OFOVERSEASCHINESE

SeventhNationalPeople'sCongressonSeptember7,1990,promulgatedby

OrderNo.33ofthePresidentofthePeople'sRepublicofChinaon

September7,1990,andeffectiveasofJanuary1,1991）

Article1

ThisLawisenactedinaccordancewiththeConstitutionwithaviewto

protectingthelawfulrightsandinterestsofreturnedoverseasChinese

andthefamilymembersofoverseasChinese.

Article2

"ReturnedoverseasChinese"denoteoverseasChinesewhohavereturnedto

thecountryandtakenitastheirplaceofpermanentresidence."Overseas

Chinese"denoteChinesecitizenswhohavesettleddownabroad.

"FamilymembersofoverseasofChinese"denotethefamilymembers,

residinginthecountry,ofoverseasChineseandreturnedoverseas

Chinese.

"ThefamilymembersofoverseasChinese"referredtointhisLawinclude

overseasChinese'sandreturnedoverseasChinese'sspouses,parents,

childrenandtheirspouses,brothersandsisters,paternalgrand-parents,

maternalgrand-parents,grand-childrenandotherrelationswhohavelong

supportedorbeensupportedbyoverseasChineseorreturnedoverseas

Chinese.

Article3

ReturnedoverseasChineseandthefamilymembersofoverseasChineseshall

beentitledtothecitizen'srightsprescribedbytheConstitutionandthe

lawandatthesametimeshallperformthecitizen'sdutiesprescribedby

theConstitutionandthelaw.Noorganizationorindividualmay

discriminateagainstthem.

Thestateshall,inaccordancewiththeactualconditionsandthe

characteristicsofreturnedoverseasChineseandthefamilymembersof

overseasChinese,givethemappropriatepreferentialtreatment,andthe

specificmeasuresthereofshallbeformulatedbytheStateCouncilorthe

relevantcompetentdepartmentsundertheStateCouncil.

Article4

ThestateshallmakearrangementsforoverseasChinesewhohavereturned

tothecountryandtakenitastheirplaceofpermanentresidence.

Article5

ReturnedoverseasChineseshallbeentitledtoappropriaterepresentation

ontheNationalPeople'sCongressandlocalpeople'scongressesinplaces

wheretherearerelativelylargenumbersofreturnedoverseasChinese.

Article6

ReturnedoverseasChineseandthefamilymembersofoverseasChineseshall

havetherighttoestablishpublicorganizationsinconformitywiththe

law,tosafeguardthelawfulrightsandinterestsofreturnedoverseas

ChineseandthefamilymembersofoverseasChineseandtoconduct

legitimatesocialactivitiessuitabletotheirneeds.Thepropertyofthe

publicorganizationsestablishedaccordingtolawbyreturnedoverseas

ChineseandthefamilymembersofoverseasChineseshallbeprotectedby

law,andshallnotbeinfringeduponbyanyorganizationsorindividuals.

Article7

Thestateshallgivesupporttoenterprisessuchasagriculturalorforest

farmswhichhaveprovidedplacementforreturnedoverseasChinese.No

organizationorindividualmayappropriatethelandlawfullyusedbysuch

enterprisesorinfringeupontheirlawfulrightsandinterests.

Enterprisessuchasagriculturalorforestfarmswhichhaveprovided

placementforreturnedoverseasChinesemay,inaccordancewiththeir

needs,setupschoolsandmedicalcareandhealthinstitutionsina

rationalway,towhichthestateshallgivesupportandaidwithrespect

topersonnel,facilitiesandfunds.

Article8

Localpeople'sgovernmentsatvariouslevelsshallsupportreturned

overseasChineseandthefamilymembersofoverseasChinesetoinvestin

theestablishmentofindustrialandcommercialenterprises,inthe

developmentofbarrenhills,wastelandsandbeaches,ortoengageinthe

agricultural,forestry,animalhusbandry,sidelineandfisheryproduction.

Theirlawfulrightsandinterestsshallbeprotectedbylaw.

Article9

People'sgovernmentsatvariouslevelsshallsupportreturnedoverseas

ChineseandthefamilymembersofoverseasChinesetosetuppublic

welfareestablishmentsinthecountry.Theirlawfulrightsandinterests

shallbeprotectedbylaw.ReturnedoverseasChineseandthefamily

membersofoverseasChinesewhoreceivematerialsfromdonations

voluntarilymadebytheirrelativesandfriendsoutsidethecountryand

willusetheminpublicwelfareundertakingsshall,inaccordancewith

relevantstateregulations,dealwiththeacceptanceandenjoy

preferentialtreatmentofdutyreductionorexemption.

