中华人民共和国海关企业分类管理办法

MeasuresoftheCustomsofthePeople’sRepublicofChinafortheClassifiedManagementofEnterprises

《中华人民共和国海关企业分类管理办法》已于2010年10月14日经海关总署署务会议审议通过，现予公布，自2011年1月1日起施行。

第一章　总　则

ChapterIGeneralProvisions

第一条　为了鼓励企业守法自律，提高海关管理效能，保障进出口贸易的安全与便利，根据《中华人民共和国海关法》及其他有关法律、行政法规的规定，制定本办法。

Article1ThemeasuresshallinaccordancewiththeCustomsLawofthePeople’sRepublicofChinaandotherrelatedlawsandadministrativeregulationsbeformulatedforthepurposeofmakingenterpriseslaw-abidingandself-disciplined,raisingthemanagementefficiencyofthecustomsandensuringthesecurityandfacilityofimportandexporttrade.

第二条　在海关注册登记的进出口货物收发货人、报关企业的分类管理，适用本办法。

Article2Theclassifiedmanagementoftheregistrationofaconsignorsorconsigneesofimportedorexportedgoodsanddeclarationenterprisesinthecustomsshallbesubjecttothemeasures.

其他企业的分类管理，由海关总署另行规定。

TheclassifiedmanagementofotherenterprisesshallbeseparatelyprovidedbytheGeneralAdministrationofCustoms.

第三条　海关根据企业遵守法律、行政法规、海关规章、相关廉政规定和经营管理状况，以及海关监管、统计记录等，设置AA、A、B、C、D五个管理类别，对有关企业进行评估、分类，并对企业的管理类别予以公开。

Article3ThecustomsshallsetsuchfivecategoriesofmanagementasAA,A,B,CandDbasedonthestatusofenterprisesabidingbylaws,administrativeregulations,therulesofcustoms,relatedprovisionsforincorruptgovernmentandoperationmanagementaswellascustomssupervisionandstatisticrecordtoconductassessmentandclassificationonrelevantenterprisesandmakethemanagementclassificationofenterprisespublic.

第四条　海关总署按照守法便利原则，对适用不同管理类别的企业，制订相应的差别管理措施，其中AA类和A类企业适用相应的通关便利措施，B类企业适用常规管理措施，C类和D类企业适用严密监管措施。

Article4TheGeneralAdministrationofCustomsshallintheprincipleoflawabidingandfacilityformulatecorrespondingdifferentmeasuresofmanagementfortheenterpriseswithdifferentclassificationsofmanagement,ofwhichAA-andA-classificationenterprisesshallbesubjecttocorrespondingmeasuresforcustomsclearanceconvenience,B-classificationenterprisestoroutineadministrationmeasuresandC-andD-classificationenterprisestostringentregulatorymeasures.

全国海关实行统一的企业分类标准、程序和管理措施。

ThecustomsacrossChinashallconducttheuniformstandard,proceduresandmanagementmeasuresfortheclassificationofenterprises.

海关与企业应当加强合作，开展经常性信息交流和业务联系。

Thecustomsshallstrengthencooperationwithenterprisesandconductregularinformationexchangeandbusinesscontacttherewith.

第五条　海关总署对企业分类管理工作进行指导、监督；直属海关负责审定、调整本关区企业适用的管理类别。

Article5TheGeneralAdministrationofCustomsshallconductguidanceandsupervisionovertheclassificationmanagementofenterprises;andthedirectlycompetentcustomsentityshallberesponsibleforexaminingandapprovingandadjustingthemanagementclassificationsfortheenterprisesinthecharge.

第二章　管理类别的设定

ChapterIISettingofManagementClassification

第一节　进出口货物收发货人

SectionIAconsignororconsigneeofimportedorexportedgoods

第六条　AA类进出口货物收发货人，应当同时符合下列条件：

Article6AconsignororconsigneeofAA-classificationimportedorexportedgoodsshouldbesimultaneouslyqualifiedforthefollowingconditions:

（一）符合A类管理条件，已适用A类管理1年以上；

（1）qualifiedforrequirementsforA-classificationmanagementforoveroneyear;

（二）上一年度进出口报关差错率3%以下；

（2）havingtheerrorrateofimportorexportdeclarationbelow3percentduringthepreviousyear;

