InaccordancewiththeamendmenttotheprovisionsofsomelocallawsandregulationsoftheGuizhouProvince,thefollowingregulationsshallbeamendedasfollows:

ChapterIGeneralProvisions

Thefirstistostrengthentherivermanagement,guaranteethesafetyoffloodcontrol,preventwaterpollution,therationaldevelopmentandutilizationofrivers,givefullplaytothecomprehensivebenefitsofriversandlakes,accordingtothe"People'sRepublicofChinawaterlaw","People'sRepublicofChinafloodpreventionlaw"andrelevantlawsandregulations,combinedwiththeactualsituationofthisprovince,theenactmentofthisordinance.

SecondtheseRegulationsshallapplytotheadministrativeareaoftheprovince（includingreservoirs,lakes,rivers,waterwaysandfloodcanalinKarstRiver）.

Thewaterwaywithintherivershallbegovernedbytheregulationsofthepeople'sRepublicofChinaontheadministrationofairlanes.

Third,thedevelopmentandutilizationofriverregulation,shouldbesubjecttotheoverallplanningofriverbasincomprehensiveplanningandfloodcontrol,andthecombinationofpesticideshennessy.Overallplanning,overallplanning,comprehensiveutilization,emphasisonefficiency,andpromotethedevelopmentofvariousundertakings.

Fourthdepartmentsofwateradministrationunderthepeople'sgovernmentsatorabovethecountylevel（hereinafterreferredtoastheadministrativedepartmentsforwateradministration）arethecompetentdepartmentsofriverswithintheirrespectiveadministrativeareas.

Relevantdepartmentsshall,inaccordancewiththedivisionoffunctionsandresponsibilities,assistinthemanagementofrivercourses.

Themanagementofthefifthriversshallbeconductedinaccordancewiththeprincipleofunifiedmanagementofwatersystemandhierarchicalmanagement.

（a）theYangtzeRiverinWujiang,three,sixredriver,QingshuiRiverRiver,ChishuiRiver,FurongRiver,riverwater,dance（withsounddance）YangRiver;thePearlRiverBasin,YellowRiver,NorthPanjiang,Li（soundwithMongolia）,NanpanjiangRiver,theRedRiver,riverriver,managementbytheprovincialadministrativedepartmentofimplementation;

（two）therivercoursesacrosstheadministrativeareasshallbeadministeredbytheirrespectiveadministrativedepartmentsatthenexthigherlevel;

（three）thisparagraph（a）,（two）outsidetheriver,managementbythecompetentdepartmentofwateradministrationatthecountylevel.

Thewateradministrativedepartmentatahigherlevelmayauthorizeorentrustthelowerwateradministrativedepartmenttomanagetherivercourse.

SixthRiverfloodcontrolandrepairworktoimplementthepeople'sgovernmentsatalllevelsresponsibleforthesystem.

Seventhunitsandindividualswhohavemadeoutstandingachievementsintheregulation,construction,protectionandmanagementofrivers,shallbecommendedandrewardedbythepeople'sgovernmentsatorabovethecountylevelorbytheadministrativedepartmentsofwateradministration.

Alllevelsofthewateradministrativedepartmentandcensorialpersonnelmustperformtheirdutiesaccordingtolaw,acceptsocialsupervision.

Thesecondchapterisregulationandconstruction

Eighthwateradministrativedepartmentsatalllevelsshall,inconjunctionwiththerelevantdepartments,accordingtotherequirementsofriverbasincomprehensiveplanningandnationalstandardsforfloodcontrolandnavigationandotherrelatedtechnology,preparationofriverregulationandconstructionplan,approvedbythepeople'sgovernmentatthesamelevel,andreportonthelevelofwateradministrativedepartmentsandrelevantdepartmentsfortherecord.

Renovationandutilizationofriverandrivermanagementinconstruction,shallbesubjecttotheriverremediationplanning,maintenanceofleveesafety,maintainthestabilityofriverflood,shippingandsmooth.

Thedevelopment,utilization,protectionandconstructionofthecoastlineoftheninthriversandbeachesshallbesubjecttotheriverchannelregulationplan,theoveralllanduseplanningandtheurbanconstructionplanning.Theriversectionsthatrunthroughtownsandlargeandmedium-sizedfactoriesandminesshall,inaccordancewiththejurisdictionoftherivermanagement,bepreparedbytheadministrativedepartmentsofwaterinconjunctionwiththedepartmentsconcerned,andshallbeimplementedaftertheapprovalofthepeople'sgovernmentsatthecorrespondinglevels.

