Introduction
1.ThiselectionguideoutlinestheproceduresinaccordancewiththeEducationOrdinance(theOrdinance)fortheelectionofparentmanagers.PleaserefertoAnnexIfortheprovisionsofelectionofparentmanagersintheOrdinance.TheIncorporatedManagementCommittee(IMC)isrequestedtopassthisguidetotherecognisedparent-teacherassociation(PTA)oftheschoolforreferenceinworkingoutanelectionmechanismforelectingparentmanagers.PTAsmayadaptthiselectionguidetosuittheirownneedsandprovideformattersrelatingtoparentmanagerelectioninthePTAconstitutions.
2.Sincetheimplementationofschool-basedmanagementinallpublicsectorschoolsin2000,theEducationBureauhaspromotedtheparticipationofkeystakeholdersinschoolmanagementanddecision-making.TheOrdinanceaimsatintroducinganopenandtransparentparticipatoryschoolgovernanceframeworkinschoolsbyincludingkeystakeholdersliketeachersandparentsintheIMC.TheOrdinanceprovidesthatthereshallbeatleastoneparentmanagerintheIMCandwheretheIMCconstitutionprovidesonlyoneparentmanager,analternateparentmanagershallalsobeprovided.Bothparentmanagerandalternateparentmanagershouldbeelectedinthesamemanner.
3.TheelectionofparentmanagersshouldbeconductedbythePTArecognisedbytheIMC.ForschoolswhichhavenoPTA,theyshouldestablishoneasearlyaspossible.ThePTAconstitutionshouldprovidefortheelectionproceduresofparentmanager(s)andtoensurethatthemechanismisfairandtransparent.Detailedarrangementsoftheelectionshouldbemadeknowntoallparents.ThePTAmayamenditsconstitutionwherenecessaryinorderthatitfulfilstheconditionsforrecognitionbytheIMCandhenceisresponsiblefornominatingparentmanager(s).Allparentsshouldbeconsultedonsuchchangesandanysubsequentamendmentstotheelectionmechanismshouldbeproperlydocumented.
TheCandidature
4.Allparentsofcurrentpupilsoftheschoolareeligibletobecomecandidates.Parentsinrelationtoapupilincludesaguardianofthepupilandapersonwhoisnottheparentorguardianofthepupilbuthastheactualcustodyofthepupil.
5.Aparentshouldnotbenominatedintheeventofthefollowingsituations—
(i)He/sheisaservingteacheroftheschool(becauseteacherscanjointheIMCinthecapacityofteachermanagers);or
(ii)He/shedoesnotmeettheregistrationrequirementsofmanagerssetoutinsection30oftheOrdinance.
6.AsstipulatedintheOrdinance,nomanagershallserveinanIMCinmorethanonecapacity.Thus,noonecanserveasaparentmanagerandanalumnimanageratthesametime.Iftherearetwoelectionsunderdifferentcategoriestobeconductedconcurrentlyinaschool,nocandidateshallparticipateinmorethanoneelection.
Number&Tenure
7.TheIMCshouldspecifythenumberandtenureofofficeofparentmanager(s)andanalternateparentmanager(ifapplicable)initsconstitution.Generally,thetermofofficeofaparentmanagerisrecommendedtocomeintoeffecton1Septemberandterminateon31August.SincethePTAmaynotbeabletoconducttheelectionofparentmanagersbefore1September,itisrecommendedthattheelectionshouldbeconductedwithintheperiodfromSeptembertoNovember.ThePTAshouldthennominatetotheIMCtheparentelectedforregistrationasaparentmanager.Otherwise,inaccordancewithsection40AUoftheOrdinance,ifthepostofparentmanagerisvacantformorethanthreemonths,theIMCshouldapplytothePermanentSecretaryforfurtherextensionoftheperiodforfillingthevacancy.

8.ThePTAmayassignaReturningOfficertomonitorthenominationsandsupervisetheissueofballotpapersandcountingofvotes.TheReturningOfficermaybeelectedamongsttheoffice-bearersofthePTAorateacherappointedbytheschool,buthe/shemustnotbeacandidatefortheparentmanagerelection.
PeriodofNomination
9.ThePTAshouldspecifyinitsconstitutiontheperiodofnominationfortheparentmanagerelection.
Nomination
10.TheReturningOfficermayissuealetterinformingallparentsofthenumberofparentmanagervacancies,theperiodofnomination,methodofnomination,dateofvoting,dateofcountingsession,dateofannouncementofresultsandotherrelevantinformation.Anominationformshallbeenclosed.Atthesametime,thelettershouldoutlinetheeligibility(paragraphs4to6above)andresponsibilitiesofcandidates.Aparentmaynominateoneselforanothereligiblecandidatetostandfortheelection.ThePTAmayspecifyinitsconstitutionthemaximumnumberofnomineesthateachparentcannominate,andconsiderwhetheritisnecessarytoestablishamechanismforsupportingthemotion.Ifsuchamechanismistobeestablished,theconstitutionshouldsetoutdetailedarrangements,suchassecondersmustbeparentsofcurrentpupilsandthenumberofsecondersrequired.Allrequirementsmustbereasonableinordertoensurethatthemechanismisfair.