（三）通过海关稽查验证，符合海关管理、企业经营管理和贸易安全的要求；

（3）meetingtherequirementsforcustomsadministration,enterprisebusinessmanagementandtradingsafetyupontheinspectionofthecustoms;

（四）每年报送《企业经营管理状况评估报告》和会计师事务所出具的上一年度审计报告；每半年报送《进出口业务情况表》。

（4）annuallysubmittingtheReportonAssessingEnterpriseBusinessManagementStatusandthepreviousyear’sauditreportissuedbytheaccountingfirm;andsemiannuallysubmittingtheStatementofImportorExportBusiness.

第七条　A类进出口货物收发货人，应当同时符合下列条件：

Article7AconsignororconsigneeofA-classificationimportedorexportedgoodsshouldbesimultaneouslyqualifiedforthefollowingconditions:

（一）已适用B类管理1年以上；

（1）qualifiedforB-classificationmanagementforoveroneyear;

（二）连续1年无走私罪、走私行为、违反海关监管规定的行为；

（2）havingnooffenseofsmuggling,smugglingactsoractsoftransgressingcustomscontrolrulesconsecutivelyforoneyear;

（三）连续1年未因进出口侵犯知识产权货物而被海关行政处罚；

（3）havingnoadministrativepenaltybycustomsforimportingorexportinggoodsinfringingintellectualpropertyrightconsecutivelyforoneyear;

（四）连续1年无拖欠应纳税款、应缴罚没款项情事；

（4）havingnotdefaultedpayabletaxorfineorconfiscatedmoneyconsecutivelyforoneyear;

（五）上一年度进出口总值50万美元以上；

（5）thetotalvalueofimportandexportabove$500,000duringthepreviousyear;

（六）上一年度进出口报关差错率5%以下；

（6）havingtheerrorrateofimportorexportdeclarationbelow5percentduringthepreviousyear;

（七）会计制度完善，业务记录真实、完整；

（7）havingsoundaccountingrules,aswellastruthfulandcompletebusinessrecord;

（八）主动配合海关管理，及时办理各项海关手续，向海关提供的单据、证件真实、齐全、有效；

（8）havingtakeninitiativesincooperationwithcustomsadministration,timelyhandlingvariouscustomsformalities,andprovidedtruthful,completeandvaliddocumentsandcertificatestothecustoms;

（九）每年报送《企业经营管理状况评估报告》；

（9）annuallysubmittingtheReportonAssessingEnterpriseBusinessManagementStatus;

（十）按照规定办理《中华人民共和国海关进出口货物收发货人报关注册登记证书》的换证手续和相关变更手续；

（10）handlingreplacementproceduresoftheCustomsDeclarationRegistrationCertificateoftheCustomsofthePeople’sRepublicofChinaforAconsignororconsigneeofimportedorexportedgoodandrelatedalterationformalitiesaccordingtoprovisions;

（十一）连续1年在商务、人民银行、工商、税务、质检、外汇、监察等行政管理部门和机构无不良记录。

（11）havingnoevilrecordsinthecommerce,people’sbankofChina,industryandcommerce,taxation,qualityinspection,foreignexchange,supervisionandotheradministrativedepartmentsandinstitutionsconsecutivelyforoneyear.

第八条　进出口货物收发货人有下列情形之一的，适用C类管理：

Article8AconsignororconsigneeofimportedorexportedgoodsshallbesubjecttoC-classificationmanagementinoneofthefollowingconditions:

（一）有走私行为的；

（1）havingcommittedtheactofsmuggling;

（二）1年内有3次以上违反海关监管规定行为，且违规次数超过上一年度报关单及进出境备案清单总票数1‰的，或者1年内因违反海关监管规定被处罚款累计总额人民币100万元以上的；

（2）havingcommittedtheactoftransgressingcustomscontrolrulesthreetimesormorewithinoneyear,withthenumberofviolationssurpassing0.1percentofthetotalofthecustomsdeclarationandentryandexitregistrationlist;ortheaccumulatedfinefortheactoftransgressingcustomscontrolruleswithinoneyearreachingmorethan1millionyuan;

（三）1年内有2次因进出口侵犯知识产权货物而被海关行政处罚的；

（3）havingadministrativepenaltybycustomsforimportingorexportinggoodsinfringingintellectualpropertyrighttwicewithinoneyear;

（四）拖欠应纳税款、应缴罚没款项人民币50万元以下的。

（4）defaultedpayabletaxorpenaltybeingbelow500,000yuan.

