INTERNATIONALBOVINEMEATAGREEMENT
ThePartiestothisAgreement,
Convincedthatincreasedinternationalcooperationshouldbecarriedoutinsuchawayastocontributetotheachievementofgreaterliberalization,stabilityandexpansionininternationaltradeinmeatandliveanimals;
Takingintoaccounttheneedtoavoidseriousdisturbancesininternationaltradeinbovinemeatandliveanimals;
Recognizingtheimportanceofproductionandtradeinbovinemeatandliveanimalsfortheeconomiesofmanycountries,especiallyforcertaindevelopedanddevelopingcountries;
MindfuloftheirobligationstotheprinciplesandobjectivesoftheGeneralAgreementonTariffsandTrade1994(hereinafterreferredtoas"GATT1994");
Determined,incarryingouttheaimsofthisAgreementtoimplementtheprinciplesandobjectivesagreeduponintheTokyoDeclarationofMinistersdated14 September1973,inparticularasconcernsspecialandmorefavourabletreatmentfordevelopingcountries;
Herebyagreeasfollows:
ArticleI
Objectives
TheobjectivesofthisAgreementshallbe:
1.topromotetheexpansion,evergreaterliberalizationandstabilityoftheinternationalmeatandlivestockmarketbyfacilitatingtheprogressivedismantlingofobstaclesandrestrictionstoworldtradeinbovinemeatandliveanimals,includingthosewhichcompartmentalizethistrade,andbyimprovingtheinternationalframeworkofworldtradetothebenefitofbothconsumerandproducer,importerandexporter;
2.toencouragegreaterinternationalcooperationinallaspectsaffectingthetradeinbovinemeatandliveanimalswithaviewinparticulartogreaterrationalizationandmoreefficientdistributionofresourcesintheinternationalmeateconomy;
3.tosecureadditionalbenefitsfortheinternationaltradeofdevelopingcountriesinbovinemeatandliveanimalsthroughanimprovementinthepossibilitiesforthesecountriestoparticipateintheexpansionofworldtradeintheseproductsbymeansofinteralia:
(a)promotinglong-termstabilityofpricesinthecontextofanexpandingworldmarketforbovinemeatandliveanimals;and
(b)promotingthemaintenanceandimprovementoftheearningsofdevelopingcountriesthatareexportersofbovinemeatandliveanimals;
theabovewithaviewthustoderivingadditionalearnings,bymeansofsecuringlong-termstabilityofmarketsforbovinemeatandliveanimals;
4.tofurtherexpandtradeonacompetitivebasistakingintoaccountthetraditionalpositionofefficientproducers.
ArticleII
ProductCoverage
ThisAgreementappliestotheproductslistedintheAnnex andtoanyotherproductthatmaybeaddedbytheInternationalMeatCouncil(hereinafteralsoreferredtoas"theCouncil"),asestablishedunderthetermsofArticleV,inordertoaccomplishtheobjectivesandprovisionsofthisAgreement.
ArticleIII
InformationandMarketMonitoring
1.EachPartyshallprovideregularlyandpromptlytotheCounciltheinformationwhichwillpermittheCounciltomonitorandassesstheoverallsituationoftheworldmarketformeatandthesituationoftheworldmarketforeachspecificmeat.
2.DevelopingcountryPartiesshallfurnishtheinformationavailabletothem.InorderthatthesePartiesmayimprovetheirdatacollectionmechanism,developedcountryParties,andanydevelopingcountryPartiesabletodoso,shallconsidersympatheticallyanyrequesttothemfortechnicalassistance.
3.TheinformationthatthePartiesundertaketoprovidepursuanttoparagraph 1,accordingtothemodalitiesthattheCouncilshallestablish,shallincludedataonpastperformanceandcurrentsituationandanassessmentoftheoutlookregardingproduction(includingtheevolutionofthecompositionofherds),consumption,prices,stocksofandtradeintheproductsreferredtoinArticleII,andanyotherinformationdeemednecessarybytheCouncil,inparticularoncompetingproducts.Partiesshallalsoprovideinformationontheirdomesticpoliciesandtrademeasuresincludingbilateralandplurilateralcommitmentsinthebovinesector,andshallnotifyasearlyaspossibleanychangesinsuchpoliciesandmeasuresthatarelikelytoaffectinternationaltradeinbovinemeatandliveanimals.TheprovisionsofthisparagraphshallnotrequireanyPartytodiscloseconfidentialinformationwhichwouldimpedelawenforcementorotherwisebecontrarytothepublicinterestorwouldprejudicethelegitimatecommercialinterestsofparticularenterprises,publicorprivate.
4.TheSecretariatoftheWorldTradeOrganization(hereinafterreferredtoas"Secretariat")shallmonitorvariationsinmarketdata,inparticularherdsizes,stocks,slaughteringanddomesticandinternationalprices,soastopermitearlydetectionofthesymptomsofanyseriousimbalanceinthesupplyanddemandsituation.TheSecretariatshallkeeptheCouncilapprizedofsignificantdevelopmentsonworldmarkets,aswellasprospectsforproduction,consumption,exportsandimports.TheSecretariatshalldrawupandkeepuptodateaninventoryofallmeasuresaffectingtradeinbovinemeatandliveanimals,includingcommitmentsresultingfrombilateral,plurilateralandmultilateralnegotiations.
