationsandvariationsuntiltheOwnerandtheBuilderhaveagreedtothepriceschargedbytheBuilderforsuchwork.

3.4.3TheBuildershallstatewhetherthealterationsorvariationsrequestedwillleadtoanextensionoftimeforthecompletionoftheWorksandhe/sheshallgivetheOwnerhis/herbestestimateoftheextratimerequired.

3.5.Extensionoftime

3.5.1AssoonastheBuilderrecognisesthattheworkwillnotbefinishedinthetimeagreedupon,he/sheshallinformtheOwneroftheneedformoretimetocompletetheWorksandthereasonfortherequestfortheincreasedtime.

3.5.2ItisthedutyoftheOwnertoconsidertherequestforanextensionofthecontracttimetakingintoaccountthereasonsgivenbytheBuilderforsuchextension,andtogranttherequestifconsideredreasonableinthecircumstancesoftheconstructionoftheWorks.

3.6.Maintenanceperiod

TheBuilderisexpectedtomakerightanydefectsfoundintheWorksforaperiodofuptosixmonthsafterthecompletionoftheWorksandthegrantingofaCertificateofOccupancybytheBoard.

3.7.RelationsbetweentheBuilderandtheOwner

3.7.1TheBuildershallcarryouttheWorksinaccordancewiththedrawingsandspecificationsandinaccordancewithanyreasonableinstructionsbytheOwnerorhis/herrepresentative.

3.7.2AssoonaspossibleafterthesigningofthecontractbetweentheOwnerandtheBuilder,theOwnershallinformtheBuilderthenameofhis/herauthorisedrepresentativewhowillrepresenttheOwnerfortheconstructionoftheWorks.

3.7.3AssoonaspossibleafterthesigningofthecontracttheBuildershallinformtheOwnerinwritingthenameofthepersonwhoshallbeauthorisedbytheBuildertorepresenttheBuilderfortheconstructionoftheWorks.

3.7.4TheOwnerandtheBuildershallinformeachotherinwritingwhenthereisachangeofthepersonsauthorisedtorepresentthemfortheconstructionoftheWorks.

3.7.5AllinstructionsfromtheOwnerorhis/herrepresentativeshallbegiventotheBuilderorhis/herrepresentativeinwriting.

3.8.Paymentschedule.

TheOwnershallpaytotheBuilderthefollowingpercentagesofthetotalcostofthecontractfortheWorksasagreeduponbetweentheBuilderandtheOwner.:

3.8.1Onthesigningofthecontractasumsufficienttobringthepaymentsuptonotmorethan5percentdependingontheagreedarrangementsbetweentheOwnerandtheBuilder

3.8.2Onthecompletionofthefoundationsasumsufficienttobringthepaymentsuptonotmorethanatotalof10percent

3.8.3Oncompletionofthewallsuptoandincludingtheringbeamsasumsufficienttobringthepaymentsuptonotmorethan20percent

3.8.4Oncompletionoftheroofsincludingtheroofsheetingandgutteringandtheinstallationofhurricaneclipsasumsufficienttobringthepaymentsuptonotmorethan30percent

3.8.5Uponcompletionoftheinteriorandexteriorplasteringandinstallationofdoorsandwindowframesnotincludingpaintingasumsufficienttobringthepaymentsuptonotmorethan40percent

3.8.6Uponcompletionoftheinteriorworkssuchas:

-theceiling,

-plumbingandplumbingfixtures,

-electricalwiring,

-allcarpentrycountertopsandcupboards,and

-tiling

asumsufficienttobringthepaymentsuptonotmorethan60percent

3.8.7Uponcompletionofconstructionofwatercisternortankwhererequired,theseptictankandsoakawayortilefield,permanentwatersupplyservicesandallotherplumbingrequirementsasumsufficienttobringthepaymentsuptonotmorethan70percent.

3.8.8UponcompletionofthecontractfortheWorksincluding:

-installationofdoorsandwindows

-allotherinteriorandexteriorfinishesincludingtiling

-paintinginteriorandexterior

-theapprovaloftheelectricalwiringandfittingsbytheelectr
