CONTRACT

1.PartyA’sResponsibilities

1）.PartyAshouldofferPartyBnecessaryworkingequipment.

2）.PartyAshallintroducetoPartyBthelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandregulationsconcerningtheadministrationofforeignteachers.

3）.PartyAshallconductdirection,supervisionandevaluationofPartyB’swork.

4）.PartyAshallpayPartyBthemonthlysalaryonthe5thofeverymonth,andifanyunexpectedaccidentshappen（i.e.theproblemswiththebank）,PartyAshallinformPartyBinadvance.

2.PartyB’sResponsibilities

1）.PartyBshallobservethelaws,decreesandrelevantregulationsenactedbytheChinesegovernmentandshallnotinterfereinChina’sinternalaffairs.

2）.Duringthetermofthecontract,PartBshallnotbeemployedbyanythirdpartywithoutwrittenconsentofPartyA.Inthecasethattheforegoingisviolated,PartyAshallterminatethiscontract.PartyBshallbebilledfortheeconomiclossincurredbyPartyA,aspenalty.

3）.Teachinghoursarenomorethan85hourspermonth.PartyBwillhavenomorethan30officehourspermonth.PartyBwillhavetwodaysoffperweek.PartyBshallbeavailableduringdaysoffforsomeemergencies,andwhensometeachersareill,PartyBshallofferthehelpwhenitispossible.

4）.PartyBshouldattendmeetings，trainingsandanyotheractivitiesasPartyArequires.

3.SalaryandOvertime

1）.XXRMB/monthfor85workinghoursand_30_officehourspermonth.Workingnotmorethan115hourseverymonth.Anyservicerequestedbeyondthe85hours/monthwillbepaidatXXRMB/hour.

2）.Thefirstmonthistheprobation.Thesalaryis80%ofRMB.

3）.PartyAwillhelpPartyBtodotheVisa,andthecostwillbepaidbyPartyBfirstly.Aftertheone-yearcontract,PartyAwillreturnthemoneythatPartyBusedtodothevisaduringthepastyear.

4.LivingArrangements

PartyAprovidesPartyBwithnecessaryworkingandlivingconditions.PartyBwillberesponsibleforutilitiesbillsandotherexpenses（i.e.youdamagesomesomethingintheapartment）.

5.MedicalInsurance;SickLeave;Personalleave

1）.AfterPartyBsignsthecontract（fromStateAdministrationofForeignExpertsAffairs,P.R.China）withPartyA,PartyAshallpayformedicalinsuranceforthedurationofthecontract.

2）.Forsickleave,amedicalcertificateoranotefromahospitalordoctorshouldbepresentedtoPartyAwithin24hours.Inthiscase,salarywillbepaidat60%ofthenormalrateforthedurationofthesickleave,uptoamaximumof10daysperyear.

3）.IfPartyBasksforthepersonalleavebecauseofhisownreasons,PartyBshouldapplyforitoneweekinadvance,inthatcasePartyB’ssalarywillbedeductedthedailysalaryperdayforeverypersonalleave（oneday）.

6.Vacation

1）PartyBreceives11publicholidaysplustenpersonalholidays.

7.Airfareallowance

1）PartyAwillre-reimbursePartyB’sflightexpensetoChinauptoamaximum8,000RMB.

2）.IfPartyBbreaksthecontractbeforeitisfinished,theallowancewillnotbegiventoPartyB.

8.Breakingthecontract

PartyBisconsideredasbreakingthecontractandPartyAisentitledtoenforcemonetarypenaltiesunderthefollowingconditions:

1）.PartyBbreakseitherArticleinthiscontractordoesnotmakeanyimprovementafterthewarninggivenbyPartyA.

2）.PartyBcannotrestoretohisnormalworkafteracontinuousleaveofabsence.

3）.IfPartyBisconvictedofanycriminaloffence.

4）.IfPartyBisnotqualifiedfortheteachingpositionaccordingtotheevaluationbythestudents;orPartyBdoesn’tacceptthetrainingbyPartyAorPartyBcouldn’tmakeanyimprovementafterthetraining.

5）.IfPartyBwantstostopworkingwithPartyA,PartyBneedstoinformPartyAonemonthinadvance.

9.Confidentiality

1）.PartyBshallnotdiscloseinformationofsalaryorallowancestootherswithoutconsentofCompany.

2）.DuringthetermorafterleavingCompany,employeesshallkeepCompany’scommercialmaterialsandotherbusinessinformationconfidential.

3）.Uponterminationofemployment,employeesshallpromptlyreturnallassetsorrelevantbusinessmaterials,includingmaterials,notes,pictures,records,figures,plansorotherdocumentsrelatedtoCompanyenterprisesandcustomers.

ThiscontractwilltakeeffectonthedatesignedbybothPartyAandPartyBandwillautomaticallyexpirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldforwarditsrequesttoanotherparty30dayspriortotheexpirationofthecontract,andsignthenewcontractwithmutualconsent.Further,ifPartyBbreaksthecontract,PartyAhasrighttoterminatethecontract.IfPartyBbreaksthecontractduetoaseriouscriminaloffense,orleavestheschoolforanotherteachingpositionwithoutprovidingonemonth’snotice,PartyAhastherighttofinePartyB5000RMB.

2.PartyBisallowedfivedaysofsickleaveandfivedaysofpersonalvacationinadditiontothe11nationalholidayseachyear.

3.PartyBmaytakeuptofiveconsecutivedaysofmedicalleaveperyear.Afterfivedays,partyBwillnotreceivepay.

4.PartyBmustrespondtocallsanytimeofthedaywhenpartyBisleadingatour.

SalaryandBenefits

1.PartyBwillreceiveabasesalaryof3000RMBpermonth.

TerminationofContract