第九条　进出口货物收发货人有下列情形之一的，适用D类管理：

Article9AconsignororconsigneeofimportedorexportedgoodsshallbesubjecttoD-classificationmanagementinoneofthefollowingconditions:

（一）有走私罪的；

（1）havingcommittedthecrimeofsmuggling;

（二）1年内有2次以上走私行为的；

（2）havingcommittedtheactofsmugglingtwiceorabovewithinoneyear;

（三）1年内有3次以上因进出口侵犯知识产权货物而被海关行政处罚的；

（3）havingadministrativepenaltybycustomsforimportingorexportinggoodsinfringingintellectualpropertyrightsthreetimesormorewithinoneyear;

（四）拖欠应纳税款、应缴罚没款项超过人民币50万元的。

（4）defaultedpayabletaxorpenaltyexceeding500,000yuan.

第十条　进出口货物收发货人未发生本办法第八条和第九条所列情形并符合下列条件之一的，适用B类管理：

Article10AconsignororconsigneeofimportedorexportedgoodsshallbesubjecttoB-classificationmanagementnotinthesituationofArticle8and9ofthemeasuresbutinoneofthefollowingconditions:

（一）首次注册登记的；

（1）havingbeenregisteredforthefirsttime;

（二）首次注册登记后，管理类别未发生调整的；

（2）managementcategoryhavingneverbeenadjustedaftertheinitialregistration;

（三）AA类企业不符合原管理类别适用条件，并且不符合A类管理类别适用条件的；

（3）AA-classificationenterprisesbeingnotqualifiedfororiginalmanagementclassificationconditionsortheonesforA-classificationmanagement;

（四）A类企业不符合原管理类别适用条件的。

（4）A-classificationenterprisesbeingnotqualifiedfortherequirementsfortheoriginalmanagementclassification.

第十一条　在海关登记的加工企业，按照进出口货物收发货人实施分类管理。

Article11Processingenterprisesregisteredinthecustomsshallconductclassificationmanagementaccordingtoconsignororconsigneeofimportedorexportedgoods.

第二节　报关企业

SectionIIDeclarationenterprise

第十二条　AA类报关企业，应当同时符合下列条件：

Article12AA-classificationdeclarationenterprisesshouldbesimultaneouslyqualifiedforthefollowingrequirements:

（一）符合A类管理条件，已适用A类管理1年以上；

（1）beingqualifiedandappliedforandtoA-classificationmanagementformorethanoneyear;

（二）上一年度代理申报的进出口报关单及进出境备案清单总量在2万票（中西部5000票）以上；

（2）thetotalofreportedcustomsdeclarationofimportandexportandexitandentryregistrationundertheagencyduringthepreviousyearbeingabove20,000pieces（5,000piecesinthecentralandwesternregions）;

（三）上一年度进出口报关差错率3%以下；

（3）havingtheerrorrateofimportorexportdeclarationbelow3percentduringthepreviousyear;

（四）通过海关稽查验证，符合海关管理、企业经营管理和贸易安全的要求；

（4）meetingtherequirementsforcustomsadministration,enterprisebusinessmanagementandtradingsafetyupontheinspectionofthecustoms;

（五）每年报送《企业经营管理状况评估报告》和会计师事务所出具的上一年度审计报告；每半年报送《报关代理业务情况表》。

（5）annuallysubmittingtheReportonAssessingEnterpriseBusinessManagementStatusandthepreviousyear’sauditreportissuedbytheaccountingfirm;andsemiannuallysubmittingtheStatementofImportorExportBusiness.

第十三条　A类报关企业，应当同时符合下列条件：

Article13AA-classificationdeclarationenterprisesshouldbesimultaneouslyqualifiedforthefollowingrequirements:

（一）已适用B类管理1年以上；

（1）beingappliedforB-classificationmanagementforoveroneyear;

（二）企业以及所属执业报关员连续1年无走私罪、走私行为、违反海关监管规定
