Article1TheseRulesareformulatedinaccordancewiththeprovisionsoftherelevantlawsanddecreesforthepurposeofstrengtheningtheadministrationofemploymentofforeignersinChina
ArticleTheterm“foreigners”intheseRulesreferstothepersons,whoundertheNationalityLawofthePeople’sRepublicofChina,donothaveChinesenationality.Theterm“employmentofforeignersinChina”intheseRulesreferstoactsofforeignerswithoutpermanentresidencestatustoengageinremunerativeworkwithinChineseterritoryinaccordancewiththelaws.
ArticleTheseRulesshallapplytoemployedforeignerswithinChineseterritoryandtheiremployers.TheseRulesshallnotapplytoforeignerswhoenjoydiplomaticprivilegesandimmunitiesemployedbyforeignembassiesorconsulates,ortheofficesoftheUnitedNationsandotherinternationalorganizationsinChina.
ArticleThelabouradministrativeauthoritiesofthepeople’sgovernmentoftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentandthoseattheprefectureandcitylevelwiththeirauthorizationareresponsiblefortheadministrationofemploymentofforeignersinChina.
ChapterIIEmploymentLicense
ArticleTheemployershallapplyfortheemploymentpermissionifitintendstoemployforeignersandmaydosoafterobtainingapprovalandThePeople’sRepublicofChinaEmploymentLicenseforForeigners(hereinafterreferredtoasthe“EmploymentLicense”).
ArticleTheposttobefilledbytheforeignerrecruitedbytheemployershallbethepostofspecialneed,apostthatcannotbefilledbyanydomesticcandidatesforthetimebeingbutviolatesnogovernmentregulations.Noemployershallemployforeignerstoengageincommercializedentertainingperformance,exceptforthepersonsqualifiedunderArticle(3)oftheseRules.
ArticleAnyforeignersseekingemploymentinChinashallmeetthefollowingconditions:
(1)1yearsofageorolderandingoodhealth
(2)withprofessionalskillsandjobexperiencerequiredfortheworkofintendedemployment;
(3)withnocriminalrecord;
(4)aclearly-definedemployer;
(5)withvalidpassportorotherinternationaltraveldocumentinlieuofthepassport(hereinafterreferredtoasthe“TravelDocument”).
ArticleForeignersseekingemploymentinChinashallholdtheEmploymentVisasfortheirentry(Incaseofagreementformutualexemptionofvisas,theagreementshallprevail.),andmaywokwithinChineseterritoryonlyaftertheyobtaintheEmploymentPermitforForeigner(hereinafterreferredtoasthe“EmploymentPermit”)andtheforeignerresidencecertificate.
Foreignerswhohavenotbeenissuedresidencecertificate(i.e.holdersofF,L,CorG-typesvisas),andthosewhoareunderstudyorinterimprogramsinChinaandthefamiliesofholdersofEmploymentVisasshallnotworkinChina.Inspecialcases,employmentmaybeallowedwhentheforeignerchangeshisstatusatthepublicsecurityorganswiththeEmploymentLicensesecuredbyhisemployerinaccordancewiththeclearanceproceduresundertheseRules.ForeignerschangeshisstatusatthepublicsecurityorganswiththeEmploymentLicenseandreceiveshisEmploymentPermitandresidencecertificate.
TheemploymentinChinaofthespousesofthePersonnelofforeignembassies,consulates,representativeofficesoftheUnitedNationsSystemandotherinternationalorganizationsinChinashallfollowtheProvisionsofMinistryofForeignAffairsofthePeople’sRepublicofChinaConcerningtheEmploymentoftheSpousesofthePersonnelofForeignEmbassies,ConsulatesandtheRepresentativeOfficesoftheUnitedNationsSysteminChinaandbehandledinaccordancewiththeclearanceproceduresprovidedforinthesecondparagraphofthisarticle.
TheEmploymentLicenseandtheEmploymentPermitshallbedesignedandpreparedexclusivelybytheMinistryofLabour.
ArticleForeignersmaybeexemptedfromtheEmploymentLicenseandEmploymentPermitwhentheymeetanyofthefollowingconditions:
(1)foreignprofessionaltechnicalandmanagerialpersonnelemployeddirectlybytheChinesegovernmentorthosewithseniortechnicaltitlesorcredentialsofspecialskillsrecognizedbytheirhomeorinternationaltechnicalauthoritiesorprofessionalassociationstobeemployedbyChinesegovernmentorgansandinstitutionsandforeignersholdingForeignExpertCertificateissuedbyChina’sBureauofForeignExpertAffairs;
(2)foreignworkerswithspecialskillswhowokinoffshorepetroleumoperationswithouttheneedtogoashoreforemploymentandhold“WorkPermitforForeignPersonnelEngagedintheOffshorepetroleumOperationsinthePeople’sRepublicofChina”;
(3)foreignerswhoconductcommercializedentertainingperformancewiththeapprovaloftheMinistryofCultureandhold“PermitforTemporaryCommercializedPerformance”.
