建筑施工企业噪声超标排污费收费标准
一、 建筑施工噪声超标排污费的征收对象
建筑施工噪声超标排污费的征收对象，亦即建筑施工噪声超标排污费的缴纳义务人，应当是在建筑施工中因使用机械设备产生并向周围生活环境超过标准排放噪声的建筑施工单位。
二、 建筑施工噪声超标排污费核定的标准
以《建筑施工场界噪声限值》（GB12523-90）标准作为征收噪声超标排污费的依据。
建筑施工噪声排放超过《建筑施工厂界噪声限值》的，应征收噪声超标排污费。
三、 建筑施工超标噪声排污费的征收标准

说明：
1.一个单位边界上有多处噪声超标，征收额应根据最高一处超标声级计算，当沿边界长度超过100米有二处及二处以上噪声超标，则加1倍征收。
2.一个单位若有不同地点的作业场所，收费应分别计算，合并征收。
3.昼、夜均超标的环境噪声，征收金额按本标准昼、夜分别计算，累计征收。
4.声源一个月内超标不足十五天的，噪声超标排污费减半征收。
5.夜间频繁突发和夜间偶然突发厂界超标噪声排污费，按等效声级和峰值噪声两种指标中超标分贝值高的一项计算排污费
6.一个工地同一施工单位多个建筑施工阶段同时进行时，按噪声限制最高的施工阶段计收超标噪声排污费。
7.本标准以分贝为计征单位，不足一分贝的按四舍五入原则计算。
8.对农民自建住宅不得征收噪声超标排污费。
四、排污申报登记
根据《环境噪声污染防治条例》第二十三条的规定：
建筑施工排放噪声可能超过建筑施工场界噪声限值的，施工单位和个人应在工程开工前十五日内向对该项目具有审批权的环境保护部门提出申报，说明工程项目名称、建筑施工场所和施工期限、可能排放到建筑施工场界的环境噪声强度和拟采用的防治措施。
排污申报登记后，排污情况发生变更的，应在变更前15日履行变更申报手续，填报《排污变更登记表》。
不按规定申报登记的，按环境监察部门核定数据征收。
五、 建筑施工超标噪声排污费的核定
环境监察部门根据审核后的《建筑施工排放污染物申报表》和按优先次序根据委托监测数据、监督性监测数据、类比测算数据等多种途径核定排污者实际排污情况，并根据国家《排污费征收标准及计算方法》计算排污者应缴纳的排污费数额，向排污者送达《排污核定通知书》。
排污者如对核定的污染物排放种类、数量和应缴纳的排污费数额有异议的，自接到《排污核定通知书》之日起7日内，可以向发出通知的环境监察部门申请复核；环境监察部门应当自接到复核申请之日起10日内，作出复核决定，并通知申请人。
建筑施工单位既有委托监测数据，也有监督性监测数据的，以噪声分贝值高的数据为准。
委托监测数据以市环境监测中心站或其他有资质的监测机构出具的《环境（噪声）监测报告》为准。
监督性监测由环境监察部门工作人员进行监测，施工单位工作人员确认。

说明：
1.此表根据《建筑施工场界环境噪声排放标准及测量方法》编制说明和有关监测技术规范实地监测、汇总、统计、计算而编制而制成。
2.由于声源之间存在屏蔽现象，各施工阶段的场界噪声按分贝值高的单项声源设备查找。
表中所列声源为我市常用型号的机械设备，本表未列有的，以实际监测数据为依据。
六、建筑施工噪声超标排污费的计算
噪声超标排污费=建筑施工时产生的噪声超标分贝数所对应的收费标准（元/月）×施工时间（月）
噪声超标分贝数=监测数据或类比数据-场界限值
夜间频繁或偶然突发噪声峰值噪声超标分贝数=
峰值噪声－（施工场界噪声限值+15dB）
七、 其他规定
1. 同一收费时段内有多个监督性监测数据的，取最高值作为收费依据。
2.施工单位完成工程后，退场前需向环保部门提交完工报告（结构阶段的施工单位在主体结构封顶后提交），由工作人员到现场核实经审核确认，环保部门停止征收该施工单位噪声超标排污费。
八、 违法责任
1. 施工单位未按规定的时间和内容填报《建筑施工排放污染物申报登记表》或者已申报的内容发生重大改变而未按规定的时间重新申报的，视为拒报；申报的内容与实际状况明显不符的，视为虚报。
对拒报、虚报噪声排污事项的，可根据《深圳经济特区环境噪声污染防治条例》第四十一条的规定，处以二千元以上一万元以下罚款。
2. 施工单位未按规定缴纳排污费的，根据《排污费征收使用管理条例》第二十一条和《深圳经济特区环境噪声污染防治条例》第四十一条的规定，将依法责令限期缴纳；逾期拒不缴纳的，处应缴排污费数额1倍以上3倍以下的罚款。
逾期缴费，每日按应缴排污费数额的千分之一计征滞纳金。
