Marriageisunificationinwedlockconcerningbothparty’srightandresponsibilityvoluntarilyarrangedbymenandwomenforthepurposeoflivingtogetherpermanently.Inordertolivetogetherhappilyandsatisfactorily,mutuallysupportingisneededtoguaranteetheaffluenceofphysicallifeandmutualchastitytosupportthefelicitousnessofthespirituallife.Therefore,mutualchastityisamajorfactortosupportthewedlock,whichisalsoafocusofmarriagelaw.Duringtherevisionofmarriagelawin2001,thedebateovertheresponsibilityofmutualchastitywasthemostappealingissue.Afterintensearguing,finallythearticle“thespousesshallmaintainmutualchastity”waslistedintherevisedmarriagelaw.Howevertheargumentovermutualchastityofthespouseshasneverstopped,moreissuesconcerningitarestillneededtobefurtherstudied.Thethesistriestoinvestigateandreviewthemutualresponsibilityofconjugalchastitysystematically.Inordertostudythesubjectsystematically,thehistorical,sociological,comparativelaw,empirical,dynamicandstaticanalysisapproachesbywhichthehistoricaldevelopmentofconjugalchastity、jurisprudentialanalysisofitandpresentregulationonitareobservedandreviewed,areemployedintheresearch.Thethesisconsistsoffourchapters.ChapterⅠ,whichiscomposedofthreesubchapters,observesthemutualresponsibilityofconjugalchastityfromtheperspectiveofitshistoricaldevelopment.InSubchapterⅠexplainstheexactconnotationofchastityandascertainsthedefinitemeaningofresponsibilityofconjugalchastityfurther.Thebasicmeaningofchastityisloyaltoeachother,whichconnotesthatthehusbandandwifeshouldbefaithfultooneanothernotonlyintheiractsbutalsoinmentalcommunicationaswell.

However,thementalcommunicationisnottheregulatingtargetoflaw,thustheconjugalchastityonlydenotesmutualloyaltyintheirsexuallifeanddeniesextramaritalsexfromtheangleofmarriagelaw.InSubchapterⅡ,theauthorobservesandstudiestheawarenessandresponsibilityofconjugalchastityundertheprimitive、slavery、feudalandthecontemporarysocietyirrespectively.AfterthattheauthorhascommentedonthechangesofattitudestowardstheconjugalchastityintheChinesemaritallegislation.Duringtheinvestigationintotheconjugalchastityintheprolongedhistory,theauthorfoundthattheregulationonresponsibilityoftheconjugalchastitywasimpliedbytwomajorline,thatis,theevolutionfrominequalitybetweenmenandwomentotheequalitybetweentheboth;andtheregulationonitthroughstatutoryremedybyprivaterightinsteadoftheinterferencebypublicpower.Simultaneously,thelinkagebetweenthedevelopment,evolutionofmutualresponsibilityofconjugalchastityandthoseofhumanmarriagelifeandthechangesoftheviewpointsonconjugalrelations,sexualmoralityandsexawarenessaredeeplyconnected.InSubchapterⅢ,theauthormainlyobservestheinfluenceofthechangesofconjugallove,attitudestowardsfamilyandsexupontheviewpointoverconjugalchastityincontemporaryChina.Asthewheelsofhistoryrollson,thehuman’sviewpointoverthesexualmoralityandsexawarenesshasbeenchangingallthetime.Astheinflationofindividualismandliberalisminmostcapitalistcountries,thepreviousexclusiveloveattitudeshasbeenreplacedbythenon-interferenceofmutualfreedom.Atthesametimetheviewpointsofthejudicialcircleandjudicaturehavechangedmoreorlessbythecontemporarythought,thereforethestrictrulehasbeenloosened.Accordingtothepreviousresearch,theauthorclaimsthatwhenwerestructuresthemutualresponsibilityofconjugalchastityinmarriagelegislationinourcountry,thechangesofcontemporaryconjugallove,attitudestowardsfamilyandsexshouldbeinvestigatedandtakenintoaccount.InthefollowingparttheauthorhaslookedintothechangesinpresentChinaindetail,andsomepersonalopinionstothemarealsoreleased.

