4、障人民群众生命和财产安全，促进经济发展，制定本法。Article 1 This law is formulated to strengthen the supervision & management over the safe production, cut down & prevent the production & safety accidents, safeguard the life and property of the public, and promote the economic development. 第二条 在中华人民共和国领域内从事生产经营活动的单位（以下统称生产经

5、营单位）的安全生产，适用本法；有关法律、行政法规对消防安全和道路交通安全、铁路交通安全、水上交通安全、民用航空安全另有规定的，适用其规定。This law applies to the safe production of the units that are engaged in the production and business activities in the territory of Peoples Republic of China (hereinafter called “Production and Business Unit”; If it is specified ot

6、herwise by the laws and administrative regulations in the issues concerning the fire-fighting safety and the safety of the transportation by road, railway, water and civil aviation, the stipulations in those laws and administrative regulations should apply. 第三条 安全生产管理，坚持安全第一、预防为主的方针。Article 3 The sa

7、fe production management should adhere to the credo of safety above everything and prevention taking the lead.第四条 生产经营单位必须遵守本法和其他有关安全生产的法律、法规，加强安全生产管理，建立、健全安全生产责任制度，完善安全生产条件，确保安全生产。Article 4 The Production and Business Unit should abide by this law and other safe production-related laws & regulation

8、s, strengthening the safe production management, establishing & completing the safe production responsibility system, perfecting the safe production conditions, and ensuring the safe production. 第五条 生产经营单位的主要负责人对本单位的安全生产工作全面负责。Article 5 The major person-in-charge of the Production and Business Unit

9、should assume the overall responsibilities for the safe production issues of the unit. 第六条 生产经营单位的从业人员有依法获得安全生产保障的权利，并应当依法履行安全生产方面的义务。Article 6 The practitioners of the Production and Business Units are entitled, by law, to the guarantees of the safe production, and should perform, pursuant to the l

10、aws & regulations, the obligations regarding the safe production. 第七条 工会依法组织职工参加本单位安全生产工作的民主管理和民主监督，维护职工在安全生产方面的合法权益。Article 7 The labor union should organize and co-ordinate, under the guidance of the laws & regulations, the democratic management & supervision exercised by the employees over the sa

11、fe production of the corresponding unit, and should also safeguard the employees rights and interests in the respect of safe production. 第八条 国务院和地方各级人民政府应当加强对安全生产工作的领导，支持、督促各有关部门依法履行安全生产监督管理职责。Article 8 The State Council and the local authorities at all levels should reinforce their guidance and sup

12、port for the safe production-related work, and urge the departments concerned to execute, in compliance with the laws & regulations, the supervisory and managerial duties over the safe production.县级以上人民政府对安全生产监督管理中存在的重大问题应当及时予以协调、解决。The governments above the county level should provide the timely co

13、-ordination and solution for the critical problems existing in the supervision and management over the safe production. 第九条 国务院负责安全生产监督管理的部门依照本法，对全国安全生产工作实施综合监督管理；县级以上地方各级人民政府负责安全生产监督管理的部门依照本法，对本行政区域内安全生产工作实施综合监督管理。Article 9 The State Council should have its departments responsible for the safe prod

14、uction supervision & management exercise, in accordance with this law, the comprehensive supervisory management over the national-wide safe production work; Whereas, the local governments above the county level should have their departments responsible for the safe production supervision & managemen

15、t excise, against this law, the comprehensive supervisory management over the safe production work within the jurisdiction of the corresponding administrative area. 国务院有关部门依照本法和其他有关法律、行政法规的规定，在各自的职责范围内对有关的安全生产工作实施监督管理；县级以上地方各级人民政府有关部门依照本法和其他有关法律、法规的规定，在各自的职责范围内对有关的安全生产工作实施监督管理。The departments concer

16、ned in the State Council should follow this law and the stipulations of other related laws and administrative regulations, and execute the supervision & management over the related safe production work within the respective scope of duties; Whereas, the departments concerned in the local governments

17、 above the county level should follow this law and the stipulations of other related laws and administrative regulations, and execute the supervision & management over the related safe production work within the respective scope of duties.第十条 国务院有关部门应当按照保障安全生产的要求，依法及时制定有关的国家标准或者行业标准，并根据科技进步和经济发展适时修订

