8.Commencement,DelaysandSuspension开工、延误和暂停

8.1CommencementofWorks开工

UnlessotherwisestatedintheContractAgreement:

（a）TheEmployershallgivetheContractornotlessthan7days'noticeoftheCommencementDate;and

（b）theCommencementDateshallbewithin42daysafterthedateonwhichtheContractcomesintofullforceandeffectunderSub-Clause1.6[ContractAgreement].

除非合同协议书中另有说明：

（a）雇主至少应提前7天将开工日期通知承包商，且

（b）开工日期应在合同协议书依第16款完全生效日后42天之内。

TheContractorshallcommencethedesignandexecutionoftheWorksassoonasisreasonablypracticableaftertheCommencementDate,andshallthenproceedwiththeWorkswithdueexpeditionandwithoutdelay.

在开工日期后，只要条件允许，承包商就应尽早开始设计和实施本工程，进而以合理、紧凑的速度，将工程进行下去，不使其延误。

8.2TimeforCompletion完成时间

TheContractorshallcompletethewholeoftheWorks,andeachSection（ifany）,withintheTimeforCompletionfortheWorksorSection（asthecasemaybe）,including:

（a）achievingthepassingoftheTestsonCompletion,and

（b）completingallworkwhichisstatedintheContractasbeingrequiredfortheWorksorSectiontobeconsideredtobecompletedforthepurposesoftaking-overunderSub-Clause10.1[TakingOveroftheWorksandSections].

承包商应在工程或可能的单顶工程的完成时间内，完成整个工程或视情况而定的各单项工程，包括：

（a）通过完成检验，以及

（b）完成本合同中指出，为按第10.1款接收的要求可认为工程或单项工程已完成而需要的全部工作。

8.3Programme实施计划

TheContractorshallsubmitadetailedtimeprogrammetotheEmployerwithin28daysaftertheCommencementDate.TheContractorshallalsosubmitarevisedprogrammewheneverthepreviousprogrammeisinconsistentwithactualprogressorwiththeContractor'sobligations,eachprogrammeshallinclude:

承包商应在开工日后28天内，向雇主提交—份详细的时间计划。

每当原实施计划不符合实际进展或承包商的义务时，承包商就应提交修订过的实施计划。

各实施计划都应说明：

（a）theorderinwhichtheContractorintendstocarryouttheWorks,includingtheanticipatedtimingofeachmajorstageoftheWorks,

（b）theperiodsforreviewunderSub-Clause5.2[Contractor’sDocuments],

（c）thesequenceandtimingofinspectionsandtestsspecifiedintheContract,and

（d）asupportingreportwhichincludes:

（i）ageneraldescriptionofthemethodswhichtheContractorintendstoadoptfortheexecutionofeachmajorstageoftheWorks,and

（ii）theapproximatenumberofeachclassofContractor'sPersonnelandofeachtypeofContractor'sEquipmentforeachmajorstage.

（a）承包商计划实施工程的顺序，包括每一主要阶段的预期时间安排，

（b）第5.2款要求的审核时间，

（c）本合同具体说明的各项检查和检验的顺序和时间安排，

（d）一份辅助报告，内容应有：

（i）承包商实施本工程各主要阶段拟用的方法总说明，

（ii）承包商各主要阶段所需各种级别承包商人员和各类承包商机具的大致数目。

UnlesstheEmployer,within21daysafterreceivingaprogramme,givesnoticetotheContractorstatingtheextenttowhichitdoesnotcomplywiththeContract,theContractorshallproceedinaccordancewiththeprogramme,subjecttohisotherobligationsundertheContract.TheEmployer'sPersonnelshallbeentitledtorelyupontheprogrammewhenplanningtheiractivities.

除非雇主在收到实施计划后21天内向承包商发出通知，指出不合合同要求之处，否则承包商在遵守其他合同义务的同时，仍应按照该实施计划继续工作。

雇主人员应有权根据该实施计划安排自己的活动。

TheContractorshallpromptlygivenoticetotheEmployerofspecificprobablefutureeventsorcircumstanceswhichmayadverselyaffectordelaytheexecutionoftheWorks.Inthisevent,oriftheEmployergivesnoticetotheContractorthataprogrammefails（totheextentstated）tocomplywiththeContractortobeconsistentwithactualprogressandtheContractor’sstatedintentions,theContractorshallsubmitarevisedprogrammetotheEmployerinaccordancewiththisSub-Clause.

承包商应及时将未来可能对工作造成不利影响或延误工程实施的事件或情况通知雇主。

在这种情况下，或在雇主通知承包商实施计划所指之处不符合合同要求，或者与实际进展和承包商写入通知中的意图不一致时，承包商应按照本款向雇主提交一份修改的实施计划。

8.4ExtensionofTimeforCompletion完成时间的延长

TheContractorshallbeentitledsubjecttoSub-Clause20.1[Contractor’sClaims]toanextensionoftheTimeforCompletionifandtotheextentthatcompletionforthepurposesofSub-Clause10.1[TakingOveroftheWorksandSections]isorwillbedelayedbyanyofthefollowingcauses:

如果下列任何一个原因已经或将延误第10.1款[工程和单项工程的接收]要求的完成时间，则承包商应在满足第20.1款[承包商的索赔]的要求时有权相应延长完成时间：

（a）aVariation（unlessanadjustmenttotheTimeforCompletionhasbeenagreedunderSub-Clause13.3[VariationProcedure]）,

（b）acauseofdelaygivinganentitlementtoextensionoftimeunderaSub-ClauseoftheseConditions,or

（c）anydelay,impedimentorpreventioncausedbyorattributabletotheEmployer,theEmployer'sPersonnel,ortheEmployer'sothercontractorsontheSite.

（a）变更（根据第13.3款[变更程序]经过协商调整完成时间除外），

（b）某项造成延误，进而成为根据本条件某一款要求延长时间理由的原因，或

（c）由雇主、雇主人员或现场雇主的其他承包商造成或引起的任何延误、妨碍或阻碍。

IftheContractorconsidershimselftobeentitledtoanextensionoftheTimeforCompletion,theContractorshallgivenoticetotheEmployerinaccordancewithSub-Clause20.1[Contractor’sClaims].WhendeterminingeachextensionoftimeunderSub-Clause20.1,theEmployershallreviewpreviousdeterminationsandmayincrease,butshallnotdecrease,thetotalextensionoftime.

如果承包商自认为有权要求延长完成时间，则应按照第20.1款[承包商的索赔
