ChapterIGeneralProvisions
Article1ThisLawisformulatedinaccordancewiththeConstitutioninordertoprotectthelegitimaterightsandinterestsoflaborers,readjustlaborrelationship,establishandsafeguardalaborsystemsuitedtothesocialistmarketeconomy,andpromoteeconomicdevelopmentandsocialprogress.
Article2ThisLawappliestoallenterprisesandindividualeconomicorganizations(hereinafterreferredtoasemployingunits)withintheboundaryofthePeople'sRepublicofChinaandlaborerswhoformalaborrelationshiptherewith.
Stateorgans,institutionalorganizationsandsocietiesaswellaslaborerswhoformalaborcontractrelationshiptherewithshallfollowthisLaw.
Article3Laborersshallhavetherighttobeemployedonanequalbasis,chooseoccupations,obtainremunerationfortheirlabor,takerest,haveholidaysandleaves,obtainprotectionofoccupationalsafetyandhealth,receivetraininginvocationalskills,enjoysocialinsuranceandwelfare,andsubmitapplicationsforsettlementoflabordisputes,andotherrightsrelatingtolaborasstipulatedbylaw.
Laborersshallfulfilltheirlabortasks,improvetheirvocationalskills,followrulesonoccupationalsafetyandhealth,andobservelabordisciplineandprofessionalethics.
Article4Theemployingunitsshallestablishandperfectrulesandregulationsinaccordancewiththelawsoastoensurethatlaborersenjoytherighttoworkandfulfilllaborobligations.
Article5TheStateshalltakevariousmeasurestopromoteemployment,developvocationaleducation,laydownlaborstandards,regulatesocialincomes,perfectsocialinsurancesystem,coordinatelaborrelationship,andgraduallyraisethelivingstandardoflaborers.
Article6TheStateshalladvocatetheparticipationoflaborersinsocialvoluntarylaborandthedevelopmentoftheirlaborcompetitionsandactivitiesofforwardingrationalproposals,encourageandprotectthescientificresearchandtechnicalrenovationengagedbylaborers,aswellastheirinventionsandcreations;andcommendandawardlabormodelsandadvancedworkers.
Article7Laborersshallhavetherighttoparticipateinandorganizetradeunionsinaccordancewiththelaw.
Tradeunionsshallrepresentandsafeguardthelegitimaterightsandinterestsoflaborers,andindependentlyconducttheiractivitiesinaccordancewiththelaw.
Article8Laborersshall,throughtheassemblyofstaffandworkersortheircongress,orotherformsinaccordancewiththeprovisionsoflaws,rulesandregulations,takepartindemocraticmanagementorconsultwiththeemployingunitsonanequalfootingaboutprotectionofthelegitimaterightsandinterestsoflaborers.
Article9ThelaboradministrativedepartmentoftheStateCouncilshallbeinchargeofthemanagementoflaborofthewholecountry.
Thelaboradministrativedepartmentsofthelocalpeople'sgovernmentsatorabovethecountylevelshallbeinchargeofthemanagementoflaborintheadministrativeareasundertheirrespectivejurisdiction.
ChapterIIPromotionofEmployment
Article10TheStateshallcreateconditionsforemploymentandincreaseopportunitiesforemploymentbymeansofthepromotionofeconomicandsocialdevelopment.
TheStateshallencourageenterprises,institutionalorganizations,andsocietiestoinitiateindustriesorexpandbusinessesfortheincreaseofemploymentwithinthescopeofthestipulationsoflaws,andadministrativerulesandregulations.
TheStateshallsupportlaborerstogetjobsbyorganizingthemselvesonavoluntarybasisorbyengaginginindividualbusinesses.
Article11Localpeople'sgovernmentsatvariouslevelsshalltakemeasurestodevelopvariouskindsofjob-introductionagenciesandprovideemploymentservices.
Article12Laborersshallnotbediscriminatedagainstinemployment,regardlessoftheirethniccommunity,race,sex,orreligiousbelief.
Article13Femalesshallenjoyequalrightsasmalesinemployment.Itshallnotbeallowed,intherecruitmentofstaffandworkers,tousesexasapretextforexcludingfemalesfromemploymentortoraiserecruitmentstandardsforthefemales,exceptforthetypesofworkorpoststhatarenotsuitableforfemalesasstipulatedbytheState.
Article14Wheretherearespecialstipulationsinlaws,rulesandregulationsontheemploymentofthedisabled,thepersonnelofnationalminorities,anddemobilizedarmymen,suchspecialstipulationsshallapply.