Onthebasisofthestudyabove,theauthorholdsthattheresponsibilityofconjugalchastityiscloselyrelatedwithconjugalrelationship,inregardtotheinfluenceofawarenessofconjugallove、familyandsexupontheresponsibilityofconjugalchastity,twoaspectsshouldbeconsidered,thatis,ontheonehand,thechangesshouldnotbeignored,inthedesignofresponsibilityofconjugalchastity,theoldroutetorecovertheadulterylawandpunishtheadulterershadbeendiscardedbytheAge,andpublicpowerexploitedinthepunishmentofextramaritalsexshouldbecautious;Ontheotherhand,thechangesofviewpointstomarriageandfamilyupontheconjugallovehaveneverunderminedthestablecornerstoneoffamilystructureintheChinesesocietythatisbecausethevaluesofmaritalmoralityunderthebackgroundofConfucianculturehavealwaysbeensupportingtheChinesemarriagefirmly.Somesocialsurveysshowthatthesexconcerningextramaritalsex,especiallythathasgravelyunderminedthestabilityoffamilies,theattitudesofourpeopleareclear,i.e.,theyopposetheextramaritalsex.Inthewesterncountries,whereas,afterthedisastrousexperimentof“sexrevolution”,theslogansof“returningfamily”and“faithfulnessisfundamentaltoconjugallove”arebacktobereused.Thuswritingtheresponsibilityofconjugalchastityintolawcanbeconsideredthepromotionoffaithfulnessinconjugallove,thatistheinnervoicesofthepeopleathomeandabroad.Chinashouldgetintegratedintotheworldtrend,learnfromthelessonsofforeigncountriesandnotrecovertheoldwayof“seriousresultsgettingfromexcessivefreedomofsex”intheWest,thusourmarriagelawcanbemadeasanewsymbolofoursocialistmarriageandfamily.ChapterⅡ,consistingofthreesubchapters,isthejurisprudentialanalysisoverresponsibilityofconjugalchastity.AtthebeginningofSubchapterⅠ,theauthorholdsthattheresponsibilityofconjugalchastityistheessenceofmarriage.Theresponsibilityofconjugalchastityisthenaturaldemandofmarriage,whichisalsoanembodimentoftheexclusivityofconjugalsexandthedemandofsocialnatureofmarriage.Inoursocialistsociety,monogamyistherequisitedemandoftheresponsibilityofconjugalchastity,whichisavigoroussafeguardofmonogamyaswell.Then,theauthoranalysesthejuristicvalueoftheentryofresponsibilityofconjugalchastityintolaw,themajorreasonofwhichisthattheresponsibilityofconjugalchastityisalwaysconsideredasagoodvirtue.

Thesafeguardofresponsibilityofconjugalchastity,inessence,couldberegardedastheprotectionandpromotionofjusticebynation.Theresponsibilityofconjugalchastityembodiesthehumanisticsolicitudeoflaw.Thehumanisticsolicitudetowardsresponsibilityofconjugalchastityissuchapropositionessentially,thatis,theregulationandboundofthemaritallifeofpeoplebylawistoleadthemtoliveasafe、happyandsatisfactorymaritallife,whichcanconnecttheindividualityofmanwiththesocialnatureofmanintrinsically;Therefore,certainharmoniesfromtheequilibriumofinterestsbetweenindividualsandsocietymaybereached,andthevalueofmancanbeelevated.SubchapterⅡmainlyobservesandreviewsthejuristicidentificationofthenatureofresponsibilityofconjugalchastity.Atfirst,theauthorholdsthattheresponsibilityofconjugalchastityisaderivativerightofspouse’sright,whichisabasicrightofdignitybetweenthehusbandandwifeformulatedbylaw.Themaintenanceofwedlockisbasedontwoelementaryconditions,thatis,theresponsibilityofcohabitationandbeingloyaltoeachother.Thereforetheresponsibilityofconjugalchastity,aderivativerightfromthespouse’sright,becomesthecoreofspouse’sright.Andthecharacteristicsoftheresponsibilityofconjugalchastityaregeneralizedindetailthereinafter.Inthefollowingpartofthissubchapter,theauthorconcludesthattheresponsibilityofconjugalchastityinevitablyhasthenatureofrightofpersonality.Thoughtheresponsibilityofconjugalchastityhasdualnaturesofrightofpersonalityandrightofdignity,theyshouldbedistinguished.
