1、安监总局36号令安监总局36号令国家安全生产监督管理总局令 第36号 建设项目安全设施“三同时”监督管理暂行办法已经2010年11月3日国家安全生产监督管理总局局长办公会议审议通过，现予公布，自2011年2月1日起施行。 局长 骆琳 二?一?年十二月十四日 建设项目安全设施“三同时” 监督管理暂行办法 第一章 总则 第一条为加强建设项目安全管理，预防和减少生产安全事故，保障从业人员生命和财产安全，根据中华人民共和国安全生产法和国务院关于进一步加强企业安全生产工作的通知等法律、行政法规和规定，制定本办法。 第二条经县级以上人民政府及其有关主管部门依法审批、核准或者备案的生产经营单位新建、改建、扩

2、建工程项目(以下统称建设项目)安全设施的建设及其监督管理，适用本办法。 法律、行政法规及国务院对建设项目安全设施建设及其监督管理另有规定的，依照其规定。 第三条本办法所称的建设项目安全设施，是指生产经营单位在生产经营活动中用于预防生产安全事故的设备、设施、装置、构(建)筑物和其他技术措施的总称。 第四条生产经营单位是建设项目安全设施建设的责任主体。建设项目安全设施必须与主体工程同时设计、同时施工、同时投入生产和使用(以下简称“三同时”)。安全设施投资应当纳入建设项目概算。 第五条国家安全生产监督管理总局对全国建设项目安全设施“三同时”实施综合监督管理，并在国务院规定的职责范围内承担国务院及其有

8、范围内承担本级人民政府及其有关主管部门审批、核准或者备案的建设项目安全设施“三同时”的监督管理。 跨两个及两个以上行政区域的建设项目安全设施“三同时”由其共同的上一级人民政府安全生产监督管理部门实施监督管理。 上一级人民政府安全生产监督管理部门根据工作需要，可以将其负责监督管理的建设项目安全设施“三同时”工作委托下一级人民政府安全生产监督管理部门实施监督管理。 第六条安全生产监督管理部门应当加强建设项目安全设施建设的日常安全监管，落实有关行政许可及其监管责任，督促生产经营单位落实安全设施建设责任。 第二章 建设项目安全条件论证与安全预评价 第七条下列建设项目在进行可行性研究时，生产经营单位应当

9、分别对其安全生产条件进行论证和安全预评价: (一)非煤矿矿山建设项目; (二)生产、储存危险化学品(包括使用长输管道输送危险化学品，下同)的建设项目; (三)生产、储存烟花爆竹的建设项目; (四)化工、冶金、有色、建材、机械、轻工、纺织、烟草、商贸、军工、公路、水运、轨道交通、电力等行业的国家和省级重点建设项目; (五)法律、行政法规和国务院规定的其他建设项目。 第八条生产经营单位对本办法第七条规定的建设项目进行安全条件论证时，应当编制安全条件论证报告。安全条件论证报告应当包括下列内容: (一)建设项目内在的危险和有害因素及对安全生产的影响; (二)建设项目与周边设施(单位)生产、经营活动和居

(2) pipe through the basement wall 第九条生产经营单位应当委托具有相应资质的安全评价机构，对其建设项目进行安全预评价，并编制

15、安全预评价报告。 建设项目安全预评价报告应当符合国家标准或者行业标准的规定。 生产、储存危险化学品的建设项目安全预评价报告除符合本条第二款的规定外，还应当符合有关危险化学品建设项目的规定。 第十条本办法第七条规定以外的其他建设项目，生产经营单位应当对其安全生产条件和设施进行综合分析，形成书面报告，并按照本办法第五条的规定报安全生产监督管理部门备案。 第三章 建设项目安全设施设计审查 第十一条生产经营单位在建设项目初步设计时，应当委托有相应资质的设计单位对建设项目安全设施进行设计，编制安全专篇。 安全设施设计必须符合有关法律、法规、规章和国家标准或者行业标准、技术规范的规定，并尽可能采用先进适用