ArticleIV
FunctionsoftheInternationalMeatCouncil
andCooperationbetweentheParties
1.TheCouncilshallmeetinorderto:
(a)evaluatetheworldsupplyanddemandsituationandoutlookonthebasisofaninterpretativeanalysisofthepresentsituationandofprobabledevelopmentsdrawnupbytheSecretariat,onthebasisofdocumentationprovidedinconformitywithArticleIII,includingthatrelatingtotheoperationofdomesticandtradepoliciesandofanyotherinformationavailabletotheSecretariat;
(b)proceedtoacomprehensiveexaminationofthefunctioningofthisAgreement;
(c)provideanopportunityforregularconsultationonallmattersaffectinginternationaltradeinbovinemeat.
2.Ifafterevaluationoftheworldsupplyanddemandsituationreferredtoinparagraph1(a),orafterexaminationofallrelevantinformationpursuanttoparagraph3ofArticleIII,theCouncilfindsevidenceofaseriousimbalanceorathreatthereofintheinternationalmeatmarket,theCouncilwillproceedbyconsensus,takingparticularaccountofthesituationindevelopingcountries,toidentifyforconsiderationbygovernmentspossiblesolutionstoremedythesituationconsistentwiththeprinciplesandrulesofGATT1994.
3.DependingonwhethertheCouncilconsidersthatthesituationdefinedinparagraph 2istemporaryormoredurable,themeasuresreferredtoinparagraph2couldincludeshort-,medium-,orlong-termmeasurestakenbyimportersaswellasexporterstocontributetoimprovetheoverallsituationoftheworldmarketconsistentwiththeobjectivesandaimsofthisAgreement,inparticulartheexpansion,evergreaterliberalization,andstabilityoftheinternationalmeatandlivestockmarkets.
4.Whenconsideringthesuggestedmeasurespursuanttoparagraphs2and3,dueconsiderationshallbegiventospecialandmorefavourabletreatmenttodevelopingcountries,wherethisisfeasibleandappropriate.
5.ThePartiesundertaketocontributetothefullestpossibleextenttotheimplementationoftheobjectivesofthisAgreementsetforthinArticle I.Tothisend,andconsistentwiththeprinciplesandrulesoftheGATT1994,Partiesshall,onaregularbasis,enterintothediscussionsprovidedinparagraph1(c)withaviewtoexploringthepossibilitiesofachievingtheobjectivesofthisAgreement,inparticularthefurtherdismantlingofobstaclestoworldtradeinbovinemeatandliveanimals.SuchdiscussionsshouldpreparethewayforsubsequentconsiderationofpossiblesolutionsoftradeproblemsconsistentwiththerulesandprinciplesoftheGATT 1994,whichcouldbejointlyacceptedbyallthePartiesconcerned,inabalancedcontextofmutualadvantages.
6.AnyPartymayraisebeforetheCouncilanymatteraffectingthisAgreement,interalia,forthesamepurposesprovidedforinparagraph2.TheCouncilshall,attherequestofaParty,meetwithinaperiodofnotmorethanfifteendaystoconsideranymatteraffectingthisAgreement.
ArticleV
Administration
1.InternationalMeatCouncil
AnInternationalMeatCouncilshallbeestablishedwithintheframeworkoftheWorldTradeOrganization(hereinafterreferredtoas"theWTO").TheCouncilshallcompriserepresentativesofallPartiestotheAgreementandshallcarryoutallthefunctionswhicharenecessarytoimplementtheprovisionsoftheAgreement.TheCouncilshallbeservicedbytheSecretariat.TheCouncilshallestablishitsownrulesofprocedure.TheCouncilmay,asappropriate,establishsubsidiaryworkinggroupsorotherbodies.
2.Regularandspecialmeetings
TheCouncilshallnormallymeetasappropriate,butnotlessthantwiceeachyear.TheChairmanmaycallaspecialmeetingoftheCouncileitheronhisowninitiativeorattherequestofaPartytothisAgreement.
3.Decisions
TheCouncilshallreachitsdecisionsbyconsensus.TheCouncilshallbedeemedtohavedecidedonamattersubmittedforitsconsiderationifnomemberoftheCouncilformallyobjectstotheacceptanceofaproposal.
4.Cooperationwithotherorganizations
TheCouncilshallmakearrangementsasappropriateforconsultationorcooperationwithintergovernmentalandnon-governmentalorganizations.
5.Admissionofobservers
(a)TheCouncilmayinviteanynon-Partygovernmenttoberepresentedatanyofitsmeetingsasanobserverandmaydeterminerulesontherightsandobligationsofobservers,inparticularwithrespecttotheprovisionofinformation.
(b)TheCouncilmayalsoinviteanyoftheorganizations
