《伦敦保险协会货物保险条款》

（１９８２年１月１日修订）

（一）伦敦保险协会货物条款（Ａ）

（仅供新的海上保险单格式使用）

承保范围

风险条款

１．本保险承保除下列４、５、６、７各条规定除外责任以外的一切风险所造成保险标的的损失。

  1.Thisinsurancecoversallrisksoflossofordamagetothesubject-matterinsuredexceptasprovidedinClauses456and7below

共同海损条款

２．本保险承保共同海损和救助费用，其理算或确定应根据运输契约和／或有关法律和惯例办理。

该项共同海损和救助费用的产生，应为避免任何原因所造成的或与之有关的损失所引起的，但下列４、５、６、７各条或本保险其他条款规定的不保责任除外。

 2.Thisinsurancecoversgeneralaverageandsalvagechargesadjustedordeterminedaccordingtothecontractofaffreightmentand/orthegoverninglawandpracticeincurredtoavoidorinconnectionwiththeavoidanceoflossfromanycauseexceptthoseexcludedinClauses456and7orelsewhereinthisinsurance.

    （“BothtoBlameCollision”Clause）

船舶互撞责任条款

３．本保险负责赔偿被保险人根据运输契约订有“船舶互撞责任”条款规定，由被保险人应负的比例责任，视作本保险单项下应予补偿的损失。

如果船东根据上述条款提出任何索赔要求，被保险人同意通知保险人，保险人有权自负费用为被保险人就此项索赔进行辩护。

 3.ThisinsuranceisextendedtoindemnifytheAssuredagainstsuchproportionofliabilityunderthecontractofaffreightment“BothtoBlameCollision”Clauseasisinrespectofalossrecoverablehereunder.IntheeventofanyclaimbyshipownersunderthesaidClausetheAssuredagreetonotifytheUnderwriterswhoshallhavetherightattheirowncostexpensetodefendtheAssuredagainstsuchclaim.

一般除外责任条款

    EXCLUSIONS

４．本保险在任何情况下不负赔偿的责任：

   4.Innocaseshallthisinsurancecover

４．１被保险人故意行为所造成的损失和费用；

４．２保险标的的自然渗漏，重量或容量的自然损耗，或自然磨损；

４．３由于保险标的包装或准备不足或不当造成的损失或费用（本条所称的“包装”，包括用集装箱或大型海运箱装载的，但该项装载以本保险开始生效前或由被保险人或其受雇人完成的为限）；

    lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsured（forthepurposeofthisClause“packing”shallbedeemedtoincludestowageinacontainerorliftvanbutonlywhensuchstowageiscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheirservants）

４．４由于保险标的本质缺陷或特性造成的损失和费用；

  Lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured

４．５直接由延迟引起的损失或费用，即使延迟是由承保风险所引起（上述第２条可以赔付的费用除外）；

   lossdamageorexpenseproximatelycausedbydelayeventhoughthedelaybecausedbyariskinsuredagainst（exceptexpensespayableunderClause2above）

４．６由于船舶所有人、经理人、租船人或经营人破产或不履行债务造成的损失或费用；

   Lossdamageorexpensearisingfrominsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperatorsofthevessel

４．７由于使用任何原子或核子裂变和（或）聚变或其他类似反应或放射性作用或放射性物质的战争武器造成的损失或费用。

  Lossdamageorexpensearisingfromtheuseofanyweaponofwaremployingatomicornuclearfissionand/orotherlikereactionorradioactiveforceormatter.

不适航和不适宜除外责任条款

   （UnseaworthinessandUnfitnessExclusionClause）

５．５．１本保险在任何情况下不负下列原因引起的损失和费用。

 5Innocaseshallthisinsurancecoverlossdamageorexpensearisingfrom

    unseaworthinessofvesselorcraft.

船舶或驳船不适航；

  Unfitnessofvesselcraftconveyancecontainerorliftvanforthesafecarriageofthesubject-matterinsured.

船舶、运输工具、集装箱或大型海运箱不适宜安全运载保险标的。

如果保险标的在装载时，被保险人或其受雇人知道这种不适航和不适当的情况。

  wheretheAssuredortheirservantsareprivytosuchunseaworthinessorunfitnessatthetimethesubject-matterinsuredisloadedtherein.

