经甲乙双方友好协商，达成如下协议：
一、协议期限：
1.协议期限：

二、职能划分
1.甲方雇佣乙方为我英语培训机构英语外籍教师。
2.乙方需遵守甲方各项职能条款，认真备课。
乙方须为每节课准备教案及教学计划。
甲方会定期或不定期检查外教上课准备情况。
三、工作时间
1.乙方一周工作5天，2天休息日。
一周上课时间为25小时。
办公时间为5小时（其中包括学员口试、准备教案及和教学相关的事宜）。
每节课不超过50分钟。
乙方有义务参加甲方安排的户外活动及户外代课行为。
2.若乙方一周没有完成其上课时间，则会在其后的工作日内补上相应的上课小时数，包括取消课程，学员未到课程，学员一周前取消的课程。
课程为少儿课程和成人课程。
四、工资及福利
每月工资总额为：
元，其中包括如下项目：
1.乙方每月基本工资为元。
2.甲方每月10号支付乙方上月工资。
3.甲方每月支付乙方元交通补助，以帮助乙方按时完成上课。
4.甲方每月支付乙方元电话补助。
若乙方使用公司电话来打私人电话，则扣除电话补助。
5.甲方每月支付乙方元作为医疗补助。
6.乙方每月可得到元全勤奖励，其中包括：
不迟到、不早退、不请假。
若乙方出现迟到、早退、提前下课行为，则每次扣除元。
若旷到整节课，则扣除元。
若乙方迟到或提前下课15分钟以上且并未在24小时前通知甲方者，则按旷到一整节课情况处理。
乙方若生病或遇紧急事情需请假者，则须提前通知甲方。
7.乙方每工作一个整月，则每月可享受元飞机补助。
8.乙方病假、事假以及法定节假日期间都无补助工资。
9.若乙方病假超过30天，则视为自动解除劳动合同关系。
五、乙方义务：
1.乙方须遵守《中华人民共和国法律》。
2.乙方须遵守甲方《员工守则》及规章制度，遵守培训中心指南。
3.乙方若出现犯罪、入狱等行为，则该合同自行解除。
4.乙方有义务积极参加甲方安排各种商业及非商业活动及户外代课行为。
5.乙方须提供个人照片作为甲方安排相应广告宣传。
6.乙方不得传播宗教或和政治有关的演讲，以及宣传非法宗教信仰等活动。
乙方不得在课堂上以任何行为宣扬非法宗教信仰及和政治有关的内容。
7.乙方不得使用任何形式的体罚对学生进行惩罚或对学生和同事进行言语上的侮辱和歧视。
8.乙方不得在本中心以外的学校担任任何形式的兼职外教、家教，若发生此种行为，甲方则有权扣除乙方自此行为开始时的工资。
9.乙方不得将此合同及私人电话号码以QQ、MSN或邮件等形式告知给学生，若给学校带来任何损失，则乙方承担全部责任。
10.乙方须帮助中方老师及其他中方员工提高英语水平。
11.乙方不得穿着奇装异服、拖鞋等进入课堂。
12.乙方应该对此合同的内容保密，不得将合同内容告之第三方。
六、甲方职责
1.甲方将乙方介绍给学校所有员工。
2.甲方须协助乙方教学活动，帮助其处理学员投诉。
3.甲方提供乙方相应工作条件。
4.甲方提供合作者。
5.甲方每月按时支付乙方工资
七、合同终止
1.如遇以下情形，合同自动终止
A乙方违背甲方职责范围。
B乙方破坏劳动纪律。
C甲方将会将乙方在校表现评估考虑在内，如果乙方持续两个月内排名表现评估最后一位，甲方将依据评估结果解除此合同。
2.试用期之后，甲方如对乙方表现不满意，应给予乙方提前两个月的通知，否则甲方应给予乙方元的未提前告知终止合同罚金。
如果乙方需要解除合同，乙方需提前两个月给予甲方书面通知并从甲方处得到许可，甲方也可通过同样程序进行合同终止。
否则，乙方给予甲方元人民币作为未提前告知终止合同罚金，在乙方未经允许就终止合同的情况下，甲方将扣除其他所有补贴。
八、违背本合同应承担的责任
乙方应承担乙方对甲方造成的经济损失，甲方依据违反者的责任决定实际的赔偿责任和经济损失。
九、甲乙双方应通过协商解决争端。
十、其他
本合同一式两份，每份具有同等法律效应，甲乙双方各执一份，合同自签字盖章之日起生效。

