江苏省工资支付条例英

RegulationsofJiangsuProvinceonWagePayment

(AdoptedattheTwelfthMeetingoftheStandingCommitteeofthe

TenthPeople’sCongressofJiangsuProvinceonOctober22,2004)

ChapterIGeneralProvisions

Article1TheseRegulationsareenacted,inaccordancewiththeLaborLawofthePeople’sRepublicofChinaandotherrelatedlawsandadministrativeregulations,inlightofthespecificsituationofJiangsuProvince,andforthepurposesofprotectinglaborers’righttolaborremuneration,regulatingandstrengtheningthesupervisionandcontroloverthewagepaymentactivitiesoftheemployingunits.

Article2TheseRegulationsshallapplytoenterprises,individualindustrialandcommercialhouseholds,privatenon-enterpriseunits(hereinafterreferredtoasemployingunits)andlaborerswhoformalaborcontractrelationshiptherewithwithintheadministrativeareaofthisProvince.

Stateorgans,institutions,socialorganizationsandlaborerswhoformalaborcontractrelationshiptherewithshallbeboundbytheseRegulationswithexceptionsofcivilservants,staffmemberswhoareregulatedwithreferencetocivilservants,andthosewhoareregulatedotherwisebytheState.

Article3Thelocalpeople’sgovernmentatorabovethecountylevelshallformulateandpromulgateonaregularbasisasteeringpolicyformacroadjustmentofwagelevelaccordingtothelocalsocialeconomicdevelopmentandthedemand-and-supplysituationoflaborforce.

Theemployingunitshall,accordingtotherequirementofthegovernment’ssteeringpolicyformacroadjustmentofwagedistribution,andwithconsiderationofthepriceinthelabormarketandeconomicresultoftheunit,workoutarationalwagelevelfortheunit.

Theemployingunitshallsetupamechanismfornormalwageincreaseandgraduallyraisewagestoitslaborersaccordingtothedevelopmentoftheeconomicresultoftheunit,theguidinglineofwagesandguidingpricelevelofwagesissuedbythelocalgovernment,aswellastheaveragewagelevelforstaffandworkersinthesametradeandsamearea.

Article4Thedistributionofwagesshallfollowtheprincipleofdistributionaccordingtoworkandequalpayforequalwork.Wagesshallbefullypaidwithgoodfaithintheformofcashandonschedule.

Article5Theadministrativedepartmentoflaborandsocialsecurity(hereinafterreferredtoastheadministrativedepartmentoflaborsecurity)underthepeople’sgovernmentatorabovethecountylevelisresponsibleforgivinginstructiononandcarryingoutsupervisionandinspectionoverwagepaymentactivitieswithinitsadministrativearea.

Thedepartmentsofpersonnel,economicandtrade,construction,industrialandcommercialadministration,andthebranchofthePeople’sBankofChinaunderthelocalpeople’sgovernmentatorabovecountylevelareresponsibleforcarryingout,withinthescopeoftheirrespectiveresponsibilities,administrationofandsupervisionoverwagepaymentactivitieswithintheiradministrativeareasinaccordancewiththelaw.

OrganizationssuchasTradeUnionsandWomen’sFederationsshallsafeguardlaborers’righttolaborremunerationsinaccordancewiththelaw.

ChapterIIGeneralRegulations

Article6Theemployingunits(withexceptionoftheindividualindustrialandcommercialhouseholds)shallformulaterulesandregulationsonmattersconcerningwagedistributionandwagepaymentaccordingtolaw.Informulatingtherulesandregulations,theemployingunitshallsolicitopinionsofthecongressofstaffandworkers(workers’assembly)orthetradeunionoftheunit,makepublicannouncementaboutthematterwithinthewholeunitandmakeitknowntoalllaborersintheunit.Itshallalsoadoptreasonablesuggestionsputforthbythecongressofstaffandworkers(workers’assembly)orthetradeunion.

Article7Thewagedistributionsystemshallincludethefollowingcontents:

(1)thedistributionmethodforwagespaidforeachpost;

(2)thedistributionmethodforthenormalwageincrements;

(3)thedistributionmethodforbonuses;

(4)thedistributionmethodforallowancesandsubsidies;and

(5)thedistributionmethodforwagespaidunderspecialcircumstancessuchassickleaveorvacationleave.

Article8Thewagepaymentsystemshallspecifythefollowing:

(1)wagepayingitems,standardsandforms;

(2)wagepaymentdatesandpayperiods;

(3)standardsforcalculatingwagesofovertimework;

(4)standardsforpayingleavepays;and

(5)thecircumstancesunderwhichwagesshallbewithheldbylawandstandardsofsuchwithholdings.

Article9Theemployingunitanditsstaffandworkersasonepartyshallcarryoutnegotiationinacollectivewaytoconcludeacollectivecontractoraspecializedcollectivecontractonwageswithregardtotheworkers’annualpayadjustmentrangeanddistributionmethodfortheadjustedportion.