Article10

Thestateshall,inaccordancewiththelaw,protecttheownershipof

privatehouses,inthecountry,ofreturnedoverseasChineseandthe

familymembersofoverseasChinese.Constructionunitsshall,in

accordancewiththerelevantstateregulations,makeduecompensationand

appropriatearrangementsforthosereturnedoverseasChineseandthe

familymembersofoverseasChinesewhoseprivatehousesarerequisitioned,

dismantledorremovedaccordingtolawforstateconstruction.

Article11

StudentswhoarereturnedoverseasChinese,childrenofreturnedoverseas

Chineseandchildren,residinginthecountry,ofoverseasChinese,shall,

inaccordancewithrelevantstateregulations,begivenspecial

considerationsinrespectofschooladmissionandemployment.

Article12

ThestateshallprotecttheincomeofreturnedoverseasChineseandthe

familymembersofoverseasChinesefromremittancesentbyoverseas

Chinese.

Article13

ReturnedoverseasChineseandthefamilymembersofoverseasChineseshall

havetherighttoinheritoraccepttheestate,legacyordonationfrom

theirrelativesorfriendsoutsidethecountry.

ReturnedoverseasChineseandthefamilymembersofoverseasChineseshall

havetherighttodisposeoftheirpropertyoutsidethecountry.

Article14

ContactsandcommunicationsbetweenreturnedoverseasChineseandthe

familymembersofoverseasChineseandtheirrelativesandfriendsoutside

thecountryshallbeprotectedbylaw.

Article15

ApplicationsforexitfromthecountrybyreturnedoverseasChineseand

thefamilymembersofoverseasChineseshallbeexaminedforapprovalby

thecompetentauthoritiesconcernedwithintheprescribedtimelimit.

ForreturnedoverseasChineseandthefamilymembersofoverseasChinese

whodesiretoleavethecountryurgentlybecauseofspecialcircumstances

suchascriticalillness（es）ordeath（s）oftheirdirectlinealrelatives

ortheneedfordispositionofpropertyoutsidethecountrywithina

prescribedtimelimit,thecompetentauthoritiesconcernedshallgive

examinationforapprovalwithoutdelayonthebasisofvalidcertificates

providedbytheapplicants.

Article16

ThestateshallsafeguardtherightofreturnedoverseasChineseandthe

familymembersofoverseasChinesetoleavethecountryforthepurposeof

visitingtheirrelatives.ReturnedoverseasChineseandthefamily

membersofoverseasChinesewhoworkinstateorgansorstate-owned

enterprisesandinstitutionsshallenjoythetreatmentasprovidedinthe

relevantstateregulationsinrespectofleavingthecountryforthe

purposeofvisitingtheirrelatives.

Article17

ReturnedoverseasChineseandthefamilymembersofoverseasChineseshall

havetherighttoleavethecountryandsettledownabroad.

ReturnedoverseasChineseandthefamilymembersofoverseasChinesewho

lefttheirpostsasveterancadres,retiredorquittedtheirpostsfor

justifiedreasonsshallcontinuetoreceivetheirpensionsafterleaving

thecountryforsettingdownabroad.

Article18

ReturnedoverseasChineseandthefamilymembersofoverseasChinesewho

applytogoabroadforthepurposeofstudyattheirownexpenseshallbe

givenpreferentialtreatmentinaccordancewiththerelevantstate

regulations.

Article19

Thestateshallprotectthelegitimaterightsandinterests,outsidethe

country,ofreturnedoverseasChineseandthefamilymembersofoverseas

Chineseinaccordancewiththeinternationaltreatiestowhichthe

People'sRepublicofChinaisapartyorhasaccededorwithinternational

practice.

Article20

ReturnedoverseasChineseandthefamilymembersofoverseasChinese

shall,wheretheirlawfulrightsandinterestsareviolated,havethe

righttorequesttherelevantcompetentdepartmentstohandlethematter

inaccordancewiththelaw,or,bringasuitinapeople'scourtaccording

tolaw.

Article21

TheStateCouncilshall,onthebasisofthisLaw,formulatemeasuresfor

itsimplementation.

Thestandingcommitteesofthepeople'scongressesoftheprovinces,

autonomousregionsandmunicipalitiesdirectlyundertheCentral

Governmentmay,pursuanttothisLawandtheStateCouncil'smeasuresfor

implementation,formulatemeasuresforimplementationrespectively.

Article22

ThisLawshallenterintoforceasofJanuary1,1991.
