DetailedRulesfortheImplementationoftheMeasuresfortheAdministrationofIndividualForeignExchangeChapter1GeneralProvisionsArticle1TheseDetailedRulesareformulatedinaccordancewiththeMeasuresfortheAdministrationofIndividualForeignExchangeforthepurposeofstandardizingandfacilitatingtheforeignexchangeoperationsofbanksandindividuals.Article2Managementofantotalannualquotashallbeapplicabletoindividualsalesofforeignexchangeanddomesticindividualpurchasesofforeignexchange.ThetotalannualquotaisequivalenttoUSD50,000perpersoneachyear.TheSAFEisempoweredtoadjustthetotalannualquotainaccordancewiththebalanceofpaymentposition.Foreignexchangesalesandpurchaseswithinthetotalannualquotashallbedealtwithatthebanksuponthestrengthofvalidpersonalidentitycertificates.Whentheamountofforeignexchangesalesandpurchasesexceedsthetotalannualquota,thoseunderthecurrentaccountshallbedealtwithinaccordancewithArticles10,11,and12oftheseDetailedRules,andthoseunderthecapitalaccountshallbedealtwithinaccordancewiththerelevantprovisionsoftheseDetailedRulesonthe"AdministrationofIndividualForeignExchangeundertheCapitalAccount."Article3Foreignexchangepurchasedbyanindividualmayberemittedabroad,depositedinhis/herforeignexchangesavingsaccount,orcarriedacrosstheborderinaccordancewiththerelevantprovisions.Article4Whentheamountofindividualforeignexchangepurchasesandsalesiswithinthetotalannualtotal,theindividualmayentrusthis/herimmediatefamilymemberstodealwiththebusiness;whentheamountofindividualforeignexchangepurchasesandsalesoroverseasindividualpurchasesofforeignexchangeexceedsthetotalannualquota,theindividualmayentrustotherstodealwiththebusinessuponthestrengthoftherelatedsupportingdocumentsinaccordancewiththeprovisionsintheseDetailedRules.Article5Incaseswhenanindividualcarriesforeigncashacrosstheborder,he/sheshallobeytherelevantadministrativeprovisionsoftheState.Article6Alldesignatedforeignexchangebanks（hereinafterreferredtoas󰀀banks󰀀）shallexamineandverifytheauthenticityofindividualforeignexchangetransactionsinaccordancewiththeprovisionsoftheseDetailedRules.Anyforgedoralteredtransactionsareprohibited.Thebanksshallprocessthetransactionsofindividualforeignexchangepurchasesandsalesthroughthemanagementinformationsystemforindividualsalesandpurchasesofforeignexchange（hereinafterreferredtoasthe󰀀systemforindividualsalesandpurchasesofforeignexchange󰀀）,andshallinputtherelevantinformationtruthfully,accurately,andcompletely.Article7TheSAFEanditsbranches/sub-branches（hereinafterreferredtoas󰀀foreignexchangebureaus󰀀）shallberesponsibleforcollectingthestatisticaldata,supervising,managing,andinspectingtheindividualforeignexchangebusinesses.Chapter2AdministrationofIndividualForeignExchangeundertheCurrentAccountArticle8Individualforeignexchangereceiptsandpaymentsunderthecurrentaccountareclassifiedintobusiness-basedforeignexchangereceiptsandpaymentsandnon-business-basedforeignexchangereceiptsandpayments.Article9Individualbusiness-basedforeignexchangereceiptsandpaymentsunderthecurrentaccountshallbehandledinaccordancewiththefollowingprovisions:

（1）Anindividualforeigntradebusinesspersonshallhandlethepurchase,payment,collection,andsaleofforeignexchangeunderforeigntradethroughhis/herforeignexchangesettlementaccount;andhis/herforeignexchangereceiptsandpayments,verificationsforimportsandexports,anddeclarationsonthebalanceofpaymentsshallbehandledinlinewiththeformalitiesapplicabletoinstitutions.󰀀Anindividualforeigntradebusinessperson󰀀referstoanindividualengaginginforeigntradebusinessactivitieswhohasattendedtotheformalitiesofregisteringattheadministrativedepartmentforindustryandcommerceortheotherbusinessformalitiesaccordingtolaw,hasobtainedabusinesslicenseorothercertificatesforbusinessoperations,hashandledtherecordingformalitiesforregistration,andobtainedtheforeigntraderightinaccordancewiththeprovisionsofthecommerceadministrativedepartmentoftheStateCouncil.