Intenthadministrativeregionsacrosstheriver,riverrivertobuilddrainage,waterblocking,waterdiversion,waterstorage,waterengineeringandriverregulationproject,thepartiesconcernedshallsolicitopinions,andapprovedbythewateradministrationdepartmentforexamination.

Elevenththeconstructionofthewaterconservancydevelopment,preventionandcontrolofwaterdisasters,riverregulationengineeringandallkindsofriverandwearRiver,embankment,riverbridge,docks,roads,ferries,pipelines,cablesandotherbuildingsandfacilities,theconstructionunitsinthepreparationofprojectdocuments,accordingtotherivermanagementauthoritywillbesubmittedtotheconstructionschemeofwateradministrativedepartmentforexaminationagree,canaccordingtothebasicconstructionproceduresofexaminationandapprovalprocedures.

Whenaconstructionprojectisarrangedforconstruction,itshallbecarriedoutinaccordancewiththeapproveddesignorplan.Duringtheconstructionperiod,theadministrativedepartmentofwatershallcheckwhetheritconformstotheriverregulationplan.

Thewaterconservancyadministrativedepartmentshalltakepartinthecompletionacceptanceoftheconstructionproject,andtheconstructionunitshallsubmittherelevantdocumentsandmaterialstothewateradministrativedepartment30daysbeforetheacceptance.

Thetwelfthwateradministrativedepartmentsshall,within30daysfromthedateofreceiptoftheapplicationfortheconstructionprojectoftheconstructionunit,notifytheapplicantinwritingoftheapplication.

Theconstructionunithasobjectionstotheexaminationopinions,atthedateofthereceiptofthenoticewithin15daysonthelevelofwateradministrativedepartmentssubmitanapplicationforreview,reviewbytheDepartmentinconjunctionwiththecompetentdepartmentofplanninginaccordancewiththeregulations.

Thirteenthbridges,docksandwateranddrainagefacilities,mustbecarriedoutinaccordancewiththerequirementsoftheprovisionsofthenationalfloodcontrolstandard,shorelineplanningandothertechnologies,notnarrowchannelflood.

ThebeambottomofbridgesandZhanqiaomustbehigherthanthedesignedfloodwaterlevel,andkeepacertainheightaccordingtotherequirementsoffloodcontrolandshipping.

Theclearanceheightofpipelinesandlinesacrosstherivermustmeettherequirementsoffloodcontrolandnavigation.

Thethirdchapterprotectionandrepair

Thescopeofthemanagementofthefourteenthriversshallbedeterminedinaccordancewiththefollowingprinciples:

（a）withtheembankmentoftheriveronbothsidesoftheembankmentbetweenthewaters,sandbanks,beaches（includingarableland）,andriverdyke;

（two）theriverwithoutdikesshallbedeterminedaccordingtothedesignedfloodlevelorthehighestfloodlevelinhistory;

（three）withinaweek,theboundarywatersoflakebeach,accesschannelandkarstriveratthehighestfloodlevelisdetermined;

（four）thereservoirisdeterminedaccordingtothecheckfloodlevel.

Delineationofthespecificmanagementoftheriver,bythewateradministrativedepartmentatorabovethecountylevelinconjunctionwiththerelevantdepartments,approvedbythepeople'sgovernmentatthesamelevel,andpileandbound.

Articlefifteenththefollowingactivitiesareprohibitedwithinthescopeofrivermanagement:

（a）theconstructionoffloodandblockingkarstRiverandfloodchannelofbuildingsandstructures;

（two）plantingwaterresistanceoftallplants（exceptembankmentshelterbelt）;

（three）settheriverfishinganddebrisdisposalofslag,slag,ash,mudandgarbageetc.;

（four）removalorriverembankments,damsandotherwaterengineeringrevetment,andallkindsofmeasurement,monitoringandotherancillaryfacilities;

（five）indamanddikesafetyprotectionareaofwells,drilling,blasting,digging,quarrying,earthandotherbuildingpondssafetyhazardactivities;

（six）onbothsidesoftheriverandlandslides,collapse,landslidesandothernaturaldisastersarealotofdeforestation,reclamation,quarrying,soil,miningandotheractivitiesendangeringtheslopestability;

（seven）divertedrivers.

Sixteenththefollowingactivitiesintheareaofrivermanagement,shallbeapprovedbytheDepartmentofwateradministration,shallgothroughtherelevantformalities:

（a）mining,mining,quarrying,earth,gold;

（two）blasting,drilling,reclamation,digponds,builtroads,canals,wells;

（three）storagematerialssuchaswood,intheriverbeachtobuildfactoriesorotherbui
