Falcon'scaseisnotsouncommonintheUS,butitisrarearoundtheworld.About9,700Americanprisonersareservinglifesentencesforcrimestheycommittedbeforeage18.Morethanafifthhavenochanceforparole.Lifewithoutparoleisavailableforyoungcriminalsinaboutadozencountries,butarecentreportbyHumanRightsWatchandAmnestyInternationalfoundonly12youngcriminals—inIsrael,SouthAfrica,andTanzania—servingsuchsentences.IntheU.S.,morethan2,200peopleareservinglifewithoutparoleforcrimestheycommittedbeforeturning18.Morethan350are15oryounger.

Cruel&Unusual?

Youngcriminalsareservinglifeterms（withorwithoutthepossibilityofparole）inatleast48states,accordingtoasurveyby TheNewYorkTimes,andtheirnumbershaveincreasedsharplyinthepastdecade.Ofthoseimprisonedin2001,95percentweremaleand55percentwereblack.

Issuchpunishmentfairforyoungoffenders?

InMarch2005,theSupremeCourtruledthatthedeathpenaltyforcrimescommittedbypeopleunder18violatestheEighthAmendmenttotheConstitution,whichprohibits"cruelandunusualpunishments."ThatmighthavesurprisedthepeoplewhoagreedtotheAmendmentin1791,manyofwhomfoundsuchexecutionsneithercruelnorunusual.ButtheCourtsaidthatthemeaningoftheAmendmentchangeswith"evolvingstandardsofdecency."TheirdecisionhasconvincedlawyersandactiviststhatthenextlegalbattlegroundintheUSwillbeoverlifesentencesforyoungcriminals.

"Unformed"Personalities

TheSupremeCourtruledthatyouthsunder18whocommitterriblecrimesarelessblameworthythanadults,atleastforpurposesofthedeathpenalty:

Theyarelessmature,morewillingtogiveintopeerpressure,andtheirpersonalitiesareunformed."Evenaterriblecrimecommittedbyayoungperson,"JusticeAnthonyM.Kennedyconcluded,isnot"evidenceofahopelesslyevilcharacter."

MostofthoseyouthfulqualitieswereevidentinFalcon,whohadtroublefittinginatschool.Sheisinprisonformurder,meaningsheparticipatedinacrimethatledtoakillingbutwasnotprovedtohavekilledanyone.

JimAppleman,thelawyerthattriedtoputFalconinjail,saysshedoesnoteverdeservetobefree.HeisconvincedthatsheshotPhillips."Ifshewerea29-year-oldora22-year-old,"hesays,"Ihavenodoubtshewouldhavegottenthedeathpenalty."

AlthoughFalconbelieveshersentenceisunfair,shesayshereightyearsinprisonhavechangedher."AcertainamountoftimebeinginjailwaswhatIneeded,"shesays."ButthelawIfellunderisforpeoplewhohavenohopeofbeingchangedforthebetter,careercriminalswhohabituallybreakthelaw,andthere'sjustnohopefortheminsociety.I'macompletelydifferentcase."

"Thiscanbehard"

ThecaseofanotherFloridateenager,TimothyKane,showshowyouthscanbesentawayforlife,evenwhentheywerenotcentralfiguresinacrime.（Floridaisamongthestateswiththelargestnumberofyoungoffenders—about600—servinglifesentences,about270withoutparole.）

OnJan.26,1992,Kane,then14,wasplayingvideogamesatafriend'shouseinHudson,Florida,whilesomeolderboysplannedarobbery.Thatnight,fiveyouthsrodetheirbikesovertoaneighbor'shome.Twobackedout,butKanefollowedAlvinMorton,19,andBobbyGarner,17,intothehouse.Hedidnotwantotherstothinkhewasscared,herecalls."Thisisthedecisionthatshapedmylifesince,"saysKane.

Hesayshethoughtthehousewouldbeempty.ButMadelineWeisser,75,andherson,JohnBowers,55,werehome.WhileKanehidbehindadining-roomtable,MortonshotandkilledBowers.HethenstuckaknifeinWeisser'sneck;Garnersteppedontheknife,nearlycuttingoffherhead.

Mortonwassentencedtodeath.Garner,likeKane,ayoungoffender,wasgivenalifesentencewithnopossibilityofparolefor50years.Kanewasalsosentencedtolife,buthemaybeabletogetparoleafterserving25years.Hedoubtsthattheparoleboardwilleverlethimout.