16、的工艺、技术和可靠的设备、设施。本办法第七条规定的建设项目安全设施设计还应当充分考虑建设项目安全预评价报告提出的安全对策措施。 安全设施设计单位、设计人应当对其编制的设计文件负责。 第十二条建设项目安全专篇应当包括下列内容: (一)设计依据; (二)建设项目概述; (三)建设项目涉及的危险、有害因素和危险、有害程度及周边环境安全分析; (四)建筑及场地布置; (五)重大危险源分析及检测监控; (六)安全设施设计采取的防范措施; (七)安全生产管理机构设置或者安全生产管理人员配备情况; (八)从业人员教育培训情况; beam and reinforced concrete floor. , Ha

22、 第十三条本办法第七条第(一)项、第(二)项、第(三)项规定的建设项目安全设施设计完成后，生产经营单位应当按照本办法第五条的规定向安全生产监督管理部门提出审查申请，并提交下列文件资料: (一)建设项目审批、核准或者备案的文件; (二)建设项目安全设施设计审查申请; (三)设计单位的设计资质证明文件; (四)建设项目初步设计报告及安全专篇; (五)建设项目安全预评价报告及相关文件资料; (六)法律、行政法规、规章规定的其他文件资料。 安全生产监督管理部门收到申请后，对属于本部门职责范围内的，应当及时进行审查，并在收到申请后5个工作日内作出受理或者不予受理的决定，书面告知申请人;对不属于本部门职责

23、范围内的，应当将有关文件资料转送有审查权的安全生产监督管理部门，并书面告知申请人。 本办法第七条第(四)项规定的建设项目安全设施设计完成后，生产经营单位应当按照本办法第五条的规定向安全生产监督管理部门备案，并提交下列文件资料: (一)建设项目审批、核准或者备案的文件; (二)建设项目初步设计报告及安全专篇; (三)建设项目安全预评价报告及相关文件资料。 beam and reinforced concrete floor. , Hanger location should be correct, install neat and firm, tubes and scaffolds should

(2) pipe through the basement wall 第十四条对已经受理的建设项目安全设施设计审查申请，安全生产监督管理部门应当自受理之日起20个工作日内作出是否批准的决定，并书面告知申请人。20个工作日内不能作出决定的，经本部门负责人批准，可以延长10个工作日，并应当将延长期限的理由书面告知申请人。 第十五条建设项目安全设施设计有下列情形之一的，不予批准，并不得开工建设: (一)无建设项目审批、核准或者备案文件的; (二)未委托具有相应资质的设计单位进行设计的; (三)安全预评价报告

29、由未取得相应资质的安全评价机构编制的; (四)未按照有关安全生产的法律、法规、规章和国家标准或者行业标准、技术规范的规定进行设计的; (五)未采纳安全预评价报告中的安全对策和建议，且未作充分论证说明的; (六)不符合法律、行政法规规定的其他条件的。 建设项目安全设施设计审查未予批准的，生产经营单位经过整改后可以向原审查部门申请再审。 第十六条已经批准的建设项目及其安全设施设计有下列情形之一的，生产经营单位应当报原批准部门审查同意;未经审查同意的，不得开工建设: (一)建设项目的规模、生产工艺、原料、设备发生重大变更的; (二)改变安全设施设计且可能降低安全性能的; (三)在施工期间重新设计的。

30、 第十七条本办法第七条规定以外的建设项目安全设施设计，由生产经营单位组织审查，形成书面报告，并按照本办法第五条的规定报安全生产监督管理部门备案。 第四章 建设项目安全设施施工和竣工验收 第十八条建设项目安全设施的施工应当由取得相应资质的施工单位进行，并与建设项目主体工程同时施工。 beam and reinforced concrete floor. , Hanger location should be correct, install neat and firm, tubes and scaffolds should be in very close touch.