Article15Noemployingunitsshallbeallowedtorecruitjuvenilesundertheageof16.
Unitsofliteratureandart,physicalcultureandsport,andspecialartsandcraftsthatneedtorecruitjuvenilesundertheageof16mustgothroughtheformalitiesofexaminationandapprovalaccordingtotherelevantprovisionsoftheStateandguaranteetheirrighttocompulsoryeducation.
ChapterIIILaborContractsandCollectiveContracts
Article16Alaborcontractistheagreementreachedbetweenalaborerandanemployingunitfortheestablishmentofthelaborrelationshipandthedefinitionoftherights,interestsandobligationsofeachparty.
Alaborcontractshallbeconcludedwherealaborrelationshipistobeestablished.
Article17Conclusionandmodificationofalaborcontractshallfollowtheprinciplesofequality,voluntarinessandunanimitythroughconsultation,andshallnotruncountertothestipulationsoflaws,administrativerulesandregulations.
Alaborcontractonceconcludedinaccordancewiththelawshallpossesslegalbindingforce.Thepartiesinvolvedmustfulfilltheobligationsasstipulatedinthelaborcontract.
Article18Thefollowinglaborcontractsshallbeinvalid:
(1)laborcontractsconcludedinviolationoflaws,administrativerulesandregulations;and
(2)laborcontractsconcludedbyresortingtosuchmeasuresascheatingandintimidation.
Aninvalidlaborcontractshallhavenolegalbindingforcefromtheverybeginningofitsconclusion.Whereapartofalaborcontractisconfirmedasinvalidandwherethevalidityoftheremainingpartisnotaffected,theremainingpartshallremainvalid.
Theinvalidityofalaborcontractshallbeconfirmedbyalabordisputearbitrationcommitteeorapeople'scourt.
Article19Alaborcontractshallbeconcludedinwrittenformandcontainthefollowingclauses:
(1)termofalaborcontract;
(2)contentsofwork;
(3)laborprotectionandworkingconditions;
(4)laborremuneration;
(5)labordisciplines;
(6)conditionsfortheterminationofalaborcontract;and
(7)responsibilityfortheviolationofalaborcontract.
Apartfromtherequiredclausesspecifiedintheprecedingparagraph,othercontentsinalaborcontractmaybeagreeduponthroughconsultationbythepartiesinvolved.
Article20Thetermofalaborcontractshallbedividedintofixedterm,flexibletermortakingthecompletionofaspecificamountofworkasaterm.
Incasealaborerhaskeptworkinginasameemployingunitfortenyearsormoreandthepartiesinvolvedagreetoextendthetermofthelaborcontract,alaborcontractwithaflexibletermshallbeconcludedbetweenthemifthelaborersorequested.
Article21Aprobationperiodmaybeagreeduponinalaborcontract.Thelongestprobationperiodshallnotexceedsixmonths.
Article22Thepartiesinvolvedinalaborcontractmayreachanagreementintheirlaborcontractonmattersconcerningkeepingthecommercialsecretsoftheemployingunit.
Article23Alaborcontractshallterminateupontheexpirationofitstermortheemergenceoftheconditionsfortheterminationofthelaborcontractasagreeduponbythepartiesinvolved.
Article24Alaborcontractmayberevokeduponagreementreachedbetweenthepartiesinvolvedthroughconsultation.
Article25Theemployingunitmayrevokethelaborcontractwithalaborerinanyofthefollowingcircumstances:
(1)tobeprovednotuptotherequirementsforrecruitmentduringtheprobationperiod;
(2)toseriouslyviolatelabordisciplinesortherulesandregulationsoftheemployingunit;
(3)tocausegreatlossestotheemployingunitduetoseriousderelictionofdutyorengagementinmalpracticeforselfishends;and
(4)tobeinvestigatedforcriminalresponsibilitiesinaccordancewiththelaw.
Article26Inanyofthefollowingcircumstances,theemployingunitmayrevokealaborcontractbutawrittennotificationshallbegiventothelaborer30daysinadvance:
(1)wherealaborerisunabletotakeuphisoriginalworkoranynewworkarrangedbytheemployingunitafterthecompletionofhismedicaltreatmentforillnessorinjurynotsufferedfromatwork;
(2)wherealaborerisunqualifiedforhisworkandremainsunqualifiedevenafterreceivingatrainingoranadjustmenttoanotherworkpost;and
(3)noagreementonmodificationofthelaborcontractcanbereachedthroughconsultationbythepartiesinvolvedwhentheobjectiveconditionstakenasthebasisfortheconclusionofthecontracthavegreatlychangedsothattheoriginalla
