1、案情简介：XX年某月某日下午，当事人驶一辆丰田越野车驶至xx路中断时，因开车疏忽撞向了一摩托车。摩托车被撞倒，死者x某（女，孕妇）撞倒后被小车碾压经抢救无效死亡，死者丈夫y某被撞成轻伤。当事人见事态严重赶快逃跑，20分钟后投案自首。经调查，死者有兄妹共三人，父亲51岁，有稳定收入，母亲无固定收入来源。分析：依据最高院关于审理人身损害赔偿案件适用法律若干问题的解释第一条的规定，本条的“赔偿权利人”是指因侵权行为或者其他致害原因直接遭受人身损害的受害人、依法由受害人承担扶养义务的被扶养人以及死亡受害人的近亲属。根据人身损害解释第28条的规定，被扶养人是指受害人依法应当承担扶养义务的未成年人或者丧失