11.Ifnooneisnominated,thePTAmayconsiderextendingthedeadlineofnominationorconductingtheelectionagainafteralapseofsometime.Theelectionproceduresshouldcaterforsuchoccasionsandspecialarrangementsshouldbemadebasedontheprinciplesoffairness,opennessandsimplicity.
Candidates’Information
12.Eachnominatedcandidateshouldsupplyabriefstatementofhis/herpersonalinformationtotheReturningOfficerwithinthenumberofwordsasrequiredbythePTA.
13.Notlessthan7daysbeforetheelectionday,theReturningOfficershouldissueanotherlettertoallparentslistingthenamesofthecandidatesbeingnominated.Thebriefintroductorystatementsofthecandidatesincludingtheirdeclarationsshouldbeattached.ThePTAshouldguardagainsttheriskofincurringanylegalliabilityinpublishingthosestatements.Thelettershouldalsoexplaintheproceduresandthetime-tableoftheelection.Ifpossible,theReturningOfficercanarrangeameetingforthecandidatestointroducethemselvestoallparentsandanswerquestionsfromthem.
Electors’Eligibility
14.Allparentsofcurrentpupilsoftheschoolareeligibletovote.Ateacheroftheschoolwhoistheparentofacurrentpupiloftheschoolalsohastherighttovote.Everyeligibleelectorhasequalvotingright.Everyparentshouldvoteindividuallyandshouldhaveonlyonevoteirrespectiveofthenumberofchildrentheparenthasattheschool.Forsimplicitysake,thePTAmaygivepupilstwovoteseachfortheirparentstovote.Onrequest,aballotpapermaybegiventotheguardianofthepupilorthepersonwhohastheactualcustodyofthepupil.
ElectionProcedures
DateofVoting
15.Theperiodbetweenthedateofvotingforparentmanagerelectionandthedeadlineofnominationshouldatleastbetwoweeks.
Votingmethod
16.Toensureafairelection,thevotingshouldbeconductedbysecretballot,i.e.electorsarenotallowedtoputdowntheirnamesoranyothermarksofidentificationontheballotpaperandshouldnotlettheotherelectorsseewhomtheyhavevotedfor.AsampleoftheballotpaperisatAnnexII.
17.Aballotboxshallbemadeavailablefortheelection.ItshouldbelockedandthekeyshouldbekeptbytheReturningOfficer.TheReturningOfficercanspecifyintheelectionprocedureswhichvotingmethodstheparentsmayadopt.Ifparentsarerequestedtovoteinpersonintheschool,theReturningOfficershouldinformallparentsinadvanceofsucharrangementsandspecifyclearlythedate,timeandvenueofthevoting.Ifparentsareallowedtoasktheirchildrentoreturntheirballotpaperstotheclassteachers,theballotpapersshouldbesealedinenvelopesspecificallydesignedforthatpurposebeforeplacingthemintotheballotbox.Blankballotpapersshouldalsobereturnedtotheschool.TheReturningOfficermayalsospecifyintheelectionproceduresanyothermeansofreturningtheballotpapers,suchasbypostorinperson.Theschoolshouldrecorddownthoseparentswhohavesubmittedtheballotpapersandthenarrangetoputtheballotpapersintheballotbox.
Countingofvotes
18.TheReturningOfficershouldarrangeacountingsessionandinviteallparents,allcandidates,and/ortheprincipaltoattendandwitnessthecountingofvotes.
19.ThechairpersonofPTA,theReturningOfficerand/ortheprincipaloftheschoolshouldparticipatetowitnessthecounting.Duringthecountingsession,theReturningOfficermustmakesurethatallballotpapershavebeenpouredoutfromtheballotboxbeforecountingstarts.Aballotpaperwillbedeemedtobeinvalidif—
(i)thenumberofcandidatesmarkedontheballotpaperexceedsthenumberthatisallowed;
(ii)theballotpaperhasnotbeenmarkedproperly;or
(iii)theballotpaperismarkedinsuchawaythattheidentityoftheelectorcanbetraced.
20.Ifthereisonlyoneparentmanagervacancy,theonewhoobtainsthegreatestnumberofvoteswillbenominatedforregistrationastheparentmanagerwhereastheonewhoobtainsthenextgreatestnumberofvoteswillbenominatedforregistrationasthealternateparentmanager.Iftherearemorethanonevacancy,thesuccessfulcandidatesaretheoneswhoobtainthegreatestnumberofvotes,thenthenextgreatestandsoonuntilallvacanciesarefilled.AnarrangementshouldbespecifiedinadvanceinthePTAconstitutiontodeterminewhoshallbeelectedwhentwoormorecandidatesobtainthesamenumberofvotes,suchasconductingasecondroundof
