7、edforaloanandcreditfromtheworldbank(hereinafterreferredtoastheifi)towardsthecostof_project,andintendstoapplyaportionoftheproceedsoftheloanandcredittoeligiblepaymentsunderthecontractforwhichthesedocumentsareissued.paymentbytheifiwillbemadeonlyattherequestofthechinesegovernmentanduponapprovalbytheifia

8、ndwillbesubjectinallrespectstothetermsandconditionsoftheloanagreement.nopartyotherthanthepeoplesrepublicofchinashallderiveanyrightsfromtheloanagreementorhaveanyclaimtotheloanproceeds.2.2paymentfromtheproceedsoftheworldbankloanwillbelimitedtogoodsproducedin,andservicessuppliedfrom,switzerlandandtheme

9、mbercountriesoftheworldbankwhichhavecommercialrelationswithchina.2.3allcostsnotmetbytheifiloanwillbepaidbytheemployerfromfundsallocatedbythegovernmentofchina.3.eligibilityandqualificationrequirements3.1thistenderisopentoallpre-qualifiedtenderersfromeligiblesourcecountriesasdefinedundertheguidelinesf

10、orprocurementoftheworldbank.3.2allgoodsandservicestobesuppliedunderthiscontractshallhavetheiroriginineligiblesourcecountries,andallexpendituresmadeunderthecontractwillbelimitedtosuchgoodsandservices.3.3theoriginofgoodsandservicesisdistinctfromthenationalityofthetenderer.3.4tobeeligibleforawardofcont

11、ract,tenderersshallhaveprovidedevidencesatisfactorytotheemployeroftheireligibilityunderclause3.1above,andoftheircapabilityandadequacyofresourcestoeffectivelycarryoutthecontract.tothisend,theemployerand_companymay,atanytimepriortoawardofcontract,requesttendererstoamplifyorupdatepreviouslysubmittedpre

12、qualificationdata.alltenderssubmittedsha【正文】includethefollowinginformation:(a)copiesoforiginaldocumentsdefiningtheconstitutionorlegalstatus,placeofregistrationandprincipalplaceofbusinessofthecompany,firmorpartnershipor,ifajointventure,ofeachpartytheretoconstitutingthetenderer;(b)thequalificationsand

13、experienceofkeypersonnelproposedforadministrationandexecutionofthecontract,bothonandoffsite,intheformatprescribedinschedulev;(c)majoritemsofconstructionalplantandequipmentproposedforuseincarryingoutthecontractintheformatprescribedinscheduleiv;(d)alistofproposedsub-contractorsintheformatprescribedins

14、chedulevi;(e)informationregardinganycurrentlitigationinwhichthetendererisinvolved;(f)thedetailsoftheconstructionmethodsproposed.3.5forthepurposesofsub-clause3.4,tendererswhohavebeenpre-qualifiedmayupdateandaugmenttheinformationsuppliedwiththeirapplicationforpre-qualification,and,inparticular,shallgi

15、veparticularsofworkinhandatthedateoftendering.3.6tenderssubmittedbyajointventureoftwoormorefirmsaspartnersshallcomplywiththefollowingrequirements:(a)thetender,andincaseofasuccessfultendertheformofagreement,shallbesignedsoastobelegallybindingonallpartners;(b)oneofthejointventuremembersshallbenominate

16、dassponsor;andthisauthorisationshallbeevidencedbysubmittingapowerofattorneysignedbylegallyauthorisedsignatoriesofallthemembersofthejointventure;(c)thejointventuresponsorshallbeauthorisedtoincurliabilitiesandreceiveinstructionsforandonbehalfofanyandallmembersofthejointventureandtheentireexecutionofth

17、econtractincludingpaymentshallbedoneexclusivelywiththejointventuresponsor;(d)allmembersofthejointventureshallbeliablejointlyandseverallyfortheexecutionofthecontractinaccordancewiththecontractterms,andarelevantstatementtothiseffectshallbeincludedintheauthorisationmentionedunder(b)aboveaswellasinthefo

18、rmoftenderandtheformofagreement(incaseofasuccessfultender);and(e)acopyoftheagreemententeredintobythejointventurepartnersshallbesubmittedwiththetender.3.7domestictenderersorcombinationsorjointventuresofdomesticandforeigntenderersapplyingforeligibilityfortheapplicationofa_%marginofpreferenceinthecompa

19、risonoftheirtenderwithothertendersshallsupplyallinformationrequiredtosatisfythecriteriaforeligibilityasdescribedinclause29oftheseinstructions.4.costoftenderingthetenderershallbearallcostsassociatedwiththepreparationandsubmissionofhistenderandneithertheemployernorhisagent_companywillinanywayberespons

20、ibleorliableforthosecosts,regardlessoftheoutcomeofthetenderingprocess.5.sitevisit5.1thetendererisadvisedtovisitandexaminethesiteoftheworksandthesurroundingsandtoobtainforhimselfonhisownresponsibility,allinformationthatmaybenecessaryforpreparingthetenderandenteringintoacontract.thecostsofvisitingthes

21、iteshallbeatthetenderersownexpense.5.2arrangementsforavisittosite,includingtransportationandaccommodation.willbemadebytheemployerorhisagent_companyandwillbeadvisedtotenderersatthepre-tendermeeting,detailsofwhicharegiveninclause16oftheseinstructionstotenderers.,5.3thetendererandanyofhisrepresentative

22、swillbegrantedpermissionbytheemployerorhisagent_companytoenteruponitspremisesandlandsforthepurposeofsuchinspectionbypriorarrangement,butonlyupontheexpressconditionthatthetendererandhisrepresentatives,willreleaseandindemnifytheemployerorhisagent_companyanditspersonnelfromandagainstallliabilityinrespe

23、ctthereofandwillberesponsibleforpersonalinjury(whetherfatalorotherwise),lossofordamagetopropertyandanyotherloss,damage,costsandexpenseshowevercaused,which,butfortheexerciseofsuchpermission,wouldnothavearisen.tenderdocuments6.contentoftenderdocuments6.1thesetofdocumentsissuedtopre-qualifiedtenderersf
