Introduction1.资金来源 1.Source of Funds1.1本招标文件第二册第六章投标资料表中所述的招标人已拥有一笔资金贷款。 The Tenderee named in the Volume II Section 6 Bid Data Sheet of the bidding documents has obtained a fund/loan. 招标人计划将

17、一部分资金贷款用于支付本次招标后所签订合同项下的款项。 The Tenderee intends to apply a portion of the proceeds of this fund/loan to the payments under the contract for which this Invitation for Bids is issued.2.招标机构及合格的投标人 2.Tendering Agent and Eligible Bidders2.1 招标机构 2.1 Tendering Agent 机电产品国际招标机构是指依照中华人民共和国商务部令2005年第6号机电产品

18、国际招标机构资格审定办法取得招标资格并从事机电产品国际招标代理业务的企业法人。 The Tendering Agent for ICB Procurement of Mechanic and Electronic Products (hereinafter referred to as Tendering Agent) means the Legal Person approved and authorized by the Ministry of Commerce to handle the procurement of mechanic and electronic products by

19、 way of International Competitive Bidding (ICB) in accordance with the Measures for Examining and Approving the Qualification of International Tendering Institutions for Electromechanical Products, Decree No.6, 2005 of the Ministry of Commerce of the Peoples Republic of China. 本次招标的招标机构名称、地址、电话和传真见投

20、标资料表。 Details such as name, address, telephone and facsimile of the Tendering Agent for this bidding are listed in the Bid Data Sheet.2.2 合格的投标人 2.2 Eligible Bidders1)投标人是响(不当用词)标、参加投标竞争的法人或其他组织。除非另有规定，凡是来自中华人民共和国或是与中华人民共和国有正常贸易往来的国家或地区(以下简称“合格来源国地区”)的供货人均可投标。 1) Bidders are legal persons or other o

21、rganizations who participate in bidding. This Invitation for Bids is open to all suppliers from within the Peoples Republic of China (hereinafter abb. as PRC) and all countries/areas which have regular trade relations with PRC (hereinafter called the eligible source countries/areas), except as provi

22、ded hereinafter. 2)投标人不得直接或间接地与招标人为采购本次招标的货物进行设计、编制规范和其他文件所委托的咨询公司或其附属机构有任何关联。 2) Bidders should not be associated, directly or indirectly, with a firm or any of its affiliates which have been engaged by the Tenderee to provide consulting services for the preparation of the design, specifications, a

23、nd other documents to be used for the procurement of the goods to be purchased under this Invitation for Bids.3)只有在法律上和财务上独立、合法运作并独立于招标人和招标机构的供货人才能参加投标。 3) The Suppliers may participate in the bids only if they are legally and financially autonomous, if they operate under relevant law, and if they a

24、re not a dependent agency of the Tendering Agent and the Tenderee.3.合格的货物和服务 3.Eligible Goods and Services3.1 合同中提供的所有货物及其有关服务的原产地，均应来自上述2.2条款规定的合格来源国地区。本合同的支付也仅限于这些货物和服务。 3.1 All goods and related services to be supplied under the contract shall have their origin in eligible source countries/areas,

25、 as defined in clause 2.2 above, and all expenditures made under the contract will be limited to such goods and services.3.2 本款所述的“原产地”是指货物开采、生长或生产或提供有关服务的来源地。所述的“货物”是指通过制造、加工或用重要的和主要的元部件装配而成的，其基本特征、功能或效用应是商业上公认的与元部件有着实质性区别的产品。 3.2 For purposes of this clause, origin means the place where the goods

26、are mined, grown or produced, or the place from which the related services are supplied. Goods are produced when, through manufacturing, processing, or substantial and major assembly of components, a commercially-recognized product results that is substantially different in basic characteristics or

27、in purpose or utility from its components.3.3 货物和服务的原产地有别于投标人的国籍。 3.3 The origin of goods and services is distinct from the nationality of the Bidder.4.投标费用 4.Cost of Bid4.1 投标人应承担所有与准备和参加投标有关的费用。不论投标的结果如何，投标资料表中所述的招标机构和招标人均无义务和责任承担这些费用。 4.1 The Bidder shall bear all costs associated with the prepar

28、ation and submission of its bid, and the Tendering Agent and the Tenderee, named in the Bid Data Sheet, will in no case be responsible or liable for those costs, regardless of the conduct or outcome of the bid process.二、招标文件 B.
