1、辽宁省工资支付规定辽宁省工资支付规定2006-10-01 辽宁省人民政府 辽宁省人民政府令2006(第196号) 辽宁省 第一条 为了保护劳动者获得劳动报酬的权利，规范用人单位的工资支付行为，维护和谐的劳动关系，根据中华人民共和国劳动法和有关法律、法规，结合我省实际，制定本规定。 第二条 我省行政区域内的各类企业、个体经济组织、民办非企业单位(以下统称用人单位)和与之形成劳动关系的劳动者，适用本规定。 国家机关、事业单位、社会团体和与之建立劳动合同关系的劳动者，依照本规定执行。 第三条 省、市、县(含县级市、区，下同)劳动和社会保障行政部门负责本行政区域用人单位的工资支付管理工作。 建设、财政

2、、税务、人事、工商行政管理、经济综合管理等有关行政部门按照各自职责，做好工资支付管理的有关工作。 第四条 工会组织依法对用人单位的工资支付进行监督，有权对用人单位的工资支付违法行为予以纠正或者向政府及其有关部门提出建议，并为劳动者依法维护获得劳动报酬的权利提供支持和帮助。 第五条 任何组织和个人都有权举报用人单位的工资支付违法行为。 政府鼓励、支持并依法保护新闻媒体对用人单位的工资支付行为实施舆论监督。 第六条 省、市劳动和社会保障等有关部门应当根据本行政区域经济社会发展水平和劳动力供求状况等因素，定期制定和发布工资水平宏观调控政策。 第七条 用人单位应当根据当地政府有关工资水平宏观调控政策，

3、结合劳动力市场价位和本单位经济效益，经与工会组织或者劳动者集体协商，确定本单位的工资水平。 第八条 用人单位应当根据本单位的经济效益增长情况、当地政府发布的工资指导线、工资指导价位和本地区、行业的劳动者平均工资水平，逐步提高劳动者的工资水平。 第九条 用人单位应当依法制定本单位的工资支付制度，并向本单位全体劳动者公布。 工资支付制度主要包括下列事项: (一)工资支付的项目、标准和形式; (二)工资支付的周期和日期; (三)加班工资计算基数; (四)工资扣除事项; (五)特殊情况下的工资支付; (六)有关工资支付的其他事项。 第十条 用人单位与劳动者应当在劳动合同中约定工资标准。工资标准根据劳动

4、者所在岗位或者所从事的工作确定。 第十一条 用人单位应当凭劳动和社会保障行政部门核准的工资总额使用手册，在其开立的银行基本存款账户支取工资性现金。 第十二条 用人单位应当以法定货币支付工资，不得以实物、有价证券等代替货币支付。 用人单位应当按照约定的日期支付劳动者工资。遇法定节假日或者休息日，应当提前在最近的工作日支付工资。 第十三条 用人单位应当自用工之日起计算劳动者工资。 第十四条 用人单位可以以小时、日、周、月为周期支付工资。按完成一定工作任务计发工资的，应当在工作任务完成的当日支付劳动者工资。 solution should properly save, avoid for water

16、代发。 用人单位必须向劳动者提供一份本人工资清单，工资清单必须与实际支付的工资相符。 第十六条 用人单位直接向劳动者本人支付工资的，应当办理签收手续。劳动者本人因故不能领取工资时，可以委托亲属或者他人代领。 用人单位委托银行代发工资的，应当在约定的日期将劳动者的工资足额存入其本人账户。受托银行在工资支付中发生劳动者不能按时领取工资或者工资数额差异等问题，由用人单位负责与受托银行协调解决。 第十七条 实行年薪制或者按考核周期计发工资的，用人单位应当每月按不低于当地最低工资标准预付劳动者工资，年终或者考核周期届满时 结算。 第十八条 劳动者与用人单位形成劳动关系后，在试用、实习期间提供正常劳动的，