５．２保险人放弃船舶必须适航和适宜将保险标的运往目的地的默示担保，除非被保险人或其受雇人知道这种不适航或不适宜的情况。

 TheUnderwriterswaiveanybreachoftheimpliedwarrantiesofseaworthinessoftheshipandfitnessoftheshiptocarrythesubject-matterinsuredtodestinationunlesstheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness.

战争除外责任条款（WarExclusionClause）

６．本保险在任何情况下不负下列原因造成的损失和费用：

  6Innocaseshallthisinsurancecoverlossdamageorexpensecausedby

６．１战争、内战、革命、叛乱、造反或由引引起的内乱，或交战国或针对交战国的任何敌对行为；

 warcivilwarrevolutionrebellioninsurrectionorcivilstrifearisingtherefromoranyhostileactbyoragainstabelligerentpower

６．２捕获、拘留、扣留、禁制、扣押（海盗行为除外）以及这种行动的后果或这方面的企图；

   captureseizurearrestrestraintordetainment（piracyexcepted）andtheconsequencesthereoforanyattemptthereat.

６．３遗弃的水雷、鱼雷、炸弹或其他遗弃的战争武器。

  Derelictminestorpedoesbombsorotherderelictweaponsofwar.

罢工除外责任条款（StrikesExclusionClause）

７．本保险在任何情况下不保下列原因造成的损失和费用：

  7Innocaseshallthisinsurancecoverlossdamageorexpense

７．１罢工者、被迫停工工人或参与工潮、暴动或民变人员；

   causedbystrikerslocked-outworkmenorpersonstakingpartinlabourdisturbancesriotsorcivilcommotions

７．２罢工、被迫停工、工潮、暴动或民变；

  resultingfromstrikeslock-outslabourdisturbancesriotsorcivilcommotions

７．３任何恐怖主义者或者任何人出于政治目的采取的行动。

期限  causedbyanyterroristoranypersonactingfromapoliticalmotive.

运输条款（TransitClause）

８．８．１本保险责任自货物运离保险单所载明的启运地仓库或储存处所开始运输时起生效，包括正常运输过程，直至运到下述地点时终止。

  8Thisinsuranceattachesfromthetimethegoodsleavethewarehouseorplaceofstorageattheplacenamedhereinforthecommencementofthetransitcontinuesduringtheordinarycourseoftransitandterminateseither

８．１．１保险单所载明的目的地收货人或其他最后仓库或储存处所；

  8.1.1OndeliverytotheConsignees’orotherfinalwarehouseorplaceofstorageatthedestinationnamedherein

８．１．２在保险单所载明目的地之前或目的地的任何其他仓库或储存处所，由被保险人择选用作：

  8.1.2OndeliverytoanyotherwarehouseorplaceofstoragewhetherpriortooratthedestinationnamedhereinwhichtheAssuredelecttouseeither

８．１．２．１在正常运输过程之外储存货物，或者：

    8.1.2.1Forstorageotherthanintheordinarycourseoftransitor

８．１．２．２分配或分派货物，或者：

  8.1.2.2forallocationordistribution.

８．１．３被保险货物在最后卸载港全部卸离海轮后满６０天为止。

 8.1.3Ontheexpiryof60daysaftercompletionofdischargeoversideofthegoodsherebyinsuredfromtheoverseavesselatthefinalportofdischarge.

以上各项以先发生者为准。

８．２如货物在本保险责任终止前于最后卸载港卸离海轮，需转运到非保险单载明的其他目的地时，保险责任仍按上述规定终止，但以该项货物开始转运时终止。

  Ifafterdischargeoversidefromtheoverseavesselatthefinalportofdischargebutpriortoterminationofthisinsurancethegoodsaretobeforwardedtodestinationotherthanthattowhichtheyareinsuredhereunderthisinsurancewhilstremainingsubjecttoterminationasprovidedforaboveshallnotextendbeyondthecommencementoftransittosuchotherdestination.