18、。Article 10 Pursuant to the requirements for the safe production assurance, the departments concerned in the State Council should establish the related national standards or industrial standards timely and lawfully, and make the amendment in time to keep the pace with technological advancement and e

19、conomical development. 生产经营单位必须执行依法制定的保障安全生产的国家标准或者行业标准。The Production and Business Unit must implement the national standards or industrial standards which are stipulated by law to assure the safe production. 第十一条 各级人民政府及其有关部门应当采取多种形式，加强对有关安全生产的法律、法规和安全生产知识的宣传，提高职工的安全生产意识。Article 11 The governments

20、 at all levels and the departments concerned should, using different approaches, publicize the laws, regulations and knowledge relating the safe production, and enhance the employees understanding about the safe production.第十二条 依法设立的为安全生产提供技术服务的中介机构，依照法律、行政法规和执业准则，接受生产经营单位的委托为其安全生产工作提供技术服务。Article 1

21、2 The lawfully-established intermediary technological service provider of the safe production, should accept the appointment by the Production and Business Unit to provide the technological service for its safe production work on the basis of the laws, administrative regulations and practice codes.第

22、十三条 国家实行生产安全事故责任追究制度，依照本法和有关法律、法规的规定，追究生产安全事故责任人员的法律责任。Article 13 The state has implemented the responsibility claiming system for any accident relating the safe production. Pursuant to this law and the laws & regulations concerned, the state will claim for the legal responsibilities of the person r

23、esponsible for the production & safety accidents.第十四条 国家鼓励和支持安全生产科学技术研究和安全生产先进技术的推广应用，提高安全生产水平。Article 14 The state encourages and supports the promotion and introduction of the science & technology research and advanced technology on the safe production, aiming to elevate the safe production to a n

24、ew level. 第十五条 国家对在改善安全生产条件、防止生产安全事故、参加抢险救护等方面取得显著成绩的单位和个人，给予奖励。Article 15 The state will grant the prize to the unit or individual who has made the remarkable achievement in improving the safe production conditions, preventing the production & safety accidents, participating in the salvage and the

25、first-aid support, and etc.第二章 生产经营单位的安全生产保障Chapter 2 Safety Production Assurance of the Production and Business Unit第十六条 生产经营单位应当具备本法和有关法律、行政法规和国家标准或者行业标准规定的安全生产条件；不具备安全生产条件的，不得从事生产经营活动。Article 16 The Production and Business Unit should be furnished with the safe production conditions stipulated by

26、 this law, the related laws & administrative regulations, and the national standards or the industrial standards; Those who have not been furnished the safe production conditions, should not deal with any activities involving production and business. 第十七条 生产经营单位的主要负责人对本单位安全生产工作负有下列职责：Article 17 The

27、major person-in-charge of the Production and Business Unit should assume the following responsibilities for the safe production work of the unit: （一）建立、健全本单位安全生产责任制；(1) Establish and complete the safe production responsibility system of the unit;（二）组织制定本单位安全生产规章制度和操作规程； (2) Arrange to formulate the

28、safe production regulations and operation procedures of the unit;（三）保证本单位安全生产投入的有效实施； (3) Ensure that the investment of the unit in the safe production has been effectively made use of;（四）督促、检查本单位的安全生产工作，及时消除生产安全事故隐患； (4) Push and inspect the safe production work of unit, and eradicate the hidden co

29、ncerns of the production and the safety in time. （五）组织制定并实施本单位的生产安全事故应急救援预案； (5) Arrange to formulate and implement the emergency response provision plan targeted at the production & safety accidents of the unit;（六）及时、如实报告生产安全事故。 (6) Report the production & safety accidents timely and truthfully. 第十

30、八条 生产经营单位应当具备的安全生产条件所必需的资金投入，由生产经营单位的决策机构、主要负责人或者个人经营的投资人予以保证，并对由于安全生产所必需的资金投入不足导致的后果承担责任。Article 18 The Production and Business Unit should be funded with the capital investment necessary for the required safe production conditions. The said capital investment should be guaranteed by the decision-m

31、aking organ and major person-in-charge of the Production and Business Unit, or the investor of the sole proprietorship enterprise, who should assume the responsibilities for the insufficient capital investment in the safe production. 第十九条 矿山、建筑施工单位和危险物品的生产、经营、储存单位，应当设置安全生产管理机构或者配备专职安全生产管理人员。Article 19 In the
