1、农村宅基地流转问题研究农村宅基地流转问题研究 摘要:宅基地是我国农村地区项重要的物权权益,其设立的初衷是为了保障农村地区的居民种基本的居留权,因此长期以来宅基地都是通过无偿审批的形式对农民进行安居保障。但随着我国经济社会的快速发展,城市化和城镇化的发展推进着我国经济触角向农村地区迅速伸进,原来的农村地区逐渐变成城市的部分,而且随着我国经济社会的快速发展,社会财富因为房地产和汽车经济的带动,我国的财富迅速向城市地区集中,我国的城市地区在经济发展和财政补贴的双重带动之下,城市居民的物质文化生活质量快速提升,而相比较农村地区,因为经济欠发达,农业产业发展以及农业经济总体增量提升不大,农民的收入水平和

2、城市居民相比较而言不是在减少而是逐步拉开差距,在这种情况下,尤其是房地产经济因为城市整体的供给总量不断减少而向市郊逐步发展,城市和农村相接壤的地方的土地价格在不断提升,作为农民手中唯一一块具有保值和增值前景的宅基地就成为市场经济体制内具有较大活力的资本要素之一,在这种背景之下,巨大的经济利益导致宅基地的乱占以及私下交易的现象盛行,而且产生了许多纷繁芜杂的纠纷和矛盾,并且为了搞活和私下放开农村地区的宅基地管理,各地都在体制和制度之内在不断的尝试和摸索,通过各种方式在对原来的宅基地管理模式进行挑战和调整,在这种情况下,在农村地区因为宅基地以及其背后所附带的经济利益的导致宅基地管理暗流汹涌。如果我们

3、从制度层面进行分析,我们就不难发现其实所有的这一切都是因为物权对于农村宅基地的管理处于真空状态,本文通过以重庆永川区陈食镇为例,研究我国目前在宅基地管理过程中存在的问题,尤其是宅基地管理中不适合农村地区生产力发展的管理体制和目前的农村经济发展存在的冲突,通过调研形式找出宅基地管理存在乱象之后的深层原因,并通过对目前促使宅基地使用权流转的外部因素进行分析的基础上,分析目前流转主体、流转客体以及流转机制进行研究,提出包括在严格保护耕地的原则之下,暂停目前的宅基地审批并进行及时清理,在对只有块宅基地的农民可进行重点保护的基础上,制定有利于保护农民的宅基地交易规范等符合我国现在农村管理特点的宅基地流转

4、策略,并且设计和宅基地流转模式相配套的相关制度,完善制度设计,加强政府引导,结合我国宅基地流转的完善宅基地登记制度,设计宅基地流转的制度框架,并且在实际实施过程中充分考虑宅基地转让以后的收益分配制度和宅基地优惠使用政策,通过加强宅基地的规范管理,构建宅基地有序流转的市场体系,包括宅基地的登记和发证工作,并且对宅基地进行物权登记之前开展全国性普查确定宅基地基数等配套制度,为我国宅基地管理和流转进行有益的探索。关键词:宅基地;流转;问题;模式;对策The main problems existing in the rural land circulation and countermeasures