1.PartyAwillarrangethetimeforstartandendofwork.Theteachinghourwillbe25perweek.Eachclassisnotmorethan50minutes.PartyBalsohastheresponsibilitytogoforoutdooractivitiesandclassesarrangedbyPartyA.Notmorethan5classeswillbegiveneachday.
2.IfPartyBdoesnotmakethefullteachinghoursperweek，theleftteachinghourswillbeaddedinthefutureworkingdays，includingthecancelledclasses，noshowingclassandnobookingclassesfromstudentsofthepreviousweeks.Theclassesareadultsclassandkidsclass.
3.PartyBgetswinterholidayaswellassummerholidaytotallyfor.TheexacttimewillbereachedbyBothParty.
No.4Salaryandwelfare.
Thesalaryforonemonthincludingtheotheritemswillbe4400，thesalaryincludesthefollowingitems:
1.AccordingtoPartyAcurrentsalarysystem，PartyB’ssalarywillbeRMB/month.
2.PartyApayssalaryatthe10thofeverymonth.Onthe10thofeverymonth，PartyBwillgetthesalaryoflastmonth.
3.PartyAwillpayPartyBRMB/monthastransportationallowanceinordertoguaranteePartyB’stimelyarrival.
4.PartyAwillpayPartyBRMB/monthascommunicationallowance.IfPartyBfailstoanswerthephonecallfromschool，thisallowancewillbecut.
5.PartyAwillpayPartyBRMB/monthasmedicaltreatmentallowance.
6.IncasePartyBislateforwork/classorleaveswork/classearly，he/shepaysafineofRMB.WhilemissingoneperiodofclasswillbefinedRMBifPartyBdoesn'tinformPartyAatleast24hoursinadvanced，lateforclassorleavetheclassearlywithin15minutesisequaltomissthewholeclass.PartyBmustinformPartyAincaseofsicknesslatenessoremergency.

RMBallowancewhenthisoneyearcontractexpires.
8.IfPartyBaskforholidaysorduringthelegalfestivals，PartyBwillgetnosalary.
9.IfPartyBaskforsickholidaysmorethan30days，itmeansPartyBwilldismissthecontract.

1.PartyBshouldobeyThePeople’sRepublicofChinaConstitution
2.PartyBshouldcomplywithPartyA‘s<>rulesandregulation，obeyingcenter’sconfidentialrule.
3.IncasePartyBcommitsaseriouscrime，beingcondemnedorputintojail，thiscontractwillbediscontinuedautomatically.
4.PartyBmustfulfillthejobresponsibilitiesasstatedbyPartyAandguaranteethequalityandquantity，PartyBhasthedutytoparticipateinallthebusinessandnon-businessactivitiesandoutdooractivitiesorganizedbyPartyA.
5.PartyBshouldprovidepersonalphotographtoPartyAtodosomeadvertisementsonwebsitesconnectedwiththeschool.
6.PartyBshouldnotspreadtherumorsormakespeechesaboutpolitics，religionsoruseoffensivewordsetcinpublic.
7.PartyBmustnotuseanyformsofphysicalpunishmentorinsulttothestudentsorcolleaguesunderanycircumstances.
8.PartyBshouldnotdoparttimejob，lecturesandpersonaltutoringoutsidetrainingcenter.Ifthishappens，PartyAwilldeductPartyB’ssalarysincethemonthPartyBstarted.
9.PartyBshouldnotgivethecontactinformationtothestudentssuchasQQ，MSNE-mailortelephonenumber，ifcauseanylostexpensesoftheschool，PartyBshouldtakealltheresponsibilities.
10.PartyBshouldhelpChineseteachersandtheotherstafftoimprovetheirEnglishlevel.Certainhoursamonth，thefixedtimeshouldbeagreedonbybothsides.
11.PartyBshouldnotwearunderpantsorslippersorclotheswhichareindecent.

1.Ifoneofthefollowinghappens，PartyAcoulddismissthiscontractandgetPartyBfired.
aPartyBdisobeyPartyB'sObligations.
bPartyBbreaksthelabordisciplines.
cPartyAwilltakeforeignteachersevaluationintoconsiderationwhenPartyBisworkingintrainingcenter，ifPartyBcontinuesonthelastpositionfortwomonths，PartyAcoulddismissthisagreementbasedontheresultoftheevaluationtest.