17、用人单位支付的工资不得低于当地最低工资标准。 第十九条 用人单位不得随意扣除劳动者工资。 除法律、法规规定可以代扣劳动者工资的事项外，用人单位扣除劳动者工资应当符合集体合同、劳动合同的约定或者本单位依法制定的规章制度的规定。每月扣除的部分，不得超过劳动者当月工资的20%;扣除后的余额，不得低于当地最低工资标准。 第二十条 用人单位与劳动者双方依法终止、解除劳动合同的，用人单位应当一次付清劳动者工资。 第二十一条 除实行不定时工作制的以外，用人单位安排劳动者在法定标准工作时间以外工作的，应当按照下列标准支付劳动者加班工资: (一)延长工作时间的，按照不低于劳动者本人小时工资基数的150,支付;

18、(二)休息日工作不能安排同等时间补休的，按照不低于劳动者本人日工资基数或者小时工资基数的200%支付; (三)法定节假日工作的，按照不低于劳动者本人日工资基数或者小时工资基数的300,支付。 第二十二条 计算加班工资的日或者小时工资基数和休假期间的工资，应当按照劳动合同中约定的劳动者本人工资标准确定;劳动合同没有约定的，按照集体合同约定的加班工资基数以及休假期间工资标准确定;劳动合同、集体合同均未约定的，按照劳动者本人正常工作应得的工资确定。 依照前款规定确定的加班工资基数以及假期工资，不得低于当地最低工资标准。 第二十三条 实行计件工资制的用人单位，应当科学、合理地确定劳动定额和计件单价，并

19、予以公布。劳动者在完成计件定额任务后，用人单位安排加班的，应当分别按照不低于计件单价的150%， 200%， 300,支付加班工资。 第二十四条 实行综合计算工时工作制的用人单位，在综合计算工时周期内，应当按照劳动者实际工作时间计算其工资。劳动者实际工作时间总和超过法定工作时间的部分，视为延长工作时间，应当按照本规定支付加班工资。 第二十五条 实行非全日制工作时间的用人单位，应当实行小时工资制。小时工资由用人单位与劳动者协商确定，但不得低于当地非全日制就业劳动者的小时最低工资标准。 第二十六条 劳动者在依法享受年休假、探亲假、婚假、丧假等休假期间，用人单位应当支付工资。劳动妇女节、青年节等部分

31、条 劳动者在事假期间，用人单位可以不支付其工资。 第二十八条 劳动者患病或者非因工负伤停止劳动的，在规定的医疗期内，用人单位应当根据劳动合同或者集体合同的约定支付病假工资，但不得低于当地最低工资标准的80% 。 第二十九条 劳动者因工伤或者患职业病停止工作的，停工留薪期的工资支付依照国务院工伤保险条例的规定执行。 第三十条 劳动者因生育或者计划生育手术休假期间，其工资待遇依照辽宁省人口与计划生育条例的规定执行。 第三十一条 劳动者在法定工作时间内依法参加下列社会活动期间，用人单位应当视同其提供正常劳动予以支付工资: (一)依法行使选举权、被选举权的活动; (二)人民代表大会代表履行职务的活动;

32、 (三)以本单位劳动者代表身份参加本单位的集体协商活动; (四)工会基层委员会依法开展工会活动; (五)人民法院通知出庭作证; (六)义务献血、参加民兵组织训练或者预备役训练; (七)宪法、法律规定的公民应当履行义务的其他活动。 第三十二条 劳动者经单位批准参加脱产、半脱产学习、进修、培训的，其工资待遇由用人单位与劳动者协商确定。 第三十三条 劳动者被人民法院判处管制或者拘役、有期徒刑适用缓刑的，或者被假释、监外执行、取保候审的，在此期间用人单位未与其解除劳动合同，劳动者继续在原单位正常劳动的，用人单位应当按照劳动合同约定或者本单位依法制定的规章制度执行。 劳动者被依法判处拘役以上刑罚，或者被依法采取限制人身自由的强制措施以及受到限制人身自由的行政处罚的，用人单位不支付其被限制人身自由期间的工资。 第三十四条 用人单位因生产经营困难暂时无法按时支付工资的，经与工会组织或者劳动者代表协商一致后，可以按照协商的日期支付工资，除实施改制的用人单位外，延期支付工资不得超过30日。超过30日的，应当向当地劳动和社会保障行政部门备案。 实施改制的用人单位，改制前拖欠劳动者工资的，必须在改制方案中明确支付被
