GeneralProvisions

Article1ThisLawisenactedinaccordancewiththeConstitutiontostandardizetheinstitutionoftheprocedurefor,andthegrantingof,administrativepermission,toprotectthelegitimaterightsandinterestsofcitizens,legalpersonsandotherorganizations,tosafeguardpublicinterestsandmaintainpublicorder,andtoensureandsupervisetheeffectiveexerciseofadministrationbyadministrativedepartments.

Article2ForpurposesofthisLaw,administrativepermissionmeansapprovalgiventocitizens,legalpersonsandotherorganizationsforengaginginspecialactivitiesbyadministrativedepartmentsonthebasis,anduponexaminationaccordingtolaw,oftheirapplications.

Article3ThisLawisapplicabletotheinstitutionoftheprocedurefor,andthegrantingof,administrativepermission.

ThisLawisnotapplicabletotheexaminationandapprovalbytherelevantadministrativedepartmentsofsuchmattersaspersonnel,financialandforeign-relatedaffairsofotherdepartmentsoroftheinstitutionsdirectlyundertheadministrationofthesaiddepartments.

Article4Theprocedureforadministrativepermissionshallbeinstitutedandadministrativepermissionshallbegrantedinaccordancewiththestatutorylimitsofpower,scope,requirementsandprocedures.

Article5Theprocedureforadministrativepermissionshallbeinstitutedandadministrativepermissionshallbegrantedinadherencetotheprinciplesofopenness,fairnessandimpartiality.

Provisionsonadministrativepermissionshallbepromulgated;andnoprovisionsthatarenotpromulgatedshallbemadethebasisforthegrantingofadministrativepermission.ThegrantingandoutcomeofadministrativepermissionshallbepublicizedexceptwhereStatesecrets,businesssecretsandindividualprivacyareinvolved.

Theapplicantswhomeetthestatutoryrequirementsandstandardsshallhavetheequalrighttoobtainadministrativepermissionaccordingtolaw,andadministrativedepartmentsshallnotdiscriminateagainstanyofthem.

Article6Administrativepermissionshallbegrantedinadherencetotheprincipleofmeetingtheconvenienceofpeoplewithgreaterefficiencyandfineservice.

Article7Withregardtothegrantingofadministrativepermissionbyadministrativedepartments,citizens,legalpersonsandotherorganizationsshallhavetherighttomaketheirstatementsandarguetheircases;theyshallhavetheright,inaccordancewithlaw,toapplyforadministrativereconsiderationorbringanadministrativesuit;andtheyshallhavetherighttodemandcompensationaccordingtolawiftheirlegitimaterightsandinterestsaredamagedduetotheunlawfulgrantingofadministrativepermissionbyadministrativedepartments.

Article8Administrativepermissionobtainedaccordingtolawbycitizens,legalpersonsorotherorganizationsshallbeprotectedbylaw.Noadministrativedepartmentsshall,withoutauthorization,changetheadministrativepermissionalreadyineffect.

Wherethelaws,regulationsorrules,onthebasisofwhichadministrativepermissionisgranted,havebeenrevisedorabolished,ormajorchargeshaveoccurredintheobjectivecircumstances,onthebasisofwhichadministrativepermissionisapproved,administrativedepartmentsmay,fortheneedofpublicinterestsandinaccordancewithlaw,alterorrevoketheadministrativepermissionalreadyineffect.Where,asaconsequence,lossesarecausedtothepropertyofcitizens,legalpersonsorotherorganizations,administrativedepartmentsshallmakethemcompensationsaccordingtolaw.

Article9Administrativepermissionobtainedaccordingtolawshallnotbetransferredexceptwherelawsandregulationsprovidethatitmaybetransferredaccordingtostatutoryrequirementsandprocedures.

Article10People'sgovernmentsatorabovethecountylevelshallestablishasoundsystemtosupervisethegrantingofadministrativepermissionbyadministrativedepartmentsandexercisestrictsupervisionoverandinspectionofthegrantingofsuchpermissionbythesaiddepartments.

Administrativedepartmentsshallcarryouteffectivesupervisionovertheactivitiesengagedinbycitizens,legalpersonsandotherorganizations,towhichadministrativepermissionisgranted.

