§16.1Applicabilityanddescriptionofpart.
(a)General.TheprovisionsofthispartgovernallproceedingsinvolvingFederally-assistedairports,exceptfordisputesbetweenU.S.andforeignaircarriersandairportproprietorsconcerningthereasonablenessofairportfeescoveredby14CFRpart302,whethertheproceedingsareinstitutedbyorderoftheFAAorbyfilingwiththeFAAacomplaint,underthefollowingauthorities:
(1)49U.S.C.40103(e),prohibitingthegrantofexclusiverightsfortheuseofanylandingareaorairnavigationfacilityonwhichFederalfundshavebeenexpended(formerlysection308oftheFederalAviationActof1958,asamended).
(2)RequirementsoftheAnti-HeadTaxAct,49U.S.C.40116.
(3)Theassurancescontainedingrant-in-aidagreementsissuedundertheFederalAirportActof1946,49U.S.C.1101etseq(repealed1970).
(4)Theassurancescontainedingrant-in-aidagreementsissuedundertheAirportandAirwayDevelopmentActof1970,asamended,49U.S.C.1701etseq.

(c)Otherenforcement.IfacomplaintoractioninitiatedbytheFAAinvolvesaviolationofthe49U.S.C.subtitleVIIorFAAregulations,exceptasspecifiedinparagraphs(a)
(1)and(a)
(2)ofthissection,theFAAmaytakeinvestigativeandenforcementactionunder14CFRpart13,“InvestigativeandEnforcementProcedures.”
(d)Effectivedate.ThispartappliestoacomplaintfiledwiththeFAAandtoaninvestigationinitiatedbytheFAAonorafterDecember16,1996.
§16.3Definitions.
TermsdefinedintheActsareusedassodefined.Asusedinthispart:
Actmeansastatutelistedin§16.1andanyregulation,agreement,ordocumentofconveyanceissuedormadeunderthatstatute.
AgencyattorneymeanstheDeputyChiefCounsel;theAssistantChiefCounselandattorneysintheAirports/EnvironmentalLawDivisionoftheOfficeoftheChiefCounsel;theAssistantChiefCounselandattorneysinanFAAregionorcenterwhorepresenttheFAAduringtheinvestigationofacomplaintoratahearingonacomplaint,andwhoprosecuteonbehalfoftheFAA,asappropriate.AnagencyattorneyshallnotincludetheChiefCounsel;theAssistantChiefCounselforLitigation,oranyattorneyonthestaffoftheAssistantChiefCounselforLitigation,whoadvisestheAssociateAdministratorregardinganinitialdecisionofthehearingofficeroranyappealtotheAssociateAdministratororwhoissupervisedinthatactionbyapersonwhoprovidessuchadviceinanactioncoveredbythispart.
AgencyemployeemeansanyemployeeoftheU.S.DepartmentofTransportation.
AssociateAdministratormeanstheAssociateAdministratorforAirportsoradesignee.
Complainantmeansthepersonsubmittingacomplaint.
ComplaintmeansawrittendocumentmeetingtherequirementsofthispartfiledwiththeFAAbyapersondirectlyandsubstantiallyaffectedbyanythingallegedlydoneoromittedtobedonebyanypersonincontraventionofanyprovisionofanyAct,asdefinedinthissection,astomatterswithinthejurisdictionoftheAdministrator.
DirectormeanstheDirectoroftheOfficeofAirportSafetyandStandards.
Director'sdeterminationmeanstheinitialdeterminationmadebytheDirectorfollowinganinvestigation,whichisanon-finalagencydecision.
FilemeanstosubmitwrittendocumentstotheFAAforinclusioninthePart16AirportProceedingsDocketortoahearingofficer.
Finaldecisionandordermeansafinalagencydecisionthatdisposesofacomplaintordeterminesarespondent'scompliancewithanyAct,asdefinedinthissection,anddirectsappropriateaction.
HearingofficermeansanattorneydesignatedbytheFAAinahearingordertoserveasahearingofficerinahearingunderthispart.Thefollowingarenotdesignatedashearingofficers:
theChiefCounselandDeputyChiefCounsel;theAssistantChiefCounselandattorneysintheFAAregionorcenterinwhichthenoncompliancehasallegedlyoccurredorisoccurring;theAssistantChiefCounselandattorneysintheAirportsandEnvironmentalLawDivisionoftheFAAOfficeoftheChiefCounsel;andtheAssistantChiefCounselandattorneysintheLitigationDivisionoftheFAAOfficeofChiefCounsel.
InitialdecisionmeansadecisionmadebythehearingofficerinahearingundersubpartFofthispart.
MailmeansU.S.firstclassmail;U.S.certifiedmail;andU.S.expressmail.
NoncompliancemeansanythingdoneoromittedtobedonebyanypersonincontraventionofanyprovisionofanyAct,asdefinedinthissection,astomatterswithinthejurisdictionoftheAdministrator.
Partymeansthecomplainant(s)andtherespondent(s)namedinthecomplaintand,afteraninitialdeterminationprovidinganopportunityforhearingisissuedunder§16.31andsubpartEofthispart,theagency.
Personinadditiontoitsmeaningunder49U.S.C.40102(a)(33),includesapublicagencyasdefinedin49U.S.C.47102(a)(15).
Personaldeliverymeanshanddeliveryorovernightexpressdeliveryservice.
Respondentmeansanypersonnamedinacomplaintasapersonresponsiblefornoncompliance.
Sponsormeans:
(1)Anypublicagencywhich,eitherindividuallyorjointlywithoneormoreotherpublicagencies,hasreceivedFederalfinancialassistanceforairportdevelopmentorplanningundertheFederalAirportAct,AirportandAirwayDevelopmentActorAirportandAirwayImprovementAct;
(2)Anyprivateownerofapublic-useairportthathasreceivedfinancialassistancefromtheFAAforsuchairport;and
(3)AnypersontowhomtheFederalGovernmenthasconveyedpropertyforairport