（2）Whenaprivatebusinesspersonentrustsanyenterprisewithforeigntraderightstohandletheimportbusiness,he/sheshallpurchaseforeignexchangebyhimself/herselfuponthestrengthoftheimportagentcontractortheagreementsignedwiththeentrustedenterprise.Thepurchasedforeignexchangeshallbetransferreddirectlyfromhis/herforeignexchangesettlementaccounttotheforeignexchangeaccountunderthecurrentaccountheldbytheentrustedenterprise.Whenaprivatebusinesspersonentrustsanyenterprisewithforeigntraderightstohandletheexportbusiness,he/shemaydealwithforeignexchangecollectionsandsalesthroughhis/herownforeignexchangesettlementaccount.Salesofforeignexchangeshallbehandleduponthestrengthoftheexportagentcontractortheagreementsignedwiththeentrustedenterpriseandthecustomsexportdeclarationformsoftheentrustedenterprise.Afterfilingatthelocalforeignexchangebureautheprivatebusinessperson󰀀snameandaccountnumbersaswellasotherdocumentsprescribedfortheverification,theentrustedenterprisemayusetheprivatebusinessperson󰀀snoticeofcollectionasthesupportingdocumentforverification.（3）Anoverseasindividualshallhandlethesaleofforeignexchangeunderthetradeitemsoftourismandshoppinguponthestrengthofhis/hervalididentitycertificateandthecustomsdeclarationformforindividualtourismandshopping.Article10Whenadomesticindividual’snon-business-basedforeignexchangesalesunderthecurrentaccountexceedthetotalannualquota,he/sheshallhandlethebusinessatthebanksuponthestrengthofhis/hervalididentifycertificateandthefollowingsupportingdocuments:

（1）Fordonations:

anotarizedagreementordonationcontract.ThedonationsshallcomplywiththerelevantprovisionsoftheState;

（2）Foralimony:

evidenceoftherelationshipoftheimmediatefamilymemberoranotarizeddocumentforalimonypayment,andproofofrevenueoftheoverseaspayer,suchasbankstatementsorindividualtaxreturns;（3）Forinheritanceincome:

legalornotarizeddocumentofinheritance;（4）Forinsurancepayments:

insurancepolicyandproofofpaymentfromtheoperatinginsuranceinstitution.PurchasesofinsurancepoliciesinforeignexchangeshallmeettherelevantprovisionsoftheState;（5）Forpatentandroyaltyincome:

proofofpayment,agreement,orcontract;（6）Forlegal,accounting,consulting,andpublicrelationservicesincome:

proofofpayment,agreement,orcontract;（7）Foremploymentcompensation:

contractofemploymentandevidenceofincome;（8）Forproceedsfromoverseasinvestment:

foreignexchangeregistrationcertificateofoverseasinvestment,resolutionofprofitdistributionordividendpayments,orevidenceofotherincome;（9）Forother:

relevantevidenceandpaymentvouchers.Article11Whenanoverseasindividual’snon-business-basedforeignexchangesalesunderthecurrentaccountexceedthetotalannualquota,he/sheshallhandlethebusinessatthebanksuponthestrengthofhis/hervalididentitycertificateandthefollowingsupportingdocuments:

（1）Forrentexpenditures:

leaseregisteredatthehousingauthority,invoiceornoticeofpayment;

（2）Forlivingexpenses:

relevantcontractorinvoices;（3）Formedicalexpenses,tuition,andrelatedexpenses:

receiptsfromdomestichospitals（schools）;（4）Forother:

relevantevidenceandpaymentvouchers.WhentheamountofasingleforeignexchangesaleisequivalenttoUSD50,000ormore,theindividualshalldirectlytransfertherenminbicapitalgainedfromthesaleofforeignexchangeintothedomesticrenminbiaccountheldbythecounterpartyofthetransaction.Article12Whenadomesticindividual’snon-business-basedforeignexchangepurchasesunderthecurrentaccountexceedthetotalannualquota,he/sheshallhandlethebusinessatthebanksuponthestrengthofhis/hervalididentitycertificateandtherelevantsupportingdocumentsindicatingthetransactionamount.Article13Whenanoverseasindividualpurchasesforeignexchangewithhis/herlawfulrenminbiincomeunderthecurrentaccountandexchangestheun-usedpartofthepurchasedrenminbibackintoforeignexchange,he/sheshallhandleitinaccordancewiththefollowingprovisions:

（1）Forforeignexchangepurchaseswithlawfulrenminbiincomeunderthecurrentaccountobtaineddomestically,theindividualshallhandleituponthestrengthofhis/hervalididentitycertificateandrelevantsupportingdocuments（includingtaxreturns）indicatingthetransactionamount.

（2）Forexchangesoftheun-usedpartofpurchasedrenminbibackintoforeignexchange,theindividualshallhandleituponthestrengthofhis/hervalididentitycertificateandtheoriginalexchangememo,andthelattershallbevalidfor24monthsfromthedateoftheexchange;incaseswhenthetotaldailyamountisnotmorethanandincludingtheequivalentofUSD500（orUSD1000iftheexchangeismadewithintheboundariesbutoutsideofthecustomssupervisionzonebeforehe/sheleavesthecountry）,theindividualmayhandleitsolelyuponthestrengthofhis/hervalididentitycertificate.Article14Incaseswhenadomesticindividualremitsforeignexchangeoverseasforexpensesunderthecurrentaccount,he/sheshallhandleitinaccordancewiththefollowingprovisions:
