CHAPTERIGENERALPROVISIONS

Article1ThisLawisenactedinaccordancewiththeConstitutionwithaviewtodevelopingthecauseofeducation,enhancingthequalityoftheentirenationandpromotingthesocialistmaterialaswellasculturalandethicalprogress.

Article2ThisLawshallbeapplicabletoeducationofalltypesandatalllevelsofferedwithintheterritoryofthePeople'sRepublicofChina.

Article3Indevelopingthecauseofsocialisteducation,theStateadherestotakingMarxism,Leninism,MaoZedongThoughtandthetheoryofbuildingsocialismwithChinesecharacteristicsasitsguidelinesandfollowsthebasicprinciplesdefinedintheConstitution.

Article4Educationisthebasisofthesocialistmodernizationdrive,andtheStateensuresprioritytothedevelopmentofeducationalundertakings.

Theentiresocietyshouldshowconcernforandgivesupporttothedevelopmentofeducationalundertakings.

Theentiresocietyshouldrespectteachers.

Article5Educationmustservethesocialistmodernizationdriveandmustbecombinedwithproductionandphysicallabourinordertotrainforthesocialistcausebuildersandsuccessorswhoaredevelopedinanall-roundway-morally,intellectuallyandphysically.

Article6TheStateconductseducationamongeducateesinpatriotism,collectivism,socialismaswellasintheimportanceofideals,ethics,discipline,thelegalsystem,nationaldefenseandnationalunity.

Article7IneducationthebrillianthistoricandculturaltraditionoftheChinesenationshallbeinheritedandcarriedforwardandallotherexcellentachievementsofhumancivilizationshallbeabsorbed.

Article8EducationalactivitiesshallconformtotheStateandpublicinterests.

TheStateseparateseducationfromreligion.NoorganizationorindividualmaymakeuseofreligiontoconductactivitiesthatinterferewiththeeducationalsystemoftheState.

Article9CitizensofthePeople'sRepublicofChinashallhavetherightandobligationtoreceiveeducation.

Allcitizens,regardlessofethnicgroup,race,sex,occupation,propertystatusorreligiousbelief,shallenjoyequalopportunitiesforeducationaccordingtolaw.

Article10TheState,inlightofthecharacteristicsandneedsofthedifferentminorityethnicgroups,providesassistancetothedevelopmentofeducationalundertakingsinregionsinhabitedbytheminorityethnicgroups.

TheStatesupportsandassiststhedevelopmentofeducationalundertakingsintheoutlyingandpoverty-strickenareas.

TheStatesupportsanddevelopseducationalundertakingsforthedisabled.

Article11Tomeettheneedsofdevelopingasocialistmarketeconomyandpromotingsocialprogress,theStatecarriesforwardeducationalreform,fostersacoordinateddevelopmentofeducationatvariouslevelsandofvarioustypes,andestablishesandimprovesasystemoflife-longeducation.

TheStatesupports,encouragesandorganizesscientificresearchineducation,disseminatetheresultsofscientificresearchineducationsoastoenhancethequalityofeducation.

Article12ThespokenandwrittenChineselanguageshallbethebasicspokenandwrittenlanguageinteachinginschoolsandotherinstitutionsofeducation.Inschoolsandotherinstitutionsofeducationinwhichstudentsofaminorityethnicgroupconstitutethemajority,thespokenandwrittenlanguageusedbythespecificethnicgrouporcommonlyusedbythelocalethnicgroupsmaybeusedforinstruction.

Putonghua（commonspeechbasedonBeijingpronunciation）andthestandar-dizedcharactersdesignedforusethroughoutthecountryshallbewidelyusedininstructioninschoolsandotherinstitutionsofeducation.

Article13TheStateawardsunitsorindividualsthathavemadeoutstandingachievementsinthedevelopmentofeducation.

Article14TheStateCouncilandthelocalpeople'sgovernmentsatvariouslevelsshallguideandadministereducationalworkundertheprinciplesofadmini-strationbydifferentlevelsandofadivisionofresponsibilities.

Secondaryeducationandeducationatlowerlevelsshallbeadministeredbythelocalpeople'sgovernmentsundertheguidanceoftheStateCouncil.

HighereducationshallbeadministeredbytheStateCouncil,and/orthepeople'sgovernmentsofprovinces,autonomousregions,ormunicipalitiesdirectlyundertheCentralGovernment.

Article15TheadministrativedepartmentofeducationundertheStateCouncilshallbeinchargeofthenationwideeducationalwork,andundertakeoverallplanning,coordinationandmanagementoftheeducationalundertakingsthroughoutthecountry.

Theadministrativedepartmentsofeducationunderthepeople'sgovernmentsatorabovethecountylevelshallbeinchargeoftheeducationalworkintheirrespectiveadministrativeregions.

Otherdepartmentsconcernedunderthepeople'sgovernmentsatorabovethecountylevelshallberesponsiblefortherelatededucationalworkwithinthescopeoftheirfunctionsandduties.

Article16TheStateCouncilandthelocalpeople'sgovernmentsatorabovethecountylevelshallreporttothepeople'scongressesatthecorrespondinglevelsortheirstandingcommitteesontheworkofeducationandonthebudgetsandfinalaccountsoftheoperatingexpensesforeducation,whichshallbesubjecttosupervision.

CHAPTERIIBASICSYSTEMOFEDUCATION

Article17TheStateappliesaschooleducationsystemembracingpre-schooleducation,primaryeducation,secondaryeducationandhighereducation.

TheStateestablishesascientificschoolingsystem.Theestablishment,formsofinstruction,lengthofschooling,enrollmenttargets,objectivesoftraining,etc.ofschoolsandotherinstitutionsofeducationgovernedbytheschoolingsystemshallbeprescribedbytheStateCouncilortheadministrativedepartmentofeducationempoweredbytheStateCouncil.

Article18TheStateappliesasystemofnine-yearcompulsoryeducation.

People'sgovernmentsatalllevelsshalltakevariousmeasurestoguaranteeschool-agechildrenandadolescentsaccesstoeducation.

Parentsorotherguardiansofschool-agechildrenandadolescentsaswellassocialorganizationsandindividualsconcernedshallhavetheobligationtoensurethatschool-agechildrenandadolescentsreceiveandcompletecompulsoryeducationfortheprescribednumberofyears.

Article19TheStateappliesasystemofvocationaleducationandasystemofadulteducation.

People'sgovernmentsatvariouslevels,theadministrativedepartmentsconcer-nedandenterprisesandinstitutionsshalladoptmeasurestodevelopeducationalprogramsandguaranteethatcitizensreceiveeducationinvocationalschoolsordifferenttypesofvocationaltraining.

TheStateencouragesthedevelopmentofvariedformsofadulteducationsothatcitizensmayreceiveappropriateeducationinpolitics,economics,culture,scienceandtechnologyandprofessionalorlife-longeducation.

Article20TheStateappliesanationaleducationexaminationsystem.

TheadministrativedepartmentofeducationundertheStateCouncilshalldeterminethetypesofnationaleducationexaminationwhichshallbeundertakenbytheinstitutionsthatconductsucheducationexaminationasapprovedbytheState.

Article21TheStateappliesasystemofeducationcertificates.

SchoolsandotherinstitutionsofeducationestablishedwiththeapprovaloforrecognizedbytheStateshall,inaccordancewiththerelevantregulationsoftheState,granteducationalqualificationcertificatesorothereducationcertificates.

Article22TheStateappliesasystemofacademicdegree.

Institutionsentitledtograntacademicdegreesshallgranttopersonswhohaveattainedtherequiredacademicorprofessionalortechnicallevelcorrespondingacademicdegreesandissuetothemdegreecertificatesinaccordancewithlaw.

Article23People'sgovernmentsatvariouslevels,grass-rootsautonomousorganizationsofamasscharacterandenterprisesandinstitutionsshalltakeallkindsofmeasurestocarryoutliteracyeducationprogram.

CitizenscapableofreceivingliteracyeducationaccordingtorelevantregulationsoftheStateshallreceiveliteracyeducation.

Article24TheStateappliesaneducationalsupervisionsystemandaneducationalevaluationsystemforschoolsandotherinstitutionsofeducation.

CHAPTERIIISCHOOLSANDOTHERINSTITUTIONSOFEDUCATION

Article25TheStateformulatesplansforthedevelopmentofeducationandestablishesandrunsschoolsandotherinstitutionsofeducation.

TheStateencouragesenterprises,institutions,publicorganizationsandothersocialorganizations,aswellasindividualcitizenstoestablishandrunschoolsorotherinstitutionsofeducationinaccordancewithlaw.

Noorganizationorindividualmayestablishorrunaschooloranyotherinstitutionofeducationforprofit-makingpurposes.

Article26Fortheestablishmentofaschooloranyotherinstitutionofeducation,thefollowingbasicconditionsshallbefulfilled:

（1）havinganorganizationalstructureandrulesandregulations;

（2）havingqualifiedteachers;

（3）havingteachingpremises,facilitiesandequipmentthatareuptotherequiredstandards;and

（4）havingthenecessaryfundsforrunningtheschoolaswellasastablesourceoffunding.

Article27Theestablishment,modificationorterminationofaschooloranyotherinstitutionofeducationshall,inaccordancewiththerelevantregulationsoftheState,gothroughtheformalitiesofexamination,verification,approvalandregistrationorfilingfortherecord.

Article28Schoolsandotherinstitutionsofeducationshallexercisethefollowingrights:

（1）toadministerschoolaffairsindependentlyinaccordancewiththeirrulesandregulations;

（2）toorganizeandconducteducationalandteachingactivities;

（3）toenrollstudentsorothe
