1、一、 HSE管理协议书HSE MANAGEMENT AGREEMENT为加强*工程服务的安全、环境与健康管理，明确甲乙双方当事人的权利和义务，根据中华人民共和国劳动法、中华人民共和国安全生产法中华人民共和国矿山安全法、中华人民共和国合同法、建设工程安全生产管理条例、中华人民共和国环境保护法、中华人民共和国职业病防治法等法律、法规及HSE相关的规定，结合CSPC实际情况，甲乙双方经平等协商，意见一致，自愿签订本合同，并共同遵守本协议所列条款。To enhance HSE management of * co.ltd.,define the right and obligation between

4、t of first side1.1 有权要求乙方建立健全HSE管理组织机构，严格执行HSE管理相关的法规、标准，遵守甲方的HSE管理的规章制度。Have right to require second contractor to build completed management organization, strictly execute HSE management statute, standard, and obey HSE management bylaw of first contractor.1.2 有权对乙方的HSE管理的业绩、资质、技术水平，特别是对安全保证条件进行审查，

5、对乙方针对作业项目制定的施工方案 (包含HSE章节)进行审查并备案。Have right to checkup achievement, aptitude, technical level of HSE management, especially to checkup the safety guarantee qualification, checkup and put on record for second contractor processing the construction scheme(include HSE part) of project.1.2.1. 审查内容包括：Ch

6、eckup contents include:a) 乙方营业执照、安全资格证书及经营范围应符合要求；Second contractors business license, safety qualification and management scope should accord with the requisitions.b) 乙方施工管理能力和队伍素质应满足工程安全需要；Construction management ability of second contractor and diathesis should satisfy the safety construction req

7、uirements.c) 乙方HSE管理机构健全，管理制度严谨、完善；Second contractors HSE management organization is sanity, and management rules are preciseness and completed.d) 乙方作业人员经过作业前的HSE教育培训，并建立考核、考试制度，存档备案。Personnel of second contractor need pass the HSE training before working, and build access, examination system, keep

8、in archives and put on records.1.2.2. 确认程序及办理入厂程序：Affirm procedure of site entry transaction a) 先由甲方审核施工资质，然后由甲方HSE管理部主管组织对乙方HSE资质进行审查。审查的主要内容包括：First contractor need to checkup the construction qualifications first, superintend of HSE management department organize checkup to second contractors qua

9、lification, include:承包商主要负责人、项目负责人和专职安全管理人员必须经过建设行政主管部门或其它有关部门考核合格后方可任职；After main principal of contractor, project principal and full-time safety management team must pass the construction admin. Head or other some related departments assess, they can hold a post.承包商安全负责人必须持有地方政府安全生产监督管理部门颁发的厂长（经理）

10、职业卫生管理资格证书或者安全主任资格证书；HSE principal of contractor must have manager professional sanitation management qualification certificateorsafety director qualification certificate that safety management department of local government award.b) 由甲方HSE管理部组织或指定单位对乙方人员进行入厂HSE教育培训。HSE management organization or de

12、service of contractor must take valid ic and other certificate to first contractor.1.3 甲方有权要求乙方维护好相关的甲方安全生产设施、设备和器材。First contractor has right to require second contractor to do the maintenance of safety production establishment and equipments of first contractor.1.4 甲方有权对乙方的施工作业现场的安全作业情况进行监督检查，乙方违章

13、指挥、违章作业、违反劳动纪律，甲方有权责令其停止作业，停止作业造成的损失由乙方承担。First contractor has right to supervise the site safety situation of second contractor, if second contractor violative command and work, offend labor discipline, first contractor has right to ask for stopping work, the losing expense is paid by second contra

14、ctor.1.5 发生事故后，甲方有权根据有关规定组织、参与事故调查，甲方有权对事故进行统计上报。After accidents haPPEns, first contractor has right to organize and join in the accident investigation according to some related regulation, first contractor has right to do statistic and report to leader.2. 甲方的义务First contractors obligation2.1 贯彻执行国家

15、和地方有关法律、法规和标准，贯彻执行CSPC有关安全、环境与健康管理的规章制度。Carry out central and local law, statute and standard thoroughly, and CSPC HSE management bylaw.2.2 向乙方明确施工作业区的范围、危险源及HSE管理要求。Define the area, hazard source and HSE management demands of construction area to second contractor.a) A)由甲方工程主管部门对乙方进行工程项目交底，组织开展工作危害