Article10Theemployingunitandalaborershallstipulateinthelaborcontractmattersconcerningthewagedistributionandpayingmethodwhichshallbecommensuratewithhisworkpost.Thestipulationsthusagreedbybothpartiesshallnotviolatetheexistingwagedistributionandpayingsystemoftheunit,thecollectivecontractorthespecializedcollectivecontractonwagesoftheunit.

Article11Inthecaseofpieceworkwages,theemployingunitshallfollowascientificandreasonablewaytodetermineandadjusttheworkloadandtherateofpieceworkremuneration;thedeterminedoradjustedworkloadshallbeonethatcanbecompletedbymorethan90%laborersatthesamepositionintheunitwithinthestatutoryworkinghours.

Article12Theemployingunitshallpaywagestolaborersaccordingtothestandardsspecifiedinthelaborcontractsiftheyhaverenderednormalservice.Thestandardsagreeduponinthelaborcontractsshallnotbelowerthanthelocalstandardofminimumwages.

Wherealaborerisunderanyofthefollowingspecialcircumstancesbuthasrenderednormalservice,theemployingunitshallpayhimnotlowerthanthelocalstandardofminimumwages;inthecaseofapart-timeworker,heshallbepaidnotlowerthanthelocalstandardofminimumhour-wages:

(1)withintheprobationperiod;

(2)wheretheemployingunitadvancespartofwagesorpayswagesininstallments;

(3)wheretheemployingunitdeductspartofhiswagesoftheverymonthforhisviolationoftherulesandregulationslawfullysetupbytheunit;

(4)wheretheemployingunitneedstodeducthiswagesforcompensationofeconomiclosshehascausedtotheunitinaccordancewiththetermsagreeduponinthelaborcontractortherulesandregulationslawfullysetupbytheunit;

(5)wheretheemployingunitcannotpaywagesaccordingtotheestablishedwagestandardduetodifficultiesinproductionandoperation,andhastolowerhiswagestandardafterconsultingandreachingintoagreementwiththetradeunionortherepresentativesofstaffandworkersintheunit.

Inthecaseofsub-paragraph(3)oftheprecedingparagraphs,theamountdeductedfromthelaborer’swagesoftheverymonthbytheemployingunitshallnotbemorethan20%ofthewagespayabletothelaborerfortheverymonth;inthecaseofsub-paragraph(4)oftheprecedingparagraphs,thereshallbeanexceptioniftheemployingunitandthelaborerhaveagreeduponotherwiseaftertheeconomiclossoccurs.

Thelocalstandardofminimumwagesshallbedeterminedbythepeople’sgovernmentofacitywithestablishmentofdistrictsbasedonthestandardofminimumwagespromulgatedbythepeople’sgovernmentoftheProvince;thesaidstandardofminimumwagesshallbeadjustedatleastonceeverytwoyears.

Incasethereisinconsistencybetweenthestandardsofminimumwagesoftheplacewherealaborcontractisperformedandwheretheemployingunitislocated,thestandardinfavorofthelaborershallprevail.

Article13Theemployingunitshallcalculatewagesforalaborerfromtheexactdayheactuallyperformshislabor.

Thepayperiodforwagesshallnotexceedonemonthatthelongest.Thefollowingrulesshallbeobservedindeterminingthepayperiod:

(1)Wherewagesarepaidonhourly,daily,weeklyormonthlyterm,thepayperiodcanbedeterminedbyhour,date,weekormonth;

(2)Wherewagesarepaidonyearlytermorthetermofanevaluationperiod,aportionofwagesshallbepaidinadvanceeverymonth,andthebalanceshallbesettledandpaidupattheyearendorontheexpirationoftheevaluationperiod;

(3)Wherewagesarepaidonpieceworkrateorothersimilarterms,thepayperiodcanbedeterminedaccordingtothepiecework-accomplishment;

(4)Wherewagesarepaidoncompletionofcertainworkload,thewagesshallbesettledandpaidupuponcompletionofsuchworkload.Incasethesettlingperiodexceedsonemonth,theemployingunitshalladvancewageseverymonth;

(5)Whereaconstructionenterpriseanditslaborersagreedtomakewagepaymentininstallmentsafternegotiation,theconstructionenterpriseshalladvancepartofwageseverymonth,settleandpayupwagesatleastonceeveryhalfayear,andsettleandpayupbalanceofthewagesofthepreviousyearwithinthefirsttendaysinJanuaryofthenextyear.

Article14Theemployingunitshallmakewagepaymentonthedatesasagreeduponbythelaborers;wherethereisnoagreementonsuchadate,thepaymentshallbemadeatthetimespecifiedbytheemployingunit.

Incasethepaymentdateisconcurrentwithastatutoryholidayoranoff-day,thewagesshallbepaidinadvanceintheworkingdaystherebefore.

Article15Theemployingunitshallpaywagestolaborersonlyintheformofcashinsteadofotherformssuchasgoodsorsecurities,andshallnotrequirethelaborerstoconsumeindesig