Article10ForeignersmaybeexemptedfromtheEmploymentLicenseandmayapplydirectlyfortheEmploymentPermitbypresentingtheirEmploymentVisasandrelevantpapersaftertheirentrywhentheymeetanyofthefollowingconditions:
(1)foreignersemployedinChinaunderagreementsoraccordsenteredintobytheChinesegovernmentwithforeigngovernmentsorinternationalorganizationsfortheimplementationofSino-foreignprojectsofcooperationandexchange;
(2)chiefrepresentativesandrepresentativesofthepermanentofficesofforeignenterprisesinChina.
ChapterIIIApplicationandApproval
Article11Theemployerwhenintendingtoemployaforeigner,shallfillouttheApplicationFormfortheEmploymentofForeigners(hereinafterreferredtoasthe”ApplicationForm”)andsubmitittoitscompetenttradeauthoritiesatthesamelevelasthelabouradministrativeauthoritiestogetherwiththefollowingdocumentations:
(1)thecurriculumvitaeoftheforeignertobeemployed;
(2)theletterofintentionforemployment;
(3)thereportofreasonsforemployment;
(4)thecredentialsoftheforeignerrequiredfortheperformanceofthejob;
(5)thehealthcertificateoftheforeignertobeemployed;
(6)otherdocumentsrequiredbyregulations.ThecompetenttradeauthoritiesshallexamineandapprovetheapplicationinaccordancewithArticlesandoftheseRulesandrelevantlawsanddecrees.
Article1Aftertheapprovalbythecompetenttradeauthorities,theemployershalltaketheApplicationFormtothelabouradministrativeauthoritiesoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentorthelabouradministrativeauthoritiesattheprefectureandcitylevelwherethesaidemployerislocatedforexaminationandclearance.
Thelabouradministrativeauthoritiesdescribedaboveshalldesignateaspecialbody(hereinafterreferredtoasthe”CertificateOffice”)totakeuptheresponsibilityofissuingtheEmploymentLicense.TheCertificateOfficeshouldtakeintoconsiderationoftheopinionsofthecompetenttradeauthoritiesandthedemandandsupplyoflabourmarket,andissuetheEmploymentLicensetotheemployerafterexaminationandclearance.
Article1EmployersattheCentrallevelorthosewithoutthecompetenttradeauthoritiesmaysubmittheirapplicationdirectlytotheCertificateOfficeofthelabouradministrativeauthoritiesfortheEmploymentLicense.
Theexaminationandapprovalbythecompetenttradeauthoritiesisnotrequiredforforeign-fundedenterprisestoemployforeigners,andsuchenterprisesmaysubmittheirapplicationsdirectlytotheCertificateOfficeofthelabouradministrativeauthoritiesfortheEmploymentLicense,bringingwiththemthecontract,articlesofassociation,certificateofapproval,businesslicenseandthedocumentsreferredtoinArticle11oftheseRules.
Article1EmployerswithpermissiontoemployforeignersshallnotsendtheEmploymentLicensenortheletterofvisanotificationdirectlytotheforeignerstobeemployedandtheymustbesentbytheauthorizedunit.
Article1ForeignerswithpermissiontoworkinChinashouldapplyforEmploymentVisasattheChineseembassies,consulatesandvisaoffices,bringingwiththemtheEmploymentLicenseissuedbytheMinistryofLabour,theletterortelexofvisanotificationsentbytheauthorizedunitandthevalidpassportorTravelDocument.
PersonnelreferredtoinArticle
(1)oftheseRulesshouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbyauthorizedunit;personnelreferredtoinArticle
(2)shouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationissuedbytheChinaNationalOffshoreOilCorporation;
personnelreferredtoinArticle9(3)shouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationissuedbytheforeignaffairs,officeunderthepeople’sgovernmentofprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernmentandtherelevantdocumentsofapprovaloftheMinistryofCulture(addressedtotheChineseembassies,consulatesorvisaoffices).
PersonnelreferredtoinArticle10
(1)oftheseRulesshouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbyauthorizedunitandthedocumentationonprojectsofcooperationandexchange;personnelreferredtoinArticle10
(2)shouldapplyfortheEmploymentVisasbypresentingtheirletterortelexofvisanotificationbytheauthorizedunitandtheregistrationcertificationissuedbytheadministrativeauthoritiesofindustryandcommerce
Article1Theemployershould,withinfifteendaysaftertheentryoftheemployedforeigner,taketotheoriginalCertificateOfficetheEmploymentLicense,