８．３在被保险人无法控制的运输延迟、任何绕道、被迫卸货、重行装载、转运以及船东或租船人运用运输契约赋予的权限所作的任何航海上的变更的情况下，本保险仍继续有效（仍需按照上述有关保险终止期限和下述第９条的规定办理）。

 Thisinsuranceshallremaininforce（subjecttoterminationasprovidedforaboveandtotheprovisionsofClause9below）duringdelaybeyondthecontroloftheAssuredanydeviationforceddischargereshipmentortransshipmentandduringanyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtoshipownersorcharterersunderthecontractofaffreightment.

运输契约终止条款 （TerminationofContractofCarriageClause）

９．如由于被保险人无法控制的情况，致使运输契约在非保险单载明的目的地的港口或处所终止，或者运输在按上述第８条规定发货前终止，本保险亦应终止，除非被保险人立即通知保险人并提出续保要求，并在必要时加缴保险费的情况下，本保险继续有效。

    9IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageisterminatedataportorplaceotherthanthedestinationnamedthereinorthetransitisotherwiseterminatedbeforedeliveryofthegoodsasprovidedforinClause8abovethenthisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheUnderwritersandcontinuationofcoverisrequestedwhentheinsuranceshallremaininforcesubjecttoanadditionalpremiumifrequiredbytheUnderwriterseither

９．１直至货物在该港口或处所出售和交货，或除非有特别约定，在被保险货物抵达该港口或处所后，满６０天为止，以先发生者为准，或：

  Untilthegoodsaresoldanddeliveredatsuchportorplaceorunlessotherwisespeciallyagreeduntiltheexpiryof60daysafterarrivalofthegoodsherebyinsuredatsuchportorplacewhichevershallfirstoccur

９．２如果货物在上述６０天期限内（或任何约定的延长期限内），继续运往保险单所载明的目的地或任何其他目的地时，保险责任仍按上述第８条的规定终止。

  Ifthegoodsareforwardedwithinthesaidperiodof60days（oranyagreedextensionthereof）tothedestinationnamedhereinortoanyotherdestinationuntilterminatedinaccordancewithprovisionsofClause8above.

变更航程条款 （ChangeofVoyageClause）

１０．当本保险责任开始后，被保险人变更目的地，应立即通知保险人，经另行商定保险费和条件，本保险仍然有效。

10WhereafterattachmentofthisinsurancethedestinationischangedbytheAssuredheldcoveredatapremiumandonconditionstobearrangedsubjecttopromptnoticebeingtotheUnderwriters.

理赔    （InsurableInterestClause）

可保利益条款

   CLAIMS

１１．１１．１在发生损失时，被保险人必须对保险标的具有可保利益，才能获得本保险单项下的赔偿。

 11InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubject-matterinsuredatthetimeoftheloss.

１１．２被保险人有权按照上述（１）条的规定，对在本保险期限内发生的承保损失获得赔偿，即使损失发生在本保险契约之前。

但在缔约时被保险人已经知道损失发生，而保险人并不知晓者除外。

  SubjecttoabovetheAssuredshallbeentitledtorecoverforinsuredlossoccurringduringtheperiodcoverbythisinsurancenotwithstandingthatthelossoccurredbeforethecontractofinsurancewasconcludedunlesstheAssuredwereawareofthelossandtheUnderwriterswerenot.

续运费条款 （ForwardingChargeClause）

１２．由于本保险承保的风险，致使保险运输在非保险单载明的港口或处所终止，保险人应偿付被保险人在卸货、存仓和续运保险标的至保险单载明目的地适当而合理产生的任何额外费用。

   12Whereasaresultoftheoperationofariskcoveredbythisinsurancetheinsuredtransitisterminatedataportorplaceotherthanthattowhichthesubject-matteriscoveredunderthisinsurancetheUnderwriterswillreimbursetheAssuredforanyextrachargesproperlyandreasonablyincurredinunloadingstoringandforwardingthesubject-mattertothedestinationtowhichitisinsuredhereunder.

第１２条不适用于共同海损或救助费用，并须按照上述４、５、６、７各条所载除外责任的规定办理，还不包括由于被保险人或其受雇人的过失、疏忽、破产或不履行债务而引起的费用。

  ThisClause12whichdoesnotapplytogeneralaverageorsalvagechargesshallbesubjecttotheexclusionscontainedinClauses456and7aboveandshallnotincludechargesarisingfromthefaultnegligenceinsolvencyorfinancialdefaultoftheAssuredortheirservants.