ChapterII

InstitutionoftheProcedureforAdministrativePermission

Article11Theprocedureforadministrativepermissionshallbeinstitutedinadherencetothelawsgoverningeconomicandsocialdevelopmentandforthebenefitofbringingintofullplaytheenthusiasmandinitiativeofcitizens,legalpersonsandotherorganizations,safeguardingpublicinterests,maintainingpublicorderandpromotingtheharmoniousdevelopmentoftheeconomy,societyandtheecologicalenvironment.

Article12Theprocedureforadministrativepermissionmaybeinstitutedforthefollowingmatters:

(1)mattersrelatingtothespecialactivitiesthatdirectlyinvolveStatesecurity,macro-economiccontrolandprotectionoftheecologicalenvironmentandthathaveadirectbearingonhumanhealthandthesafetyofpeople'slivesandproperty,whicharesubjecttoapprovalinaccordancewiththestatutoryrequirements;

(2)mattersrelatingtothedevelopmentandutilizationoflimitednaturalresources,theallocationofpublicresourcesaswellasaccesstothemarketofthespecialtradesthathaveadirectbearingonpublicinterests,etc.,towhichspecialrightsneedtobegranted;

(3)mattersrelatingtotheprofessionsandtradesthatprovideservicestothepublicandthathaveadirectbearingonpublicinterests,thequalificationsandcompetencetobepossessedbywhich,suchasthespecialcredibility,conditionsandskills,needtobeaffirmed;

(4)mattersrelatingtotheimportantequipment,facilities,productsandarticlesthathaveadirectbearingonpublicsecurity,humanhealth,andthesafetyofpeople'slivesandproperty,whichneedtobeverifiedbymeansofinspection,test,quarantine,etc.andinaccordancewithtechnicalstandardsandspecifications;

(5)mattersrelatingtotheestablishmentofanenterpriseorotherorganization,thecapacityofwhichasasubjectneedstobeaffirmed;and

(6)othermattersforwhichtheprocedureforadministrativepermissionmaybeinstituted,asprovidedforbylawsandadministrativeregulations.

Article13ForthemattersspecifiedinArticle12ofthisLawwhichcanberegulatedbythefollowingmeans,institutionoftheprocedureforadministrativepermissionmaybeexempted:

(1)mattersonwhichcitizens,legalpersonsandotherorganizationscanmakedecisionsthemselves;

(2)matterswhichcaneffectivelyberegulatedbythecompetitivemechanismofthemarket;

(3)matterswhichtheorganizationsoftradesorintermediarybodiescanmanagethroughself-discipline;and

(4)matterswhichadministrativedepartmentscansolvebyotheradministrativemeanssuchassupervisionafterwards.

Article14WithrespecttothemattersspecifiedinArticle12ofthisLaw,theprocedureforadministrativepermissionmaybeinstitutedbylaw.Wheresuchalawisnotenacted,itmaybeinstitutedbyadministrativeregulations.

Whennecessary,theStateCouncilmayinstitutetheprocedureforadministrativepermissionbymeansofpromulgatingdecisions.Afterimplementationofsuchdecisions,theStateCouncilshall,exceptformatterstowhichprovisionaladministrativepermissionisgranted,withoutdelayrequesttheNationalPeople'sCongressoritsStandingCommitteetoenactlaws,orformulateadministrativeregulationsitself.

Article15WherelawsoradministrativeregulationsonthemattersspecifiedinArticle12ofthisLawarenotformulated,theprocedureforadministrativepermissionforthemmaybeinstitutedbylocalregulations;whereneitherlawsandadministrativeregulationsnorlocalregulationsareformulated,andwhereitisreallynecessaryforadministrativepermissiontobegranteddirectlyfortheneedofadministration,thepeople'sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentmayinstituteprovisionalprocedureforadministrativepermissionintheformofrules.Whereitisnecessarytocontinuegrantingsuchprovisionaladministrativepermissionattheexpirationofawholeyear,thesaidgovernmentsshallrequestthepeople'scongressesortheirstandingcommitteesatthecorrespondinglevelstoformulatelocalregulations.

Noprocedureforadministrativepermissioninrespectofthequalificationsandcompetenceofcitizens,legalpersonsandotherorganizations,whicharetobeaffirmedbytheStateinaunifiedmanner,maybeinstitutedintheformoflocalregulationsorrulesofthepeople'sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment;norshalltheprocedureforadministrativepermissioninrespectofthesetting
